      On January 16th, we reached out to ********************* of Assured Partners LLC; the broker for Acuity. We asked why our rate increased by $78. We were told that based on a previous audit that we filled out, they raised our rates for hardwood flooring being installed. 2% of Rice Flooring's work is hardwood. At this point, we decided to cancel our insurance with Assured Partners - Acuity. The representative, *********************, clearly tried to keep our business but the savings was too great by switching to another company. We moved forward with cancelling the policy and there was no mention by **************** of any fees, future audits, etc. that could be incurred from canceling. He asked his secretary on Jan. 17 to send over the Docu Sign email for cancellation. My wife signed it on January 19th and we were sent documentation that the policy had been canceled. Based on us no longer being a customer of Acuity or **********************, LLC, we expected no future correspondence from them. Acuity then sent an audit after we had already cancelled claiming it was due to our "short policy" being cancelled. We were NEVER made aware that we had any type of short policy and feel that this is verbiage being used to simply charge people money after they no longer want to do business with Acuity. Given that we were no longer a customer, their seemed no reason to complete the audit paperwork. They stated that non-compliance of the audit paperwork could result in a surcharge (very vague) and said, and/OR cancellation of my policy. Since my POLICY WAS ALREADY CANCELLED, it seemed as if this was just a way to be mad that I cancelled and a SCAM to charge me additional monies. I have always filled out audit paperwork DURING MY TIME AS A CUSTOMER. No additional charges were ever charged, so why now? Because, they want to PUNISH THE SMALL BUSINESS MAN, and CHARGE BOGUS CHARGES AFTER CANCELLATION. They are simply making up their own rules. I want them to send notification in writing that I owe $0.

      I visited the ***** office of Assured Partners of Missouri and voiced my complaint today mid day. They had no response and were really left speechless. They said all I needed to do was fill out the audit paperwork and it would "all go away". I was told the charges would be dropped if I filled out the audit paperwork even though I canceled as of 2/2 and just now received this paperwork as of 4/28. I would also like to note that their business practices are shameful and the due date of payment for this amount that they are wrongfully charging is me is 5/12. The lady at Assured said that the audit report was sent as a way to calculate my premium moving forward for the next 12 months. Again, I said, then "why" do I have to fill it out as I have no intention of moving forward with this company and have already cancelled. No reply from her other than, "that's not how this works". I also pointed out that the bill was just received on Sunday, 4/28 and has the phrases "short rate" and "surcharged exposures" marked which were NOT noted on my cancellation paperwork that is signed by *********************, their agent. It also says that if I didn't fill out the audit paperwork that they may charge up to triple my annual premium even though Missouri only allows up to two times AND/OR cancellation of my policy. But, my policy was already cancelled so attempting to charge me this $2,244 is a way to punish me for cancelling. Short rates and surcharge premiums were never mentioned when I cancelled my policy nor was I ever notified of any type of verbiage.

      We have reviewed the complaint.  I interviewed the producer on the account, *********************.  His statement is attached for your review.  The insured was given the original policy to start coverage back in 2019 and they have received renewals every year since.  When a policy is sold as well as renewed our producers and account managers ask the clients to review the policy and let us know if any questions.  The clients says in the complaint he has never been charged for additional premium for audits, but as explained in the attached letter from **** there has been at least 3 years where he was charged.  Our position on this complaint is that we gave the client the information needed to be aware of the audits as well as the statement in the policy regarding the how Acuity handles cancellations.  They are not bogus charges, and he owes them as explained clearly in the policy.
