    Details of Complaint:Company Involved: Earnings Whisper, a financial services website.Issue: Charged $199.95 during a "two-week free trial" period.Sign-Up Date: October 30th 2024 at 9:09 am.Charge Date: October 30th 2024 Summary of Complaint:Misleading Trial Offer:I was offered a two-week free trial with a clear statement that I would not be charged until the trial period ended.Without warning, I was charged $199.95 before the trial period concluded.Ineligibility ************************************* informed me, after charging my card, that I was ineligible for the free trial due to a previous trial in August.There was no notification during sign-up that I was ineligible for the trial based on prior use.If informed, I would not have proceeded with the sign-up, and the charge would have been avoided.Refund Denied:Upon contacting customer service, my request for a refund was denied.I was not given prior notice of the charge and did not authorize payment outside the free trial agreement.Consumer Harm:This lack of transparency in eligibility and billing practices likely affects other consumers similarly.Many trial-based services inform users if they are ineligible for a free trial before proceeding with sign-up, which this company failed to do.Request for Relief:1. I am seeking a refund of $199.95, which I believe was charged deceptively.2. Additionally, I request that Earnings Whisper update its website to:Clearly inform consumers if they are ineligible for a free trial.Provide explicit notice if a charge will occur due to ineligibility.Conclusion: This companys practices are misleading and need to be investigated to prevent future consumers from similar unauthorized charges.

    On July 30, 2024, ****** **** signed up for our free service.A week later, he signed up for our lower-tiered ***************** which requires a paid subscription but does not have a free trial. When he did so, he checked a box that said he had read and agreed to our terms of service, which states explicitly:

     "We offer a no-obligation, free trial to the ************** for you. This free trial is exactly that a FREE opportunity to explore ******** Whispers' services without cost. Free trials are limited to one per customer. Duplicate trials will be identified as 'bad faith' actors and are not eligible for refunds or account credit following any ******** Whispers purchase."

    This policy is available at **************************************** and is easily accessible from every page on our website.

    For the next three weeks, he continued to use this service and accessed ***** pages before deciding to upgrade to the higher-tiered ************** and utilize our free trial. On August 27, 2024, he once again checked a box that said he agreed to the policy regarding the free trial. He used this service for ten days and accessed 495 pages before deciding to cancel the free trial. Then, he continued to use our site for nearly two months and accessed 437 pages. Therefore, by the time he signed up to use our ************** again on October 30, 2024, he was quite familiar with our website, our services and offerings, and our terms of use. That is why he, for the third time, confirmed that he had read and agreed that he would be charged if he continued to sign up for this service. Likewise, to protect ourselves from bad actors who try to repeatedly gain access to our intellectual property without paying, particularly during peak periods, ****** **** was charged for his second signup to our **************.

    I have reviewed the business' response and am rejecting it because:

    I was fine paying the $49.95 fee as I was using it for informational purposes only. I didn't use or act up any of the additional benefits from the $199.95 ****** services. As I said earlier, I am not a bad actor nor trying to scam you guys from not having to pay. I would not have signed up for ****** Services if your site clearly said that I am not eligible for a free trial which your site didn't do and is misleading. Your site clearly told me that I am eligible for a two week free trial as I even took a screenshot and was charged without my permission nor informing me that I am ineligible.

     

    All you had to do was let me know I am ineligible for a free trial and I will have to pay $199.95 If I am interested in using your trader services which wasn't done. Hence I am asking to refund my $199.95 for services I don't use nor care on using ever again.
