  My husband and and I had an inground pool put in our backyard in 2024.Along with the pool we had a large retaining wall built, a concrete patio rebuilt, concrete placed around the pool, the back yard regraded and fenced in. We hired JH Construction from ********, MO for the work. **** ***** is the owner in the company and who we worked ******* Hamby was very responsive during the negotiations for getting the contract as well as during the completion of the construction. There were issues with the concrete work such as foot prints left by the workers and spider cracks developing in the concrete. We were able to work with Mr. ***** by having money taken off our bill for future cosmetic work.This year we noticed gaps starting at a couple of the concrete seams leading to the pool. Mr ***** has been contacted numerous times since 8/27/25 about repairing these. He came out once to look at the first gaping seam on 8/28/25 and left telling us he would be back after getting supplies to repair it. He never returned.Since then we have sent 10 text messages on separate days at various times asking him to speak with us regarding the gaping seams. A couple phone calls have also been placed to Mr. ***** with messages left asking him to call us. A second seam began to pull apart by 9/2/25 which Mr. ***** was sent pictures of. He was sent videos of the gaping seems on Monday 9/22/25. The cracks are spreading and the concrete is shifting. Mr. ***** again told us he would come over to our house. Again he has yet to come over to observe and repair the concrete or contact us.We would appreciate advice on how to work with Mr. ***** to get the repairs made or pay for the repairs if another company makes them.

  This response has been given to me several times already and Mr ***** never shows up to fix the gaping concrete. I will close out the case only when the problem is solved and the concrete repaired.

  As I suspected JH Construction never reached out to speak with me nor did **** ***** come to my home and complete the work as he responded to the BBB he would.  This is his pattern with customers. He says he will do something and doesnt. He and his company continue to cheat and rip off people.

  He signed a contract to complete the job, and he did not complete the job. He was supposed to build a pool, landscaping, put up a deck and a fence. He started the job three years ago. He comes by every so often and does a little more work. I had to pay someone else to finish the job. I paid the full price upfront.

  We were over there to get everything lined up, but he already had someone at the house to do the pavers.  The deck was not in the contract.  He never paid anything for the work we did do on the deck.  I gave him materials we purchased for the job including the pool liner.  He paid me for the pavers.  They were upgrade from the contract for the pool.  We brought in about $2800 of top soil that he wanted to grade out the lower yard.  He did not pay for that part.  There were some parts that needed to be finished up on our part, he did not give us the opportunity to finish that part.  We have no animosity towards him.

  On April 29, 2023, I entered into an agreement with JH Construction to build a retaining wall for me. ******************* is the owner of this company. He has worked with my next door neighbor for years as a backhoe operator; he has his own business and equipment. He often hires people to do things like build the retaining wall after he prepares the ground with his heavy equipment. He was building a retaining wall for my next door neighbor and I asked him to build one for me as well while he had the equipment and crew available.Our original agreement was for a 5 foot high wall for $13,000.00. I paid him $6,500.00 to start the job on May 1, 2023. As the as the work progressed, I became nervous that it was not going to be high enough to protect my driveway from collapse. **** agreed to build it two feet higher for an additional $2,800.00.The crew building the wall completed it the work on May 19, 2023. **** was supposed to bring in more dirt to smooth out the top and make it level. He promised to come back the next day so I paid him the remaining amount owed of $9,300.00 on that day. He never came back, we spoke on the phone and texted for several months until he stopped taking my calls.I know you should not pay a contractor in full until the job is finished but this job was hours away from being complete and we have know each other through my next door neighbor for many years. I just want the top of the wall leveled so I can plant grass on it.I look forward to hearing from you and hope that if you speak to him, he will honor his promise to complete the top of my side yard between the wall and the driveway as promised or refund $1000.00. This is the amount I will have to pay someone else to finish the job. I have pictures and text messages to offer as proof if needed.Thank you,
