    We purchased a home from Ashlar LLC in July of 2021. In the spring, Ashlar started development on a home next door. They did not place a silt fence up and the mud washed over destroying my back yard. This occurred twice. The “fix” Ashlar decided was to contract a sod company, ****** *****, to place sod over the mud. No other remedy was done, just placed sod. Not only did this change the grade of the yard but it also created excessive erosion and they didn’t even place enough sod to actually repair all of the damage. As a result, we were getting mold in our grass and excessive bugs. After MULTIPLE attempts to seek Ashlar to fix their damage appropriately, they continued to deny the issue was theirs. They continued to claim that is wasn’t within warranty, however I’m not claiming it’s a warranty item. I believe it was damage to my property and Ashlar refuses to fix the damage they did. And now it has cost me 4100 dollars for drainage systems to fix the damage.

    As late as July and Early August we had responded to the customer indicating we would be fixing the area on the side of the house that was not draining.  We were doing a repair down the road that once complete with that we were going to work on the customers side yard.

    The rear yard of the customers house had positive drainage that we had verified on multiple occasions.  Mr. ******* had also reached out to 2-10 warranty about the issue and they had indicated as well that this was not a warrantable condition.

    In section 12 of the contract Mr. ******* signed when purchasing the home it indicates that our price includes gutters and splash blocks only and that any other drainage options required are the responsibility of the homeowner.  Mr. ******* buried his downspouts and his sump pump as part of the work that he is requesting reimbursement for.  These are clear in the contract that they are not part of our specifications and that those things if desired or needed are responsibility and cost to the homeowner.

    Now that the customer has decided to make repairs on the side of the house without waiting on us to do the work we said we would it makes it hard to value what the cost of that repair would have been.  I would be happy to reimburse Mr. ******* the cost of what our repairs would have been, but that would be significantly less than the 4100.00 her paid for burying downspouts and sump pumps.   Our repairs would have been done by regrading the side yard and repairing that sodded area only.

    I am rejecting this response because:



    Firstly, none of this complaint is about the sides of the house.  That would be settled with 2-10 warranty if I so desire to pursue arbitration through the warranty manager.  The fact that I have to even consider seeking arbitration because you won’t, as you say, come dump dirt on my property is ridiculous, but I digress.  This complaint is about the damage that Ashlar committed to the back yard as documented.  That damage has no bearing on the warranty and I do not claim it is a warrantable issue.  I believe you negligently managed your construction site, damaged my property, and then refused to appropriately repair it.  I would be willing to discuss compensation, but have yet to hear from anyone in regard to that.   Ashlar has my phone number, email, and address, so what is the hesitation if you are planning to offer compensation?  As soon as you reach out and we discuss appropriate compensation, I will mark this complaint as resolved.
