- Government Actions:Government Action: BBB reports on known government actions involving business’ marketplace conduct:MN Attorney General Assurance of Discontinuance
On January 28. 2022, the business entered into an Assurance of Discontinuance with the Minnesota Attorney General. The Assurance settles allegations that the business violated Minnesota Statutes 325F.69, 325D.44, 504B.177 and 504B.215 by adding utility surcharges to consumer's rent without providing notice of the total utility costs for the buildings; double-charging some tenants and charging late fees to tenants who did not pay the surcharges or paid their rent late because of the surcharges. Under terms of the Assurance, the business agreed to not bill any tenant a utility surcharge unless they are in compliance with MN Statute 504B.215 and not to bill any tenant who pays their utilities directly and the business shall not retaliate against the tenants for reporting any possible violations. In addition, the business agreed to refund all tenants at specific locations any utility surcharges as listed in the agreement. The business also agreed to notify all tenants that it has reversed and/or refunded all utility charges and late fees it billed in December 2021. The business also agreed to pay a civil penalty of $45,000.00 The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
