On July 22, 2024, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11 (b)(5)(8)(9); 326B.805, subd. 5 (c) and 326B.84 (2)(5)(15) (2022). Under terms of the Order, the business agreed to revocation of their residential building contractor license and the qualifying builder license for Jason Smith and to cease and desist from performing or offering to perform the work of a residential building contractor, remodeler or residential roofer in Minnesota. They also agreed to be prohibited from applying for a DLI license for 4 years from the date of the Order and Mr. Smith is prohibited from holding a position of fiduciary, managerial, ownership or supervisory authority with another licensed residential building contractor in Minnesota. The business agreed to a $25,000.00 fine, with the balance stayed on the condition that they fully comply with the terms of the Order and have no future violations of any laws, rules or orders under DLI authority.
