On December 13, 2022, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business owner was a dual agent for the sale of a property, where they failed to get consent from both parties as required by Minn. Stat. 82.67 subd. 4 (2020) and failed to get a signed buyer's broker agreement prior to acting as the buyer's representative, a violation of Minn. Stat. 82.66 subd. 2(a) (2020). In addition, the business' owner, on his broker license applications, failed to disclose judgements against him, a Chapter 7 bankruptcy, being named in civil suits alleging breach of contract, a misdemeanor criminal conviction for a total of 56 material misstatements on the 14 applications, a violation of Minn. Stat. §§ 82.81 subd. 12(a) (5), (6) (2020). The business owner also failed to notify the Commissioner within 10 days of a final adverse decision or order of a court against them, in violation of Minn. Stat. § 82.65 subd. 3 (2020).
Under terms of the Consent Order, the business agreed to their real estate broker license is suspended beginning January 1, 2023, unless the business pays a civil penalty of $5000.00 of a $15,000.00, with the balance stayed. As of February 3, 2023, the Real Estate Broker's license is active. The business also agreed to complete the broker license course and refrain from violating any laws, rules or orders under the responsibility of the Minnesota Dept. of Commerce.
