  Government Action: BBB reports on known government actions involving business’ marketplace conduct:

  Minnesota Dept. of Commerce Consent Order
  

  On September 30, 2024, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business: Conducted business as a real estate licensee under the name of, and on behalf of a company to whom Respondent is not licensed, in violation of Minn. Stat. § 82.68 subd. 1(2022); acted as a real estate brokerage without a real estate license, in violation of Minn. Stat. § 82.81 subd. 1 (2022); Failed to deposit all trust funds into the trust account in violation of Minn. Stat. § 82.75 subd. 1(2022); Charged more than the statutorily allowed amount for Non-Sufficient Funds (NSF) fees in violation of Minn. Stat. § 82.82 subd. 1(f) (2022); Included automatic extension provisions in listing agreements, in violation of Minn, Stat. § 82.66 subd. 1(c) (2022); Failed, on a multitude of occasions, to include in listing agreements, a full description of the property, as required by, and in violation of Minn. Stat. 82.66 subd. 1 (b) (2) (2022); Failed to include the list price in listing agreements, as required by, and in violation of Minn. Stat. § 82.66 subd. 1(b) (3) (2022); Failed to include the notice regarding compensation as required by, and in violation of Minn. Stat. § 82.66 subd. 1(b) (8) (2022); Failed to include the disclosure statement regarding dual agency as required by, and in violation of Minn. Stat. § 82.66 subd. (1) (b) (9) (2022); and failed to notify the Department  of Commerce of a change in street address within ten days, as required by, and in violation of Minn. Stat, § 45.0112 (2022).

  Under terms of the Consent Order, the business agreed to pay $6,000.00 of a $15,000.00 penalty, with the balance stayed on the condition that the business does not have any further violations of any law, rule or order under the Department of Commerce authority and to pay $112.50 in investigative costs. The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details go to the below link.
