    I reviewed my ChexSystems Consumer Report and identified areas for dispute. I was very upset upon discovering these fraudulent accounts, unauthorized transactions and inaccurate information; thus, I demand that it be resolved in a fair and equitable manner that it be investigated and, if necessary, be corrected or removed. Failure to comply with Federal regulations by credit reporting agencies are investigated by the ************************ (see 15 *** 41, et ***.). I am maintaining a careful record of my communications with you for the purpose of filing a verified complaint to the state of ***************************'s office, should you continue in your non-compliance. I further remind you that, as in Wenger v. *****************, No. ******* (*******. Nov. 14, 1995), you may be liable for your willful non-compliance.

Our records indicate that ChexSystems has received a dispute from the consumer through a **** complaint, which states that information contained in ChexSystems files is a result of identity theft.ChexSystems also received a copy of an FTC Identity Theft Report document. ChexSystems has initiated a review of the consumer file relative to the **** complaint and will send correspondence to the consumer when the review is complete.     They are ruining my credit. In 2019 I called and wrote to find out why and Chex Systems never told me. This is FRAUD. I called 2 hours today. Ive written. They do not speak English. This is hurting my credit..

Account opening decisions are determined by an institution and its individual policies.
    Our records indicate that the consumer contacted ChexSystems on 06/03/2025 indicating they were declined opening an account. The ********************** representative informed that account opening decisions are determined by an institution and their individual policies and offered a copy of their consumer disclosure report. The consumer indicated she had requested a copy of their report and never received it and the ChexSystems representative explained to the consumer that this was the first contact at ChexSystems. A copy of **** Smiths ChexSystems consumer disclosure report was sent to the consumer.

    This complaint is being filed against Chex Systems Inc. for their reckless, negligent, and damaging reporting of completely false and unverified information that is actively destroying my ability to access essential banking services. Chex Systems is knowingly reporting two fraudulent entries dated 10/23/2024 and 11/14/2024, neither of which are supported by any valid contract, signed agreement, or legal documentation tied to me in any way. I have never opened, authorized, or agreed to any account related to these dates, and Chex Systems has failed to provide even the most basic verification or proof. Instead, they continue to recklessly publish these false records, causing real financial harm, embarrassment, and obstruction to both my personal and business financial operations. Ive demanded multiple times that they validate or remove these entries, and theyve either ignored those requests or replied with useless, generic responses. This isnt a misunderstandingthis is defamation and negligence at the highest level. I am making it absolutely clear that my legal team is preparing to sue Chex Systems Inc. for over $250,000 in punitive damages for the severe harm their reporting has caused. This will include claims for defamation, negligent misreporting, financial interference, and emotional distress caused by their failure to correct false data. We are also filing formal complaints with the ***** ***, and multiple state regulatory agencies.

ChexSystems services primarily assist its clients in assessing the risk of opening new accounts. When providing this service,ChexSystems abides by the requirements of the **** and any applicable state statutes.     ChexSystems clients, which consist mainly of financial institutions, regularly contribute information on closed checking and savings accounts, referred to as Reported Information. The **** does not require furnishers to obtain consumer consent to furnish reported information to ChexSystems. Reported information pertains to accounts reported for mishandling, closed for cause, and/or suspected fraud activity. ChexSystemscurrent practice is to retain reported information on file for a period of five years unless the source of the information requests its removal or ChexSystems becomes obligated to remove it under applicable law.

    ChexSystems will initiate a review of the consumer file relative to the complaint and will send correspondence to the consumer when the review is complete. If a reinvestigation is required, under normal circumstances, it will be completed within approximately 30 days (21 days for residents of *****).      I am rejecting this response because:

    ChexSystems attempt to deflect responsibility by falsely claiming I did not first reach out is both factually inaccurate and legally irrelevant. Under the Fair Credit Reporting Act (FCRA), 15 U.S. Code ?1681i(a)(1)(A), once a consumer disputes any item of information, the consumer reporting agency must conduct a reasonable reinvestigation within 30 days. I have made multiple demandsboth directly and through consumer protection channelsfor ChexSystems to validate or remove the blatantly false entries dated 10/23/2024 and 11/14/2024, and you have failed to provide a shred of legally sufficient verification. Under ?1681e(b), you are required to maintain reasonable procedures to ensure the maximum possible accuracy of the information you report. Your continued publication of false, unverified data without supporting contracts or documentation is a direct violation of this federal obligation. By refusing to remove these unverifiable entries and obstructing my access to vital banking services, ChexSystems is now in willful noncompliance under ?1681n, making you fully liable for actual, statutory, and punitive damages, attorneys fees, and costs. The Supreme Court has held in Safeco Ins. *** of America *. ****, 551 U.S. 47 (2007) that failure to correct inaccuracies after being notified qualifies as willful misconduct. This is more than negligenceits defamation, misreporting, and interference with my finances. Your claim that unverifiable data can remain for five years is a gross misreading of the lawyou are obligated to delete false data. My legal team is preparing a $250,000+ lawsuit citing ?1681n, 1681o, and state law. This complaint will not be withdrawn. Additional action is being taken with the ***** FTC, and state regulators.

    For the past 12 months, *** tried nonstop to create an online account with **********************, but keep hitting a total brick wall. Ive called support countless times, and get nowhere no clear answers, no solution. Im stuck in a loop where **** misinform me, transfer me, or send me to LexisNexis. LexisNexis says the problem is on ChexSystems end and sends me back. This back-and-forth has dragged on a year with zero *********** make things worse, many ChexSystems agents I spoke to were unhelpful, clueless, and at times rude. When I reached supervisors (twice in a year), they said, Theres nothing we can do. So Im locked out with no account and no access to my info because ChexSystems cant or wont fix the glitch blocking me.This isnt just inconvenient its unacceptable for a company handling sensitive data and affecting financial lives. Im far from alone. Hundreds online have the same problem. ChexSystems knows but hasnt seriously tried to fix it.I demand ChexSystems fix the broken system stopping people like me from setting up accounts. They owe a clear explanation and a knowledgeable contact who can solve this without passing us around. After a year, we deserve immediate action and a path forward.Consumers shouldnt have to fight this hard to access their info its their right, backed by law. I expect ChexSystems to fix their system ASAP and confirm full access to my data through a working portal. If not fixed quickly, I want a formal apology and assurance theyll improve to prevent this nightmare for others.

Our records indicate that Mr. ******* attempted to create a secure consumer portal account through the ************************** website and the security quiz could not be generated as the consumer could not be located based on the information they entered or there is not enough information about the consumer to generate a quiz.  When this occurs, a message will display informing the consumer to contact ChexSystems using another method. ChexSystems receives security quiz information from a third-party vender that provides authentication services which includes **************** If Mr. ******* has placed a security freeze or opted out with LexisNexis this could impact the ability to verify the consumers identity to create a secure consumer portal account.      I am rejecting this response because: ChexSystems response to my complaint is unacceptable and frankly insulting. After a year of trying to gain access to my consumer portal, being bounced back and forth between ChexSystems and LexisNexis, and receiving nothing but canned answers, I expected a real solution. Instead, I got a weak excuse that shifts blame and completely ignores the core issue: your system doesn't work  and you know it.

    Your explanation that a quiz couldnt be generated due to not enough information is a tired deflection. Ive already confirmed with LexisNexis that I have no security freeze or opt-out in place that would prevent verification. Ive gone through their process multiple times. Theyve told me point blank: this is on ChexSystems. So stop pointing fingers at them and pretending like your hands are tied. You run the system. You own the process. The responsibility is on you to make it work.
    Whats worse is that you acknowledge there's no alternative method to verify consumers online. Thats not just bad business its a violation of consumer rights. I shouldnt have to send mail or make phone calls for a year to get access to information Im legally entitled to. This is 2025. Your refusal to fix a known, ongoing issue is negligent, and it has very real consequences for people who rely on ChexSystems to access basic financial services. Youre locking consumers out of their own data with no clear recourse, and Im not the only one. There are hundreds of others in the same boat, and your refusal to act makes it look like you simply dont care.

    Im demanding that ChexSystems stop hiding behind a broken process and take immediate responsibility for this failure. I want access to create my account, a clear explanation of what went wrong, and proof that you're working on a real fix  not just spinning your wheels while consumers get stonewalled. Your refusal to fix this is fully exposed. Youve had over a year. Youre out of excuses. Fix it.

    I need a free copy of my ChexSystems Report ASAP.The automated systems is horrible. It is frustratign that I am not able to get a live representatvie to address my concerns.     It seems that a fraudulent checking account with *************** was opened in my name in **. I requested that they remove it from my file. They declined stating that the information is correct. The information is NOT CORRECT. They have a responsibility to report our accurate information. It very maddening to me that this company that I have never heard of is contributing to the wrong caused by an identify theft.     Chex Systems, **** (ChexSystems) has reviewed the complaint filed by ******* ******.
    Our records indicate that ChexSystems has previously received a dispute directly from the consumer that was of the same nature as the complaint.  As is our standard practice, ChexSystems placed the reported information in dispute and sent a letter to notify the consumer of our intent to initiate a reinvestigation.ChexSystems notified *************** of the consumers dispute and requested that they reinvestigate the accuracy and completeness of the information submitted.
    *************** requested a change be made to the disputed information to reflect the closure status as no monetary loss and the date of closure and closure status date as 01/09/2023 and with those changes, verified the disputed information to be accurate and complete. As a result, it will remain on file at ChexSystems.
    ChexSystems sent a letter to notify the consumer of the results of the reinvestigation and to provide an updated consumer disclosure report. The letter also explains that, in accordance with the ****, the consumer may provide a valid identity theft report signed by a law enforcement officer or police report filed with a law enforcement agency that clearly supports the claim. Once ChexSystems receives the required supporting documentation, we will review the situation further and provide the consumer with notification of any action taken.
