    Minnesota Dept. of Commerce Consent Order

    On October 9, 2023, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business failed to: use comparable sales that were most similar to a property, a violation of USPAP Standard Rule SR 1-1(a), 1-4(a), 2-1(a) (2020) and Minn. Stat. 82B.195, subd. 3 (1)(iv) and 82B.20 subd. 2(5)(7) (2022); failed to provide a credible appraisal report because of errors, omissions and improper appraisal methods, a violation of USPAP Standard Rule SR 1-1(a)(b)(c), 1-4(a), 2-1(a)(b), 2-2(b)(x)(1) (2020) and Minn. Statut. 82B.195, subd. 3(1)(i)(iii)(iv)(vi) and 82B.20, subd. 2 (7)(13) (2022); failed to reconcile the available data for an appraisal, a violation of USPAP SR 1-6 (a)(b) (2020) and Minn. Stat. 82B.20, subd. 2 (7)(13) (2022) and failed to have a work file prior to issuing an appraisal report, a violation of USPAP record keeping rule (2020), and Minn. Stat. 82B.071, subd. 2 (2022). 

    Under terms of the Consent Order, the business agreed to pay $4,000.00 of a $5,000.00 penalty with the balance stayed on the condition the business does not further violate any law, rule or order under Minnesota Dept. of Commerce authority, complete 3 courses from the Appraisal Foundation within 180 days, complete a continuing education course approved by Minnesota Dept. of Commerce, pay investigative fees of $630.00 and commit no further violations of laws, rules or statutes under Minnesota Dept. of Commerce authority. The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details go to the below link.
