  Government Action: BBB reports on known government actions involving business’ marketplace conduct:

  Minnesota Department of Commerce Consent Order
  

  On January 21, 2025, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business was hired to list residential property for rent and managed those properties, and when new contracts were signed in 2021, additional language was added requiring the property owner to give the right to list the property if the owner wished to sell. In 2023, the property owner informed the business they were planning to sell the property.  The business owner then told the property owner that the listing requirement from 2021 was still in effect. The property owner then listed the property with the business, who negotiated a sale of the property  and received a commission.  Minnesota Department of Commerce investigation determined there was no agreement to extend the 2021 agreement, which resulted in false and misleading statements which influenced a transaction, under Chapter 82 of the Minnesota Statues, in violation of Minn. Stat. § 82.81, subd. 12(a)(10).  

  Under terms of the Consent Order, the business agreed to pay a civil penalty in the amount of $7,500.00; pay $2,610.00 in investigative costs and Mr. Humphrey is required to complete an additional 8 hours of continuing education focusing on client representation contracts, in addition to their continuing education requirements. The business also agreed to cease and desist from violating any laws, rules, or orders under the authority of the Minnesota Department of Commerce.  The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
