On October 19, 2022, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082 and 326B.84 (2020) based on provisions of a July 2020 Consent Order signed by Kenneth Lang and James VinZant and their businesses of Lang VinZant Construction LLC; KRL Exteriors LLC and Midway Vo-Tech Inc. The Consent Order settles further allegations that the business violated Minn. Stat. 326B.082, subd. 11(b)(8), 326B.805, subds. 1 and 3, 326B.81, 326B.84 (1)(2) (2020) and Minn. R. 2891.0040, subp. 1B (2021). Under terms of the Consent Order, the business agreed to ensure their contracts comply with Minnesota Statutes; reduce all contracts and change orders to writing, signed and dated by both consumer and business, the business and their representatives are prohibited from offering any items of value to consumers to offset their insurance deductible or offering to compensate consumers for their deductible by offering a service, material upgrade, marketing credit or anything similar. The business also agreed to create internal processes to communicate to fulfill their contracts and compliance with DLI and maintain records of their construction transactions for at least three years. The business further agreed to provide reasonable supervision to their employees, subcontractors and sales staff and to ensure that all building permit applications include the entire scope of work and do not being work until all permits have been issued. The business will also pay $1,000.00 monetary penalty with the remaining $14,000.00 penalty stayed on the condition the business fully complies with the terms of the Consent Order and engages in no future violation of any law, rules or orders by DLI.
