    Minnesota Dept. of Commerce Consent Order

    On October 17, 2024, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that: the business failed to identify and explain the reasons for changes to an appraisal report; a violation of  the Uniform Standards of Professional Appraisal Practice (USPAP) Standard Rule (SR) 1.-1 (a), (b), (c); 2-1 (a), (b), 2-2 (a) (x) (5) (2020)  and Minn. Stat. §§ 82B.95 subd. 2(5) and 82B.20 subd. 2 (6) and (7) (2022) and failed to provide market data to support his opinion of market conditions, a violation of violation of USPAP SR 1-1 (a), 1-3 (a) (v), 2-1 (a) (b), 2-2 (a) (x) (1) (2020) and Minn. Stat. § 82B.20 subd. 2 (6) (7) (2022).  The Order also settles allegations that business failed to provide a credible and supported sales comparison of the value of a property, a violation of USPAP SR 1-4 (a), 1-6 (a), 2-1 (a) (b), 2-2 (a)(x)(5) (2020) and Minn. Stat. 82B.20 subd. 2 (6)(7) (2022) and their work failed to have the required documentation to support opinions and conclusions, a violation of  USPAP Record Keeping Rule, Ethics Rule (2020) and Minn. Stat. 82B.071 subd. 2 (2022).  

    Under terms of the Consent Order, the business agreed to pay $2,500.00 of a $5,000.00 penalty with the balance stayed on the condition that the business has no further violations of any law, rule or order under Minnesota Department of Commerce authority. The business also agreed to complete corrective education within 90 days of the Order and to pay investigative costs of $607.50 as allowed by Minn. Stat. 45.027, subd. 1 (8) (2022).  The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
