On July 27, 2021, the Michigan Department of Attorney General reached a consent judgment with the business in Wayne County Circuit Court. The Attorney General alleges the business breached a March 2019 Assurance of Voluntary Compliance by charging deposits beyond vehicle rental costs, and by failing to implement a process for inspection of a car before the rental process was completed.
The consent judgment contains three key components:
- The business must pay $17,500. $15,000 of those funds will be made available for consumer reimbursements
- The business is now bound through court order to meet its obligations under the March 2019 assurance agreement (see also: BBB's March 2019 alert within this business profile)
- Consumers specified in the judgment are protected from any attempts by the business to collect funds for purported damages or other issues
Any consumer who rented a vehicle from one of the business's Michigan locations who wants to be considered for reimbursement- if they have not already done so- should file a consumer complaint with the Michigan Attorney General no later than August 23, 2021.
Consumers who rented vehicles from Executive Car Rental in Florida or Texas and experienced issues are encouraged to file complaints with the Attorney General in those states- if they haven't already done so- in the event they follow the Michigan Attorney General's action.
Both parties reached the consent judgment to resolve the pending matter to avoid continued litigation and it should not be considered as an admission of guilt or finding of violation of the law.
BBB files indicate that this business has a pattern of complaints concerning return of deposits after rental cars are returned and billing issues surrounding the Florida Sun Pass. On January 4, 2019, BBB submitted a written request to the company encouraging them to address the pattern of complaints. As of 02/2019, BBB has received a response from the business. BBB attempted to work with the business on resolving consumer complaints and the underlying pattern of issues presented to Executive Car Rental. BBB will continue to accept and report complaints against this business and fulfill its responsibility to inform businesses of communications from its customers. As of 03/20/2019, the business is required via an Assurance of Voluntary Compliance with the State of Michigan's Attorney General Corporate Oversight Division to refund some consumers and come up with a process to prevent some of noted above issues from reoccurring.
