    I ask this company to Build a PoleBarn. I gave a Deposit of $20,000 to put on the list to Build it.Ten Thousand (******) of it was Non Refundable we both agreed to that. I waited a ******************** still havent been built or started. Then I waited six more months which was July this year 2023. At this time I notified the Builder that I no longer wanted it built so he agreed to return ****** back as it states in the Contract. He said he was going to Refund ********* me a check. He hasnt contacted me or made any arrangements to fulfill the contract.

    *************** and his brother, *************************, entered into an agreement to build a barn on property located in *********, **. It is my understanding that this property was inherited by ************************* and that **************** was going to pay to have the building constructed for the two to share, therefore, when considering the property, having equal exposure and equity. Approximate cost was 200k;please see attached pre-contract agreement requiring a payment of $10,000.00 and clearly explaining that all monies are non-refundable. After that process was complete; both, **************** and **************, entered into a contract to build the building. There are two separate master contracts, one bearing the signature of each due to the fact that they were singed in separate locations. The contracts are identical and both state that all monies are non-refundable, please see paragraph XIII in attached master contracts. After signing the master contract,we initiated and completed several steps including: a perk test, ordering materials, scheduling, etc. Nearing the end of summer, **************** stopped at the office and expressed that he would like to cancel the project and would like a refund for some of the monies. He let me know that there wasn't anything wrong, but he had decided to move back to ************ and "patch things up" with his ex-wife. I am of the legal opinion that no refund is due as that correlates with the contract language.  
    As far as integrity is concerned, I do feel that **************** and ************** are due a partial refund; I didn't have 20K in exposure, so I am willing to make a partial refund, I explained that to ****************. I also explained that I can't just give the refund to ****************, he and his brother are equal contributors to the contract so I would need to issue a refund to both of them once a hold harmless agreement that including canceling the contract, was signed by both of them. After **************** left my office, I reached out to ************** and reviewed the conversation I had with ****************. Very reluctantly, after several apologies from **************, ************** stated that I could refund his brother and cancel the contract; I let him know I needed him to sign some paperwork and I would send it to him, once I received that back, I would contact **************** so he could sign and get his refund. I relayed that information to **************** as well. As of today, we have not received that paperwork back from **************. *************** did stop and inquire about his refund, I let him know I had not heard back from his brother. I also never gave **************** an actual refund amount,mostly because I had not calculated our expenses and time yet. Our next communication from **************** was this complaint, which is quite frustrating and mis-leading.
