    I am writing to file a complaint regarding an issue I encountered with ******* McPhail, the owner of McPhail's Tree Service, in relation to a contracted job for which I was hired on November 10, 2024.On or around November 7 or 8, 2024, I met with ******* McPhail inside Advance Auto Parts in *********, *****, to discuss a one-day contract job cutting and splitting 3-5 cords of wood. The agreed rate was $150 per cord. ******* informed me that I could arrive at any time in the morning to begin work, and that I should give him a ***** minute notice prior to arriving, as he is not a morning person. We also exchanged contact details, and he provided me with a business card and directions to the work site via ****** Maps. On November 10, 2024, I traveled approximately 45 minutes to the job site as agreed. Around 45 minutes before my estimated arrival, I called ******* to inform him I was close, as per his instructions. Unfortunately, he did not answer my call. I then sent him a text message, to which he responded that he no longer needed my services and that "this is not going to work." As a result, I wasted a significant amount of time and resources traveling to the job siteroughly a 2-hour round triponly to find out that ******* had no intention of following through on the agreed-upon work, nor did he contact me prior to the scheduled day to cancel or reschedule. I believe that this lack of communication, coupled with the time and money I lost, constitutes a breach of the terms of our agreement. For these reasons, I am seeking reimbursement for the $800 in lost income and time, which includes both the agreed payment for the contracted job and compensation for the time and travel expenses I incurred. I believe ******* McPhail should be held liable for this loss, given that he did not provide prior notice of his change of plans, nor did he make any attempt to cancel the arrangement in a timely or professional manner.

    I met with him on 11/10 at the store is true. I handed him a business card and told him to text me his information which he did not. He referred to himself as being the woodsman that gets up at 4:00 all the time. So He asked if he could be there at 6:00 a.m. on a Sunday morning. I thought that was too early and told him I could do 7:00 a.m. and he said that was fine. I drove 45 minutes to be at the job site. I was there at 6:45 to 7:30 so I wasted 45 minutes of my time being there with no phone call and no way to contact him. He did not text me until 8:15 am on that Sunday morning saying he was 45 minutes away and at that point I texted him back saying that I had already been there and it was not going to work for us because he did not show up when we had scheduled the agreed time. Then he tried to blackmail me with venmo and charge me a bill for $100 for his travel. And then he made threats about my business equipment.. he left harassing and threatening messages so I blocked him

    My phone# was provided to him the day we met at AdvacneAuto on a his business card he handed me and I provided it back. He expressed he could not find help to cut wood all summer and was stressed out as he needed to make money. Furthermore, he stated I can show up anytime in the morning as he does not normally go to that location on the weekends. He showed me via goole maps on his phone in extreme detail where to park, where the wood was located, where he wanted it split and thrown into a pile. His only request that I call him when I'm 45mins-1hours away, and I did just that. I live 62miles (one way) from the job site he hired me to work at. I drove 42miles (one way) at which time I had cell phone service and called him immediately. I drove 84miles round trip and wasted 2.5hours of time to have this small business owner back out of the requested contracted work without any notice. It's clear he cannot find help as he is not a man of his word and does not have the money to pay contracted work. 

    I'm seeking to be paid the damages originally requested in my initial complaint. If he does not agree, small claims court will be filed.

    first of all i am the consumer trying to hire the complaint..  He did not text me his contact info which i had asked for, and left me no way of contacting him.   2nd We had an agreed aponed time to meet.  I drove 90 min round trip and waited 45 min at the job site waiting for him to confirm the job and go over everything that was required..  **** did not show up on time and  didn't call  before I left the job site. which i consider a breach of our agreement to go any further with this job.   futher more the first round of texts ended up in him texting vulgar language..  next phone call he left threating message so there is no helping to make this better.   Now he has left slanderous remarks on a public forum about my business and I..
