    On 04/24/2024 17:54pm I went to Pepperell Quality Market. Cashier Name: Quick Check PM C0156 #****. After paying for groceries my disabled wife needed to go to the restroom. I asked the cashier if we can use the restroom, but he said that they do not have restroom for customers. Under Massachusetts state law, a business must allow a person to use their restroom if three or more employees are working at the time of the request and also must allow access to people who suffer from certain medical conditions. At the time of our visit more than three employees were working in a store.Pepperell Quality Market employees are poorly trained, do not obey the law of the land , poorly speak English and making up their own rules.

    We apologize for the inconvenience this caused. Our bathrooms are not easily accessible for the public. They pose a risk to the public because our back room area contains goods which could pose an injury to the public. Such as pallets of water, beer, and other heavy items. If these were to fall on the public because of their movements it could cause injury and a law suit to us. Also, when our back room storage area was clear for the public to access our bathrooms, we had a heavy amount of vandalism. Patrons would purposely clog the toilets with rolls of toilet paper, paper towels, and we also had 3 incidents of the customer smearing f**** on the walls, and floors. It is a risk to the employees who need to use them, not to mention the expense of having the plumbing repaired. Please see the following, which is from the Massachusetts Law website:Chapter 191 of the Acts of 2012 An Act Relative to Public Access of Private Restrooms Chapter 270 of the General Laws is hereby amended by adding the following section:-Section 26. (a) For the purposes of this section, the following words shall, unless the context clearly requires otherwise, have the following meanings:Customer, an individual who is lawfully on the premises of a retail establishment.Eligible medical condition, Crohns disease, ulcerative colitis or any other medical condition that requires immediate access to a restroom facility.Retail establishment, any business or place where members of the public have access as invitees or licensees.(b) A retail establishment that has a restroom facility for its employees shall allow a customer to use that facility during normal business hours if the following conditions are met:(1) the customer requesting the use of the employee restroom facility suffers from an eligible medical condition or uses an ostomy device, provided that the existence of the condition or device is documented in writing by the customers physician;(2) three or more employees of the retail establishment are working at the time the customer requests to use the employee restroom facility;(3) the retail establishment does not normally make a restroom available to the public;(4) the employee restroom facility is not located in an area where providing access would create an obvious health or safety risk to the customer or an obvious security risk to the establishment; and (5) a public restroom is not immediately accessible to the customer.(c) A retail establishment, or an employee of a retail establishment, shall not be civilly liable for an act or omission in allowing a customer who claims to have an eligible medical condition to use an employee restroom facility that is not a public restroom if the act or omission: (i) is not negligent and occurs in an area of the retail establishment that is not generally accessible to the public; and (ii) results in injury to or death of the customer or individual, other than an employee, accompanying the customer.(d) This section shall not require a retail establishment to make any physical changes or improvements to an employee restroom facility located on the premises.(e) A violation of this section shall for the first offense be punished by a fine of $100. A second or subsequent offense shall be punished by a fine of not less than $100 nor more than $200.sections 3, 4 5 and d, are all reasons we do not have to make our bathrooms available to the public.I'm sorry you had a bad experience with our store, and hope you understand our standing on this matter. This should no way reflect of our Business as a whole.Thank You
