On or about January 3, the following unfair or deceptive act occurred:Mr. ********************** was hired to do install a retaining wall around a 30 ft above ground pool, a 20x30 trex decking, and a cement pad for pool heater and pump. Mr. ********************** rented an excavator from MB Tractors for 1 week. He indicated the landscaping portion would take one week to complete. Mr. ********************** was unable to complete the work in that time frame and indicated he needed another week with the excavator. During this time, Mr. ********************** only showed up for a couple hours at a time and often missed days of work. Mr. ********************** had the excavator at our house for 1 month (until February 10th). At this time, he still had not finished the necessary landscaping to put in footing for the deck or fill in the area behind the half-built retaining wall. Mr. ********************** did not show up at our home from February 9th- March 14th. Below is a timeline of events that took place in which Mr. ********************** was negligent in his work by destroying property (above ground pool and existing deck): On January 19th Mr. ********************** texted Mr. ********************* (homeowner) to say that his excavator bucket broke and hit the pool ripping an 8-inch hole in the wall and the liner. Mr. ********************** told the homeowner (*********************) that he talked to two pool guys who said he could patch the wall and liner and it was guaranteed for 5 years. **************** asked for a new wall and new liner as the pool was just purchased in May/June 2021 and had yet to be used. **************** contacted ***************** and ******, ** and was made aware that a Mr. **** Touwig had called him about the wall and liner and told him that it needed to be replaced. On February 9th, Mr. ********************** hit one of the 4x4 beams on a preexisting deck attached to the house rendering it unsafe. It took Mr. ********************** until March 14th to fix the beam. On February 28th, Mr. ********************** and **************** spoke by phone and he told **************** that **** would be able to patch the pool and that he had just talked to G
