I was sued by Discover from ******************************************* PC. I never received any mail regarding the court information. After finding out the information due to attorneys reaching out to me for the court case, I had reached out to Zwicker $ Associates PC to take care of the matter and setup an agreement. A settlement of $560 was made and the original banking account I wanted the payments to come out of wasnt working. I tried to call in to replace it with a different account so I could make my first initial payment with the agreement date of September 28th, 2023 I called in three times on September 27th, 2023. The employees verified all of my information after asking me multiple questions. Placed me on hold and hung up on me each time. I have also tried to email the lawyer about this matter as well (very nice and helpful attorney) but received no response on how to go about this situation. I was holding up my end of the agreement and I still have yet had a callback or an email on this. I called today October 26th, 2023. Verified all of my information with two employees. Wanting to go ahead and provide my new account information for the payment.The second employee who I was transferred to, placed me on hold and hung up the call as well. Zwicker & Associates, P.C. is a law firm that represents its clients for the purpose of debt collection. ************************ is neither a customer nor client of this law firm. Rather, this law firm represents ************* with respect to a credit card issued to ************************ ending in 3008.
Ms. *********** narrative provides that she has regularly been in contact with our office for the purpose of re-paying the underlying loan and otherwise suggests that that this office refused to work with her toward resolving her debt. Although ************************ also suggests that we failed to notify her of the lawsuit against her, our records show that notices sent in connection with that matter have not been returned by the postal service, although it does appear that ************************ has recently changed her address. We have updated our file with her most recent address,which is the one that she furnished with this complaint. Our records show that we have worked with ************************ over the last few months to resolve this matter and in fact we established a repayment arrangement with ************************ that would satisfy her debt if paid as agreed. ************************ asserts that this firms employees have hung up on her on several occasions and due to this she was unable to fulfill her repayment promise in connection with the settlement.Our records do show that ************************ contacted our firm on September 27,however, we disagree with Ms. *********** contention that our employees hung up on her for the purpose of preventing her from fulfilling her payment agreement. Our records show that ************************ disconnected the calls on two occasions that day while it appears our employee inadvertently disconnected a call while transferring ********************** in one instance.
We understand that ************************ wishes to resume her settlement agreement and we would also prefer to resolve the matter through mutual agreement. Therefore, we will agree on behalf of our client to reinstate the settlement agreement so that ************************ can take advantage of the settlement deal she originally negotiated. We ask that ************************ please contact our office if she wishes to accept our offer.

This is regarding an old Discover loan seeiously affected after (and during) the pandemic. I was always able to pay the monthly amount until Covid 19 seriously affected my health and my finances. Discover company passed my case to the ******************************************* and they filed a court case. I ALWAYS contacted this company to show my GOOD FAITH on repaying every single dollar of my loan. And I am currently pay my monthly payments. This company is seriously playing with peoples life. Ms. ********** narrative provides that she has regularly been in contact with our office for the purpose of re-paying the underlying loan and otherwise suggests that that this office refused to work with her toward resolving her debt. Our records show that we have worked with ********************** for the last two-years to resolve this matter and that, while our records show that we have made several repayment arrangements with *********************, she has not paid consistently or according to the terms of those payment plans, nor did she return the settlement agreement we mailed to her in connection with the litigation against her. Presently, the last voluntary payment received from ********************** was on August 28, ************************************************************** the month of September. The last contact this office had with ********************** was October 3, 2023 at which time this firm engaged ********************** in courteous and professional dialogue regarding the account.
Although our records show that ********************** ultimately did not make a September 2023 payment, we would prefer to continue to work with her to resolve the account on a voluntary basis. I have all documents on file.
As I have several emails sent to Zwicker & Associates that were not considered.The Discover loan I took in 2018 was ALWAYS paid on time by me until the pandemic seriously affected my business and my financials. When Covid hit, I right away contacted a debt relief company in order to be able to pay all debts. This company was Credit & Associates. I made few payments throughout them until I could not afford anymore.
Then, few months later (in the middle of the pandemic) I received a file that my case was brought to Court. I right away contacted Zwicker & Associate, in order to act with good faith regarding my debt. I explained that, due to the pandemic, I was unable to pay. But they forced me to accept the monthly amount of $ ****** which I started paying. Even though I did have ZERO means to do so.
But I asked my family to help me out.
At the beginning of 2022 I contacted Zwicker and Associated and told them that I was heading overseas for at least 2 years, to try to come out from my bad financial situations. They asked me to send and email that was going to remove the Credit Associate debt relief company. I explained that I not longer used that company but still I sent this email. Throughout all 2022 Zwicker & Associated was able to receive my monthly payment, automatically withdrawn from my ********** account. But then, while I was still overseas, they stopped the withdrawal on March 2023. When I came back in the States, in July 2023 I contacted them and asked them the reason why they stopped. They said that the automatic payment was only good for several months. They asked me AGAIN to send them an email to remove AGAIN the Credit Associates debit relief from my account. I explained over and over that NO LONGER I was represented by this firm. But again I had to send an email. I authorized ******* & Associate to withdraw the amount of $ ***** fron my checking account. AGAIN 100% good faith toward my debt. This amount was covering the past months, including August 2023. September payment was not detracted from my checking account. I reached out to Zwicker & Associated several times. Each time they would transfer my calls from an office to an other one. Until finally, after many many attempts, I got an answer. To send them an email to remove Credit Associates.
I told them AGAIN that this email was sent many times. NO longer I was represented by this company (since 2020!!)
NEVER, during all this time, they could organize their messy files.
Pandemic was a HUGE change of peoples life. It affected me, and my wife, 100%. Financially. Healthy. She almost died with *****. So, when you experience a SERIOUS unusual phase of your life, you expects some RESPECT.
We, both me and my wife ***************************, ALWAYS shown a huge good faith in order to repay our debts. Even though we found ourselves to face enourmous challenges during these past 3 years. If ***** never hit, we were simply 2 business people. Responsible toward our debts. My wife sent a complaint to the BBB as well. Against Zwicker & Associates. She has, as well, 2 debts toward Discover (handled by Zwicker & Associated). Each time we contacted their office, we receive a different answer.
Your case is closed. Your case is in court. (We never received a court order). We are not expecting much from these complaints. We are simply expecting SOME RESPECT. We never ghosted our responsabilities. In the contrary, we showed good faith, even in really bad bad moments.
Zwicker & Associated gave us a HUGE amount of stress. Emotionally and financially. We truly hope that, through this conplainy, their firm will change. And start to treat homest people with the respect that they deserve. Sincerely***********************************

Zwicker & Associates, P.C. is a law firm that represents its clients for the purpose of debt collection. ********************** is neither a customer nor client of this law firm. As initial matters, to the extent Ms. ********** complaint re-iterates matters contained in her initial complaint, our position is that our prior response accurately and fairly addressed those issues. As we explained in our prior response, we do not dispute that ********************** has made payments towards her debt, however, the facts also show that she has done so inconsistently. Nevertheless, as we previously explained, as a courtesy to her we released the garnishment and asked that she contact us to establish a voluntary repayment agreement. Our records do not indicate that ********************** has contacted our firm since we initially replied to her. ********************** also presents for the first time references to allegations and arguments purportedly on behalf of her wife. Our reply is limited to addressing Ms. ********** rebuttal concerning issues personal to her and we are not able to discuss matters or allegations pertaining to third parties.
Ms. ********** rebuttal narrative reiterates that she has regularly been in contact with our office for the purpose of re-paying the underlying loan, and otherwise continues to suggest that that this office refused to work with her toward resolving her debt.Additionally, ********************** alleges for the first time that she was forced to accept a monthly payment of $241.00 with respect to her account and that this office intentionally ceased accepting her automatically scheduled payments while she was out of the country. These assertions are simply not accurate.This firm processed payments as authorized by **********************. Our records reflect that the parties negotiated a settlement by telephone which included the referenced $241.00 payments. ********************** telephonically authorized twelve ACH payments through this firm with an understanding that she would need to contact our office to set up additional payments at the expiration of the twelve ACH payments; the last payment being made February 27, 2023. As ********************** acknowledges through her rebuttal, she did not contact our office to schedule further payments until July, 2023, at which point she scheduled two ACH payments, which were debited according to her instructions and applied to the balance she owes.

I had a debt through PNC where they agreed to accept $50 a month. I was told this would stop any further collection. $50 payments had been scheduled ever since. Now Ive learned that Zwicker purchased the debt and is trying to **** I have not received any notice prior to learning of the action to **** Violating the ***** laws. I sent in a debt validation letter and have not received any response. I will be hiring an attorney if this is not resolved. Although ******************** claims that this firm has purchased her debt, this law firm does not engage in debt purchasing and we have no ownership stake in Ms. ********* debt. Rather, this firm formerly represented her creditor, PNC ***** ******************** as its attorneys with respect to a credit card debt ending in **** issued to *********************
******************** complains that her debt was referred to this law firm despite a payment arrangement she asserts was established with her creditor prior to this firms involvement.
This firm was first made aware of Ms. ********* claim to have established a prior agreement directly with our client through this complaint. Although our records show that we made several attempts to contact ******************** prior to initiating legal action, our records do not show that we received any contact from her prior to the lawsuit and we have no record of receiving a request for validation of the debt. A credit card company AMEX sent my bill to them. I had a bankruptcy which was officially discharged this year-2023. I have called this law firm numerous times and have demanded they stop calling. Zwicker & Associates, P.C. is a law firm that represents its clients for the purpose of debt collection. ********************** is not a customer or client of ********************** & ******************, P.C., rather, this law firm represents ************* as its attorneys with respect to a credit card account issued to ********************** ending in 4907.
This complaint is the second complaint that ********************** has filed with the Bureau regarding this account. Her prior complaint, to which this law firm substantively responded, was assigned Bureau number ********. In response to that complaint, as well as her subsequent rebuttal complaint, this firm explained that ********************** had reached a repayment agreement with this firm to satisfy her obligation to our client in full if paid as agreed. This firm also explained that we had mailed the stipulation outlining the terms of that repayment agreement to the mailing address that ********************** confirmed with our office. That document was mailed to ********************** based on her representation to this firms personnel that she was located in *******. We also emailed the stipulation to her, twice, to the email addresses she provided to our office and to which she has communicated with the firm in the past.
With respect to ********************** assertion that we have refused to accept her payments, that is simply not accurate. Our records reflect that ********************** telephonically authorized three ACH payments through this firm, two of which were declined for insufficient funds. Accordingly, this firms personnel explained to ********************** that we would no longer accept checks drawn from personal accounts and that future payments would need to be made using certified funds.
Although ********************** has indicated to us in the past that she resides in *******, it appears she is actually located outside of the country. Accordingly, this firm will dismiss the legal action pending against ********************** without prejudice, close our file, and return ********************** account to our client.

This company knowingly pursuit of false collection in my name. On the court date in 18 they coerced me into agreeing to a settlement. I am currently suing however, the ******** office is not responding and has moved offices and has a disconnected number. I had a loan with ****** by ******* ***** for over $8,000, I was able to make the payments until my employment situation changed and had too much debt. The loan was sent to Zwicker and Associates after being charged off. I had worked with them on a settlement amount of the full balance owed, There was a payment of $1,500 that was the initial payment taken and the remaining payments were to be $204 until the balance was paid. The first payment of the $204 did return due to insufficient funds. I called Zwicker and Associates to just pay the remainder of the balance. I spoke with an agent and made a payment around $3,100. The agent had advised the case was already sent to be placed in court and that she was going to send an email to her higher **** including the attorney, to advise the full settlement balance had been paid. I asked if I would receive anymore phone calls or notifications, which she indicated if I did to disregard them. I shredded the letter I had the payment confirmation on after a few months after not getting any more calls or notifications. May of this year, my banks accounts were frozen due to the lawsuit being pursued in court. The case was sent to ***************************** Court Receivers who was unable to do anything other than take a payment arrangement. I have contacted Zwicker several times and the concern was escalated to *************************** (a Supervisor). I have asked Zwicker to pull call recordings and asked for a copy of the settlement documentation, only to be denied on all occasions during phone calls. I keep getting directed to the *********************** even after explaining they can not assist with getting Zwicker to pull calls to confirm final payment nor request to have the settlement documents sent to me.Business Response

************ alleges in her complaint that she has settled her debt, but that this firm has continued collection activity against her. Our records do not show that her debt is settled. Upon receipt of the allegations set forth by ************ in this complaint, this firm conducted an investigation into her claims which involved reviewing our call records. Those records reflect that *********** did contact this law firm shortly after a lawsuit had been initiated to discuss her account. Our records show that this firm and ************ reached an agreement to resolve her obligation through a series of monthly installment payments. This firm mailed ************ a letter setting forth the terms of that agreement and ************ also signed a Rule 11 agreement and agreement for judgment that was filed with the court.
************ did not pay as agreed. In fact, our records show that she only made the initial payment pursuant to the terms of the settlement. Her next payment was declined by our bank for insufficient funds. Despite efforts by this firm to reach her, we were unable to communicate with ************ to resolve the lapse in payments. Our records show that we mailed her a letter concerning the dishonor of her second payment and requesting that she contact us, but she did not. We also attempted to reach ************ by telephone multiple times without success.
Because ************ did not pay as agreed and was not responsive to our attempts to contact her, this law firm took steps to enforce the judgment on behalf of our client through the appointment of a receiver. Prior to doing so, we sent ************ a request for information in the form of post-judgment discovery, to which we have no record of a response. We understand that ************ has now tendered several more payments toward the judgment debt, however, our records do not show that ************ has settled or otherwise paid the full balance due as she asserts in the complaint.Of course, if she has evidence to the contrary she is welcome to provide it to us and we will review it promptly.

This letter serves as a response from Zwicker &Associates, P.C. to the complaint submitted to the BBB by *****************************.**************** is not a customer or client of ********************** & ******************, P.C., which is a law firm that represents its clients for the purpose of debt collection.Rather, this law firm represents ************* with respect to a judgment debt referenced in Ms. ******* submission arising from a credit card account ending in 4078.
**************** asserts that this firm has not released the levy against her bank account after she paid her debt. We respectfully disagree with Ms. ******* assertions that this law firm has engaged in any deceptive or otherwise improper collection tactics in connection with Ms. ******* account or the enforcement of the judgment.While our records do show that **************** has paid the judgment in full, that payment was received after this firm had initiated the levy against her bank account. As a result of the payment, this firm promptly took the steps legally required to terminate the levy of her account. Specifically, this firms attorney filed a notice dissolving the garnishment writ with the court, which was also served on the bank. Although not required to do so, we also contacted her bank by telephone to alert them of the dissolution filing and followed up by directly faxing the papers to her bank in order to do everything we could to address Ms. ******* concerns. Ultimately, however, we cannot control how quickly Ms. ******* bank responds to our dissolution request.
As noted above, our records reflect that **************** has satisfied her obligation to our client. Accordingly, we will also send **************** a letter confirming that her account has been paid in full and file a satisfaction with the court in accordance with our normal procedures. Although our file does reflect that we have attempted to contact her, should **************** wish to further discuss her account with us, she may contact *****************, who is the managing attorney of our ******* office and is familiar with this matter, at ***********************.

First off, i have never been so disappointed and disgusted by a company like I am with Zwicker and PA. First off, the communication is nonexistent and deliberately misleading. Ive had nothing but issues. I set up a payment plan; only for it to NEVER be debited from my account and never had any notices regarding my account if something had went wrong. They really like to use your faults and mistakes against you. The attorneys are very good at making you seem incompetent and incapable of making reasonable decisions and not understanding that some people do make mistakes and instead of FOLLOWING UP on those said mistakes, you never hear anything. So perturbed by this company. And Im warning all of my colleagues to stay away from any credit card that has been sold to this company if these issues arise. This complaint is the second complaint that ******************** has filed with the Bureau regarding this matter.Her prior complaint, to which this law firm substantively responded, was assigned complaint number ********. In response to that complaint, this firm explained that ******************** had contacted this firm to discuss the possibility of establishing a repayment agreement with respect to her **** and negotiated a payment arrangement to resolve her account. Although ******************** asserted in her complaint that this firm failed to debit the payment, we did in fact attempt to do so, however the payment was dishonored by her bank.
Though ******************** complains of a lack of communication from our firm regarding her account, our records show that this firm did in fact send a letter advising that Ms.********* initial payment had been returned. That letter was addressed to Ms.********* **** settlement firm, because as we noted in our previous submission in response Ms. ********* prior complaint, our records show that ******************** had engaged the services of a **** settlement firm to negotiate with her creditors. ******************** has not provided us with updated information regarding her representation, and therefore the letter was sent to her **** settlement firm.
Our limited interactions with ******************** have been courteous and professional and our records show that ******************** has since made voluntary arrangements through the courts Online ************************** to settle the balance by agreement. As a result, we believe this complaint may be resolved.

In June 2023, my bank account was levied by ********************** and Associates in reference to a default judgment that I received no information about in regard to an old Discover account. I had originally been enrolled in a Freedom Debt Relief program and graduated that program a few months ago without the Discover account paid in full. The original settlement amount while enrolled with FDR was $7200.00. I had paid $5500 prior to the bank account levy. FDR charged me $1700 in fees to negotiate this initial settlement as well. That fee was never applied to the account in question. So, I withdrew the account from FDR and was making payments on my own to Zwicker and Associates. Then, COVID hit. So, nearly three years later $1325.00 was taken from my bank account as a result of a default judgment. Zwicker said they couldnt contact me because I was in a debt relief program, BUT I have the actual email revoking the debt relief attorneys from my POA. So, I called to settle this accountoffered 50% and was blind sided. They wanted 80% of the remainder of the debtover $2800. Total to be paid (over $11,000) on a previously $7200 agreed settlement. There was no communication at all, written, electronic, phonenothing. I have been accruing interest for 3 years with no communication whatsoever when I had given them permission to speak to me years ago. Something is not right here. They purchased the old debt from Discover.there is no way they paid the amount of money I am out for this issue.Business Response

As an initial matter, although ****************** asserts that she has not been able to reach a mutually acceptable arrangement with this firm, our records show that ****************** contacted this firm three days before filing this complaint for the purposes of establishing voluntary repayment agreement to resolve her debt and our records show that during that conversation she reached an agreement to settle the remaining balance she owes.
A portion of Ms. ******** complaint appears to be directed at the conduct of her debt management company and as a result we cannot respond to those allegations. With regard to this firms conduct related to the collection of her account, this firms records materially differ from Ms. ******** allegations on several points. Although ****************** states that judgment entered against her by default and without notice, that is not the case. In fact, our records show that ****************** was represented by an attorney and judgment entered against her by agreement. That agreement called for ***************** to remit monthly installment payments to settle her obligation,although this firm did not receive all of the required payments and as a result the settlement became void. This firm has no record of ****************** attempting to contact us to discuss her obligation until after her bank account was levied.As this firm had no information concerning Ms. ******** intention to voluntarily resolve her obligation, this firm took steps permitted by law to attempt to recover the remaining amount due. According to our records, at the time the levy of Ms. ******** account was initiated, we had not received a payment in approximately two years.
As referenced above, our records show that ****************** did ultimately contact our office and reach an agreement to settle her debt. Our representatives engaged in courteous and professional discussion with ****************** regarding repayment of the debt. Although the amount that ****************** proposed to pay was below what we were authorized to accept, ultimately ****************** did accept our counter proposal and has scheduled her initial payments pursuant to that agreement.
