I bought a car from him back in April of this year for $3500, he claimed he would have my title in a couple of weeks and issued me a temp tag, when I started questioning it he claimed that there was an error never explained to me what the error was. Back in August I got into a wreck and the car was totaled, after trying to get the title so I can give it to the insurance company I found out by DMV that the title is bonded in Texas, Louisiana cannot do anything with the title, I can't get is registered or anything. I have a settlement check pending for this situation but I cannot receive it because the title doesn't have my name on the from, the insurance company wouldn't accept that. He wants the car back but I paid cash in full, he not trying to do anything about this situation.

    RE: Case ID: #********. ***** ******* **** ** **** *** *********** ** ****** **********

    Dear Sir or Madam:
I received a dispute from the above-named customer (***** ******) in regards to a purchase of 2011 Nissan Altima VIN ***************** on 04/12/2024. See attached picture (image 1) bill of sale.
This vehicle was purchased from Copart Auction Wilmer Texas on Apri 01 2024. At the time of purchase, title is pending from Texas state DMV and will be provided to Auction once received. (see attached picture message image 2-4). The publication of the vehicle at the auction clearly stated that vehicle has a Texas state Salvage title pending. See attached image.
Vehicle is restored to normal functionality and posted for sale. On the 04/12/2024 the Complainant (***** ******) contacted me regarding the vehicle. She and her dad came to my garage and test drove the vehicle, and proceeded with purchase. I explained to her that the title to the vehicle is pending from Texas DMV, and I will contact her soon as I have title in my possession. I issued her Bill of sale and Louisiana 60 days temporary registration tag. (See attached image 1)
On the April 22 2024, I received title from the Auction. Texas Salvage title. Title had a bond on it.  I reached out to Copart Wilmer Texas operational manage regarding the title having a bond on it because it wasn’t advertised at the Auction as a Texas bonded title via email. (See attached image 5 messages).
On May 03 2024 I received email response Copart assistant manager at Copart Wilmer Texas location regarding the issue. She stated that they are looking into the issue and will reach out to me with their findings.  (See attached image 6).
I didn’t get any response back from the Auction regarding the title before the Complainant (***** ******) 60 days temporary tag expires. She reached out to me about her tag expiring. I issued her another 60 days temporary tag and explained to her what was going on with the title. She didn’t understand. I told her I'll reach back to her regarding the title when I get a response from the Auction to decide if she is to return the vehicle.
On August 21 2024. I reached out to Copart again regarding not have received a response yet on how to resolve the title issue. (See attached image 7.) The Auction responded back to me on August 27th 2024 apologizing for the delayed response. (See attached image 8). On August 28th 2024 the Auction responded with a resolution (see attach image 9). The resolution is for me to return the vehicle to the Auction since it can only be registered in Texas and I can be refunded. (See attached image 9 messages).
Between the time of response and resolution from the Auction, the Complainant (***** ******) was involved in Auto accident. The vehicle was totaled and insurance issued her a check. She reached out to me regarding the title of the vehicle, I told her the resolution from the auction and also gave her the bonded title.(see image 9-12). I asked her to have the insurance company reach out to me regarding the title issues if they have any concerns. I also told her that she can bring back the car back so I can send it back to the Auction and refund her if she’s not satisfied. She insisted that the car is with the insurance wreckage recovery and she cannot bring the car back to me and is demanding for refund.
I cannot refund the complainant (***** ******) if she doesn't bring the car and title back to me. She has already gotten a check from the insurance company and is also trying to get a refund from me.
I am willing to refund the complainant if she brings back the vehicle in operating condition.

    Thank You.
