    3/16/2022 I signed a contract to renovate an in ground ********** and repair all leaks. After renovation complete leaks still happened. 2 more repairs on deck behind spa, still have leaks and I was charged more for repairs. They changed the filter pump after I told them it had already been charged. I don't want this to happen to anyone else. I may be filling in this pool. Tired of dealing with this. I told them don't come back I won't pay anymore.

    August 2, 2022 I signed a Pool contract with this business. The contract paid in full (41,800) on 8/2 via wire & no work had been performed when I canceled on 8/12. The owner ultimately said I got a good deal & should go ahead & let the them do the work. The son, my POC & mislead me in order to get full contract balance sent to his personal account. He overcommitted to a date ( by 9/3) he knew they could not meet. Owner has confirmed they wouldn't meet my timeline and it shouldnt have been promised. The son stated monies "up front" ensured he could pay for supplies in advance & beat my Housewarming on 9/10. As of 8/15 I learned no pool supplies I was rushed by the son to select on 8/5 have been ordered. Within 8 days of signing the contract I uncovered 1. Pool permit had not been filed 2. Son lied about having insurance/arborist license "after" my wire 1700.00 for planned work, 3. The company claims due to admin error my permit was filed in wrong parish (but could not show proof when asked for app#) 4. "Small" Canary Palms quoted at $2,000 ea. were $1250.00 for "large", 5. Contract terms were not followed *I drafted email v/s company creating adendum or update to contr. I uncovered that a prior vetted pool company (which was more expensive by 20k) hadnt canceled permit filing due to admin oversight . After all of the above & more, time loss ( no fault of mine) and what in my opinion appeared to be unethical business practices, deception, family business misalignment... I made an EASY decision to end the contract both verbally &in writing on 8/12. Owner said he is open to resolve but has "not" refunded me nor produced receipts requested for expenses claimed to be out of. The son text & said he would not be refunding my $41,800 only $1700. No cancelation period noted on contract. It feels like theft! I'm told they only build less than 6 Pools a year. My money is sitting in the sons "personal" bank account. He seems to think it belongs to "him". IRS Red Flags

    Unfortunately, we had to clear legal matters with client and couldnt respond promptly. Client loss criminal complaint due to bonded contract and purchased materials. She then filed a civil proceeding where she filed for a summary judgment and it wasnt granted. It wasnt a forced decision because a signed contract and full payment was submitted on her behalf . Supporting documents were submitted. The payment that was submitted was wired to a personal account and transferred immediately into the business account on the same day . It was an oversight on bank when we called bank together to get the proper wiring information . While receiving the proper wiring information we also requested the business bank account information and the banker made a mistake and provided the personal account information .When the money went into the personal account we have proof that it was immediately transferred into the business account the same day. The business account is also with the same bank and was corrected immediately. The client decided that she wanted to breach contract for personal reasons and unfortunately thats not how business is conducted. Its a process and many unfortunate matters took place that delayed pool installation. Client has a history of breaching contracts and poor communication. When Kimbroughs staff went to file permit she had an open permit application filed with another pool company. Therefore it was a week and half delay because she had to write a letter to ******************************* permit office . It had to be a notarized letter saying shes no longer with the other pool company and we couldnt proceed with our permit which delayed the process. ********* pool was able to file the application for a permit after a week and half delay and it was accepted . At that time we already scheduled her position to get her pool completed. We had to delay other people that were in line and materials were purchased and waiting for clearance on permit to proceed. When we called the permit office to see what was the update on permit taking so long at that time they told us that the client called them to stop progress on the permit . We also have that in a letter from ******************************* permit office. Then client asked ** to take a complete loss and resell products that were already purchased for her project that she abruptly cancelled. The client questioned arborist license and was immediately refunded $1700 which was a separate agreement after the pool contract was signed. It was just labor to cut the tree down no materials were involved thats why she was fully refunded plus she requested refund for wiring fee which was also refunded . Unfortunately this took place , we have been in business for 55 years and been with the BBB for 29 years . Within the time frame this is our first bad review that is wrongfully filed with the Better Business Bureau. Our reputation speaks for itself. I notice she stated we only do six pools a year . Id like to address that , we do full renovation, new construction build, plastering and fully custom pools . We appreciate everyone that have been with us three decades or better servicing their pools and we appreciate all the recommendations because we dont advertise at all. Matter of fact the client that we are currently responding to on the BBB called to say she wanted us to do her pool because we have an impeccable reputation! Im very sorry it didnt work out with this client . We went through great measures to satisfy her but unfortunately we couldnt come to terms with providing the service for her pool. Whoever it concerns thanks for reading our reply.
