      I contacted Michelle A********* after seeing an ad on AKC Marketplace for Staffordshire Bull Terriers.

      She only communicated via texts until I insisted that we speak. When we spoke, she mostly talked about her grandchildren and crawdads.

      Anyway, she said she had a show dog she could sell me and to forward her the sum of $2000 for the dog plus $500 for bringing the dog to me in Philadelphia, PA. I sent her $2500 via Zelle direct withdrawal from my bank and direct deposit into her bank.

      Within 24 hours I decided it was a knee jerk reaction and didn't want the puppy. I offered her $500 as retribution with an expectation that the other $2000 would be returned.

      She said no. If I didn't want a dog this year, I could get one next year. She said the contract says "no refunds". I never read the contract until she said that and I mentioned that I never signed the contract.

      When I realized she wasn't going to give me ANY of my money back, I started talking to her again about getting a puppy. I figured she could bring the puppy and I could just sell it to try and recoup some of my money.

      The longer I talked to her, the more likely I figured she wasn't even going to fly to Philadelphia with the puppy. I could have spent the next day driving to/from Philadelphia International Airport, but I figured it would be a waste of time.

      So, being the bigger person, I contacted her by her preferred method (text) and said I didn't want a puppy from her ever. In my last text I explained that I had so much anxiety caused by the situation that I was up with diarrhea.

      Her response was about her own bowel habits.

      Thank you for anything you can do. These people are running an unethical business even if they are champions of certain dog breeds.

      I am rejecting this response because:

      I did not sign an agreement. She is refusing to return even a portion of 2500 because I decided I didn’t want her puppy. 

      She is an unethical horrible breeder and did me wrong. She knows it.

      She claims I can get a dog some other year. Why would I want to represent her name in the ring? Also, why won’t she put that in writing on her letterhead?

      I have provided the AKC and bbb with attachments of conversations.

      She Outright is stealing my money and I will now contact an attorney.

      The purchase for an AKC Limited-Registration Staffordshire Bull Terrier was $2,000 with an additional $530.30 for an In-Cabin Airline Delivery bringing the Grand Total to $2,530.30. On January 9th of 2021 I submitted a required non-refundable but transferable reservation payment of $400 for the 2nd pick of a male puppy from 3 litters expected in April of 2021. On January 10th of 2021 I submitted the remainder of the full purchase in advance to have the 2nd pick of a male from the litters upgraded to the 1st pick of a male. I received continuous excuses for not being able to pick from the three litters expected in April of 2021 along with numerous other advertised litters but finally reached a time where I got to pick from a litter and submit another payment for delivery, $530.30 was submitted on August 25th of 2021. However, a few days later I received more excuses as to why I would not receive that puppy either. More advertised litters came with additional excuses until December 31st of 2022 where I was offered a dog. I requested but did not receive any additional information such as AKC Registration Numbers for the Dam & Sire, Pictures of the litter, etc. On January 4th 2023, I requested a refund of $2,120.30 out of the $2,530.30 as I knew that the $400 reservation payment was not refundable. The business said “No refunds” and sent more pictures of the puppy, but again not the rest of the litter, dam, sire, etc. Unfortunately, along with the lack of information regarding the breeding of this puppy the additional pictures also showed that the puppy had very noticeable health issue(s) that led me to decline the puppy and requested information on future litters. I went even further and offered discussing receiving a refund even lower than the $2,120.30 I previously requested but that was ignored and I was simply told of additional advertised future litters and that “I’ll just put you for the next one”.

      I am rejecting this response because:

      I am still requesting a partial refund ($2,130.30 out of $2,530.30) as I did not receive the product I purchased over 2 years ago and the ONLY term that was mentioned and agreed upon was the deposit ($400) being non-refundable.

      No terms/contract were ever provided nor were they ever mentioned apart from the following which was provided on January 8th 2021:

      “If your thinking about getting on our list only do so if your  seriously ready to commit. Understand normal wait time can be six months or longer.Prices$2000 Plus shippinglimited registration$3200 plus shippingfull registration(Deposit is non refundable but transferable )Final payment and shipping fees must be paid In full by 71/2 weeks of age or before !”
      It was clearly stated that the “deposit is non-refundable” but this did not mention the remainder of a full purchase payment ($1,600) nor the delivery payment ($530.30) which is why I am requesting a refund of $2,130.30.
      Additionally, the deposit and remaining purchase payment totaling ($2,000) were for the first pick of a male puppy from 3 specific breedings: (Dexter x Miss T) & (CC x Cricket) & (Cazel x Mya)… yet none of those litters were provided. Sure, the breeder could keep/transfer the deposit, but the remainder of the purchase payment was for a male puppy from one of those 3 specific litters.
      After more than 3 months passed (April 28th 2021) I reached out to receive an update on those 3 specific litters my purchase payment went towards and I was given excuses to why I wasn’t given a selection from all 3 of those litters. I was also told “Glitter is due next week…. Tango and Teal due end May” yet several months went buy again and I was not provided the option to choose from that second set of 3 litters and contacted the breeder again on July 14th of 2021. The breeder responded with a mention of 4 more litters “We have done two breedings… Than two people have bred CC… First litter due July 27”.
      On August 11th 2021, the breeder unknowingly why switched from using emails to SMS/Text messages for contact and I supposedly finally got a pick… (Please note this is a pick after 10 advertised breedings and this is not from one of the 3 initial breedings that my full payment was made towards). I was provided 2 male puppies to choose from out of the 10 advertised breedings. I had to request information as none was provided besides the pictures of the 2 male puppies. I paid for the delivery ($530.30) On August 25th 2021 but on August 31st 2021 I was told “We loss one male… The other not doing well”. Yet at that same time another previously unmentioned and unadvertised litter was available, but I declined as this did not seem right (Approximately 9 months had passed after full payment and where I had to keep reaching out for updates, finally got a pick after 10 breeding advertisements, paid more money, then my pick supposedly died but another pick suddenly emerges and this time I was shown the entire litter). On September 4th of 2021 I was informed, after I requested, that another litter was due on October 5th of 2021. However, I was not contacted until I reached out to the breeder on my own accord nearly 12 months later on August 26th 2022. The breeder said the same as nearly 12 months ago, “I currently have litter due in October, I’ll definitely mark you down for that one”. What about the one you said for October 2021 and the 12 months that pass between that time? Well ,once again, the breeder went months without contacting me and I had to reach out to the breeder on December 13th 2022. The breeder claimed “I had wrote you Wonder why hadn’t head back” yet I was not contacted for that breeding that was supposed to be born in October 2022 just like I wasn’t for the one in October 2021. However, the breeder claims there is 1 female puppy available or an “older male… He’s retired champion”. I of course declined both of those dogs as my initial full payment was for the 1st pick of a male puppy from 3 specific breedings. Yet another breeding was advertised to be delivered at the end of that month, December 2022, yet I did not receive a contact again. On December 29th 2022 I reached out to follow up on that supposed breeding and on December 31st I am shown two pictures of a singly puppy that is a couple weeks old which wouldn’t be possible as on December 13th the breeder said the breeding wasn’t due until the end of the month (Pictures are included in this document). Despite all of which had occurred over approximately 2 years I requested additional information, but after a few days passed with no response I kindly requested a refund on January 4th 2023. The refund request was denied even when I mentioned the reservation being waived (the breeder would keep it) and even offering to consider reducing the remainder of the full payment ($1,600) and delivery ($530.30) to simply get some of my funds back (Again, please note that the full payment was for the first male pick from the first 3 advertised breedings and the delivery payment was for a puppy that not only wasn’t from the first 3 advertised breedings but I also did not receive the one I picked and paid delivery for & these payments were all placed in 2021). However, the breeder did provide additional updated pictures of this single puppy but it was very obvious that the puppy had developed significant hair loss around it’s ears, jaw and even stretching down it’s neck. While it may not be possible to determine the cause of the hair loss I believe any professional breeder and especially any veterinarian can conclude simply by viewing the pictures that a health issue is present so of course I denied this puppy. The breeder then advertised 3 more breedings and said “I’ll just put you for next one”.
      I did not receive my purchase: 1st pick of a male from the first 3 litters that were advertised when I placed my payments. I also did not receive a puppy that I did select approximately 8 months later and even submitted an additional payment for delivery. I believe that alone should invalidate the breeders reasoning for refusing to refund, simply because I denied a puppy offered approximately 2 years after full payment and approximately 1.5 years after paying for delivery for one I did select. Additionally, no terms were ever mentioned or agreed upon apart from AND I quote "(Deposit is non refundable but transferable)". That quote did not mention the remaining purchase payment nor delivery, payment so no agreement was ever made on those not being refundable hence me being willing to accept a refund minus the $400 deposit that WAS stated to be non refundable. 
      The breeder provided a couple supposed statements from “clients” but has the breeder been informed of complaints submitted to the Better Business Bureau from several “customers” who have been said to have issues rather similar to mine?

      some didn’t conceive

      teal had all girls

      Tango miscarried

      he has credit that won’t expire 

      he can get a puppy 

      later this year 

      That’s why our information sheet states no refunds

      thats why they are told do not send unless you understand

      I am rejecting this response because:

      Animal Husbandry should be a
      burden on the retailer NOT the consumer.
      No “information sheet” was
      ever provided or discussed nor were any “terms” besides the deposit/reservation
      payment being non-refundable. Furthermore, this was only mentioned in an email’s
      body message which stated “deposit is non-refundable”.
      There were three different
      types of payments that were submitted:
      Deposit/Reservation Payment ($400)
      Remaining/Final Payment ($1,600)
      This payment was also submitted for the 1st Male pick from 3 specific litters
      This product was NOT received nor was an opportunity to select the product
      Delivery Service Payment. ($530.30)
      This service was NOT received
      The only type of payment that
      was stated as being non-refundable was the Deposit/Reservation, Payment,
      which does NOT include the other two types of payments. The Remaining/Final Payment
      is not the same as a Deposit/Reservation Payment nor is a Delivery Service Payment.
      Again, I retained and have provided
      proof of all our communications/interactions/payments. The retailer chose to
      state the Deposit Payment was non-refundable but did not state this included a Remaining/Final
      Payment nor a Delivery Service Payment.
      Just as Animal Husbandry should
      be a burden on the retailer so should creating and providing Terms and
      Conditions for conducting business. Again, only the Deposit/Reservation Payment
      was stated as being non-refundable and this was done in an email’s body message…
      not an “information sheet”, which was also never provided nor even discussed.
      I am not only requesting but also believe I should be entitled
      to receiving a refund for the two different types of payments that were never
      mentioned as being non-refundable: the Remaining/Final Payment for a Product
      which was not received ($1,600) and the Delivery Service Payment for a Service
      which was not received ($530.30). This brings a total refund request of ($2,130.30).
      Despite the Deposit/Reservation
      Payment ($400) having been stated as being non-refundable I wasn’t even
      provided the opportunity to select a product from the three specific litters
      that the payment was submitted for and which is supposedly due to an Animal
      Husbandry Burden/issue causing the situation. However, an Animal Husbandry burden
      issue should fall on the retailer not the consumer, which should leave me
      entitled to also receive a refund for the Deposit/Reservation Payment as well.
      To simply conclude: At this
      time, I am simply and kindly only requesting a refund for ($2,130.30) which excludes
      the ($400) for the Deposit/Reservation Payment towards a product that the
      retailer is essentially stating never existed.

      In the/this attached document I have provided a copy (which has previously been
      provided) of the retailer only stating that the “Deposit is non-refundable…” as
      well as the three specific advertised breedings that my Deposit/Reservation
      Payment and Remaining/Final Payment were made towards. In addition, a copy of
      all three of the payments I submitted (which were also previously provided), show
      proof that my payments even specifically mentioned they were going towards the three
      advertised breedings that supposedly never occurred… but again that would be an
      Animal Husbandry burden that falls upon the retailer not the consumer.
