    On August 31, 2022, I attended a presentation given by Timeshare Clearinghouse representatives who spoke of a new regulation that would hold timeshare owners legally liable for maintenance fees if they deeded it to another party that failed to make the payments. To avoid the possibility of this happening to me, I entered into an agreement with the company on the terms that they would aid in my release from the original ownership contract for a flat rate settlement of maintenance fees for a total of $9,112. I was also presented with the opportunity to join a travel club which would give me access to more properties at a nightly rate without being subject to purchase or ownership. I accepted this based on the explanation that the only cost associated would be an annual fee of $189 if I chose to utilize it. After receiving a request for my deed and timeshare portal username and password, I inquired about the purpose of the request, the associated breakdown of costs and timeline from start to finish in the form of a formal itemized statement. On September 20, Timeshare Clearinghouse responded to my request with a list of cost associated with the purchase of the travel club and transfer of my timeshare title to include: $1044 maintenance fee, $1825 TCH fee, $3200 resort & club fee, $1500 attorney fee and a $1,544 title deed search, Estoppel fee and transfer. None of these were fully disclosed in the agreement and I was not informed that I would be paying any additional costs associated with the travel club prior to, other than voluntary annual membership fee. I informed the company that I had made an informed decision on the basis that the contract was not clear and conspicuous. I requested a full refund for the debt I had to incur as a result. The company has only offered to return the money not yet spent out of the original amount. At this time, I believe Timeshare Clearinghouse to be in violation of my consumer rights and no settlement has been reached in the matter.

    I am unsure of what the complaint actually is about.  Timeshare Clearinghouse has performed every aspect of this contract.  This client met with us, for a free dinner and to receive an owner update, which covers several items, including transferring their existing timeshare ownership and joining the travel club.  She chose to move forward and like every other client was provided with twice as much time to cancel as we are legally required to give.  We communicated 7 times by email and 5 times by phone, within the first 12 days with her and there was no concerns.  When she could not find her deed, we ordered a copy from the county recorders office and sent it to our attorney for title search,  Once the title search came back clean, the attorney prepared a new deed for this client to execute.  Our pricing is determined by the exact ownership being transferred and is an all in price, meaning the client will never have to pay any additional funds.  We notified this client that we were sending her the deed to execute and she stated she wanted to cancel.  We explained that her time to cancel had expired 3 weeks earlier and we had already performed the legal work necessary to transfer her ownership and she had been enrolled into the travel club.  Our clients biggest concern is how quickly we will remove them from their timeshare ownership.  So, once the rescission time has past, we move with speed to complete the transfer.  I am unsure how anyone can complain about us doing our job, communicating with them through out and then they stop us.  The travel club has an annual fee of $189, only if used, if no use during any year, there is no fee.

    I placed a complaint to the BBB on October 26, 2022, against Timeshare Clearinghouse. After some time without receiving an update, I contacted the Louisville BBB. I was then informed that notification of Timeshare Clearinghouse response to my complaint had been sent on November 16, 2022, to my email, which I did not discover before it was subsequently closed after 7 days without response. The matter remains unresolved, and I would still very much appreciate input and resolution options from the BBB. As instructed, I am writing to request the reopen of claim case number ******** on the reason of not being aware of the initial notification. This matter remains in limbo. My last correspondence to the company was to cease activities pertaining to this case with request for a refund of the total amount on the grounds that the given contract was unclear, unconcise and did not list the costs and fees charged as a result. According to Timeshare Clearinghouse statement, there was communication several times without expressed concern. I have attached a document that combines all correspondence from Timeshare Clearinghouse and myself which will prove the company' statement incorrect. Timeshare Clearinghouse misrepresented the terms resulting my inability to make an informed decision. After review, can you please provide next steps. Thank you for your time and consideration

    This client came to our presentation with her daughter and after approximately 2 hours, asked to take some of the contracts with her and left.  They came back a few hours later, wanting to move forward with our company, as they both agreed it was their best option.  When she executed the contract, she initialed and signed a total of 7 pages of the contract, some pages requiring multiple spots to initial.

    As previously answered, we have already performed the bulk of the work to complete the transfer of her timeshare out of her name.  We are ready to complete, as contracted.  The contracts every client executes require our company to act with precision and quickness, to provide the best service possible.  We cannot reverse the work we have already performed and get the funds spent in doing so.

    We take considerable precaution with out contracts.  Every client is afforded more than twice the number of days of cancellation, legally required by their state of residence.  All of our font is the same size, with no fine print.

    The response made by Timeshare Clearinghouse does not accurately address the discrepancy at hand. The original terms of agreement presented to me at the presentation referenced on August 31, 2022, was that the company would aid in the liquidation of my timeshare through the settlement of future monthly maintenance fees. A membership into a travel club that would allow me to gain access to hotels or resorts for a discounted nightly price, which I would only pay an annual fee of $189 if I chose to utilize, was offered as an option. Those were the terms I agreed to.  I did not agree to purchase a travel club to include a $1044 maintenance fee, or a $3200 resort and club fee. I was not presented with an attorney fee schedule detailing the sum of $1500. I have yet to receive a HUD detailing a $1825 TCH fee or a $1544 title deed search. The supporting documentation will show that I repeatedly asked Timeshare Clearinghouse to provide me a formal itemized statement to describe how the extension of my credit was utilized before any works had been done. They have failed to do so. There was no consideration of funds given to me by Timeshare Clearinghouse.  This contract was not clear and concise and did not list out all of the terms or fees that I am being held responsible for. This prevented me from making an informed decision, which is my right as a consumer. I feel that I have been discriminated against due to my age which is causing immense duress.

    The contract entered into by this client is for the transfer of ownership of her timeshare and a membership into the travel club, that has a annual fee of $189, only in the years of use.  There is no annual maintenance fee of $1,044 nor is there a $3,200 resort and club fee with the travel club membership.  The other costs associated with this purchase, were the costs of legally removing her as the owner of her timeshare, which includes all costs and the attorney.  We do not provide an itemized statement, we provide a service and the cost for that service, which was presented and accepted by this client.  The contract is clear, concise and contains no fine or small print.  There are no fees, outside the purchase price and annual fee of travel club, if used, that this client is responsible for.  Again, we provide more than twice the legal rescission period required, to make sure our clients have the time to check, verify and feel comfortable.

    The inconsistency and inability to
    provide an accurate statement of charges is why this dispute exists and
    persists. On September 19, 2022, after acquiring the credit and providing permission
    to Timeshare Clearinghouse to access that credit for what I was led to believe would
    be the liquidation of my timeshare, I requested a breakdown of all cost
    associated with the transaction. On September 20, 2022, Timeshare Clearinghouse
    responded to that request with an informal statement of cost to include a $1044
    maintenance fee, $1825 TCH fee, $3200 resort & club fee, $1,500 attorney fee,
    $1,544 title deed search, Estoppel fee & transfer fee, totaling $9,113. Please see exhibit E in the supporting documentation. According
    to the company’s latest response, these fees now do not exist. If the company offers a service for the cost of that service, as the person paying for the
    cost, why can’t I know what makes up that cost? Clear and concise means notice
    or disclosure that is apparent to and understood by the reasonable customer. This
    is what makes it valid, not the time to rescind. I’m the customer and I do not
    understand the cost associated with this contract.

    It remains my stance that the company has not fulfilled fair and adequate reporting of the service offered and the costs breakdown of that service, which I have a right to as a consumer. This dispute remains at a standstill until the company can provide the truth. I have already provided supporting documentation which shows the company's inconsistencies in what they are claiming is the service they provide and the cost at which they provide it at. My hopes are that the BBB can provide a thorough review of the agreement in question along with all correspondence and offer a recommended resolution.
