      At the March 1, 2025, Home and Garden show we went to get new ideas for gutters that would not drain out on driveway. * *****, the owner, was in the Ever Clean booth and we spoke directly to her about the problem we had and asked for help to correct. This had been an icy winter and the way our gutters were, we had been home bound for 4 weeks. My wife is mobility impaired and missed four weeks of therapy because of this. The only problem with our gutters was the drainage issue. I am 75 years old with mobility issues so I can no longer clean ice off the driveway. At the show, we were both on mobility scooters. We have lived in this home since April 1975, and were well aware of what we needed to have happen. Mrs. ***** was attentive and she assured us she could correct the problem. We agreed on the explained correction and we agreed to let her send her construction supervisor, *******, to look at our home and explain what they would do to keep the water off the driveway.. ******* assured both of us that he could fix the problem. We agreed on his plan on March 5, 2025, and paid him a deposit of $2500. His plan was to move the new gutter location to the middle of the back of the house and showed us where he would put it away from the driveway. In the front, he showed us where he would put the new downspout so it would not drain to the driveway. We agreed to this and signed the paperwork. His two workers came out and we went over what we had agreed on the new gutter location and went in the house. We stayed inside the house and trusted them to do what we agreed. After they left, we went out to look and realized that they did not put the downspouts where we agreed on and when it rains water will gush right onto the driveway. *** called ******* and someone came while we were not home and put a $9. gutter extender on the back downspout We have called and sent several email videos on the water gushing over the driveway and they have not responded. Not fixed.

Furthermore, our records confirm you conducted the post installation inspection with our installation manager issuing final payment with check #5826 to him upon completion. 

      Mr. ****, thank you for the confirming video of the Ever Clean Gutter working as expected.  We have scheduled an additional site visit to install a downspout extension.

      Mr. Mullins ordered our Ever Clean Gutter System in 2018 and requested we come out in 2022 to have a
      look at his performance concerns on the front of his home.
      We rarely have warranty issues but we do always try to help our customers solve rainwater collection
      problems with their homes to our best ability!
      Typically, inspections are accompanied with a service visit charge IF they are not a problem with our
      installation or a warranty issue. We provide our customers with two lifetime performance warranties: The
      gutter will never clog (on the inside), and the gutter will never pull away from the home.
      A letter was mailed to Mr. Mullins in 2022 informing him that we came for a look and could see no signs of
      performance failure. The letter also acknowledged his statement that he intended to order a new roof
      replacement and we therefore noted in the letter that the roofer need to simply avoid all physical contact
      with the Ever Clean Gutter System in place to avoid damage or performance issues. The letter also noted
      that we would waive the service fee for that visit but the next visit would be accompanied by a service fee if
      the concerns were not associated with our two performance warranties.
      Mr. Mullins next contacted our office June 13th of this year with concerns that the rear gutter "looked a
      little low," to which we requested a few photos to be submitted to avoid an inspection as the inspection
      could generate a service charge if not a warranty claim. A single photo can answer a great deal of questions
      and be a true time saver for all involved, especially our customers. Photos can be submitted via email or
      text, of course at no charge, and they are reviewed by a team of managers and installers.
      Mr. Mullins indicated his daughter would send a photo or two, yet they were never received. On June
      14th, 2024 Mr. Mullins placed another call to the office, this time with an unkind tone, explaining his
      condition with blindness and wheelchair. We told him we could schedule a visit but it would be
      accompanied with a service fee this time if the problem described is not part of our warranty.

      Our Operations Manager, James Barger, which is the same manager that visited Mr. Mullins’ home in
      2022, called Mr. Mullins to notify him we would come out and Mr. Mullins declined and informed James
      of a pending lawsuit for thousands of water damage to his home which he believes is caused by the Ever
      Clean Gutter System in place on part of the rear of him home.
      Gutters are rarely the cause of damage to INTERIOR of homes as they are positioned at the end of a soffit
      on the fascia boards, which can commonly be as much as 18 inches past the exterior walls.
      We have 20 plus years of very happy customers throughout Kentucky and are always interested in helping
      our them solve problems when it is associated with the Ever Clean Gutter System. Other exterior
      components, such as roofing, are beyond our scope and are typically the cause of interior water damage.
