On August 13, 2023, I signed an agreement with ******* ******** who represented himself as the owner of Build Back Better. The contract said that all work was to be completed by August 29, 2023 and stated that time was of the essence. As a deposit I paid $418.40. He committed to:
Install 64 sqft of subfloor, 144 sqft of LVP3, 54 linear feet of 1/4 round, caulk, paint, and repair soffit, carpet repair, tile repair, and reattach shutters.

The contract said the start date would be August 16th or sooner.

On August 12th via text he stated that he would start the job on Tuesday August 15 or Wednesday 16th and would take care of everything in 3 days. On August 13th, he told me he would start the job on Monday August 14th or Tuesday August 15th. Then on August 16th he said he had some problems and would start the job on Thursday August 17th or Friday August 18th. On Friday he said he was on his way there and would have the subfloor replaced by 6:00 that day. The floor was not fixed or even started. He pulled up what looked like one board was all the work that was done. On Friday August 18th, he told me he would be back Sunday August 20th. He did not show up. On Monday August 21st, he said he couldn't find a baby sitter so he couldn't go to the job. That day he told me he would be there Monday by 8:00 am. He did not show up that day either. On Tuesday August 22nd he still had not restarted the job.

At that point, he had failed to show up on seven different days that he said he would be there. I offered to negotiate a settlement to pay him for the minor amount of work that he had done and to hire someone else. He wanted to charge me $388 or 37% of the total contract. I did not agree because that amount felt ridiculous. The contract said all the work would be complete on August 29th and that time was of the essence. By August 29th none of the additional items in the contract were complete.
