The lock on my unit was left in maintained mode for an unspecified amount of time yesterday 9/6. I have animals and valuables inside and the front door was left completely open. I did not know this arriving home from work yesterday and couldn't figure out why 2 keys I had wouldn't work. Dumb luck, I turned the handle after 30 minutes and my door was open.
The first thing I did was check to make sure nothing was stolen. Everything appeared to be in order. Yesterday, I spent a lot of time trying to get ahold if the office at the phone number myself and my boyfriend were provided. There is a pest problem. We've been very corporative with the 3rd party contractor and have let it be known on multiple occasions if someone needs to be home, they need to come on the weekends or Tuesday/Wednesday. They were supposed to come last week when my boyfriend was home every day in vacation but canceled. We were told, not asked Tuesday that pest control would be by. It's fine if they enter the apartment but please make sure the animals are not in the room being treated and keep that door closed. I attempted to reach the office many times as screen shot shows to see if they would reschedule to next Tues/Wednesday when I would be home.
I'm putting this out here because I did get a call from someone at * ** ********** ***** before work this morning. She was completely dismissive of my panic over the fact my apartment was left unlocked for an unknown amount of time yesterday. She tried to blame me for the pest problem even though several units have had to be treated in our building so likely, these pest are traveling. She also said I never called or spoke or left messages. To which I did tell her maybe if they had people in the US and English we'd their first language and they didn't misspell my name and address more then 3 times on a call they would get messages. I love my area, I like my apartment. We are never late with rent and have been there 2 years.Business Response

Regarding the pest treatment, we understand how important it is to address this matter promptly. We know you are only available on Tuesdays and Wednesdays, which unfortunately limits our scheduling options. Additionally, our pest control technicians have noted that the current state of the unit—specifically related to cleaning and housekeeping—impacts the effectiveness of the treatment.
To better address the pest issue, we kindly request your cooperation in maintaining cleanliness in the unit. This will significantly enhance the efficacy of the treatment and help us resolve the problem more effectively.

On May 31, Tina A******* could not meet me to recieve keys from my unit and do a move out inspection. She offered me time to do more but I didn't need it and agreed to leave keys under Matt and Agreed to meet June 3. On June 3rd we met, I ppinted out things I felt I was responsible for, she asked to be friends have lunch sometimes she said she was leaving her position we left. June 29 I contacted Tina about my refund, f**** AT THE FRONT DESK took my new address and Tina said I would recive refund but didn't handle the property, I was told I would recieve a return call that day. I called the next day and same gave new address to ***** who couldn't find any info printed a return phone call and again nothing. I call the folding day and **** answered the phone as "check smart" but transfered me to Tina no answer. I contacted jessi B***** who asked me questions I could only answer with yes or no, did it I lied he would be angry and he also never tithe call. He told me if I had the keys, which I did not or entered the apartment after the 31 I would be charged with full rent in June.
When the employee answered the phone unprofessional as lly I realized again they were simply making a big joke about all the pain and suffering of my initional complaint of carpet beetles and continuing the harassment, lies and psychological abuse that I endure since Aug of 22 when I was first threatened with eviction for being a nuisance asking for needed repairs that led to abatement of contract with decin 8 which they failed the first insurrection. I was told by the property manager the fifty dollars I gave her was given to a contractor and the heavy furniture infested with carpet beetles) would be removed to the dumpster on May 31 after placing keys so on June 1 I had no keys, no belonging in unit and June 3 I met Tina, was told it was an awesome move out. The unprofessional behavior, the lies and repeated notice to vacate with harassment and slander shows the credibility of the company.Business Response

Thank you for reaching out. We took over as manager of Batavia Meadows in August of last year. Ms. ***** came to us on 9/1/22 with complaints of "carpet beetles" in her unit. In the same month she made complaints of roaches. Pest control did not find these issues in her unit. The housing authority called our office on 10/18 stating that this tenant is "wearing them out with complaints" as well. Ms. ***** called in numerous complaints to our office, she emailed us constantly as well, and when maintenance would come to look at them she would harass them or not let them in. This tenant sent our office numerous emails, called daily, harassed our tenants and staff on site. She made a facebook group indicating that she managed or worked for our property. We attempted to work through all of these issues with her worker however her worker was frustrated with her calls and emails as well. This tenant has called our office threatening suicide among other things on recorded lines as well as in writing.
In January pest control found that the carpet in her unit was soaked with cat urine and it was fleas in the carpet from her cat. In another attempt to make Ms. ***** happy we replaced the carpet in her unit. She then poured bleach on the new carpet stating this carpet also had carpet beetles.
In February we nonrenewed Ms. ******* lease to be out by 3/1. The tenant did not vacate however even still we worked with her worker and extended the renewal another month. In that time we sent pest control again at her request. She refused entry. Ms. ***** has filed complaints regarding this issue already in May of this year. Ms. ***** vacated the unit 6/30/23. Her unit was checked that day .We did not even charge her account for the damages in the unit at move out. She did not pay June rent, or other past due late fees and charges. After her deposit was credited to her her past due balance she still has an outstanding balance with us of $596.59. A letter detailing this was sent to her on 7/1 via mail to the address she provided.
Additionally we no longer manage this property, which we have explained to Ms. ***** on the multiple times she has called our office.

Tell us whyTo whom it concerns... CAP property manager Tina A******* did not accept web or electronic payments. Above is the only copy of a check I currently have. I last paid rent in May of 23, on the fifth through the only means available to me, a slot in the door of a vacant office. Rent is due by the 5th of the month midnight. May 5th 2023 fell on a Friday, it is not my responsibility to hand deliver the rent but the property managers responsibility to collect all tenants rent via door slot. I have also included proof that in Jan of 23, my unit failed inspection of owner repairs sanctioned by the housing authority and therefore recieved no payment from HUD/METROPOLITAN HOUSING AUTHORITY but DID recieve my portion of the amount due and the amount being asked of me to pay is above my deposit is the amount they were denied by cmha prior to the 200 rent increase with my new lease which CAP ALSO denied (vacate by order of no lease) yet starting in Feb. 23 did accept increase payments from both myself and cmha. Also included is at their request withdrawn without prejudice and seeking no secondary action of monetary settlement plantifs sworn and certified court record of releasing me from the lease, mutually consented, holding me with whatsoever no financial responsibility of late fees or other secondary cause or motion from the clermont county court of clerks. CAP has, since they first purchased said property, seemed to have me vacate this unit in question over 5 times, the first with similar accusations of non payment of 4 months rent which I did produce traceable money order receipts to counter.Overall CAP even prior to their negligence in repairs and regards to tenants safety and well being, prior to being held in abatement and illegally issuing a notice to vacate while under abatement then committing fraud by changing the original notice dated Jan 6, 23 from notice to vacate due to holding tenant responsible for section 8 sanction repairs to Feb 23 notice to vacate for no lease after accepting increased rent (approved at their request) in return for new lease for myself to have again showed unorthodox, consist changes in their stories and having never ask in court nor to me in person any financial responsibility on my part by signing attached agreement witnessed in court and so lack and admitted to having no valid legal reason to ask more or with hold my deposit. Also your portal is failing to send my documents.Business Response

Please see the attached records. I believe we have provided all of the proof that we can. We did not charge for damages on move out as a new company took over the property during that time.
We would greatly appreciate if you would no longer allow Ms. ***** to harass our office. We have nothing more to do with this property and have provided proof that her claims are not valid in the many many complaints she has written, phone calls to our office, etc. We are no longer even holding her deposit and this issue needs to be taken to the owner or new management company. Per our records she left owing $1346.59, which did not include the damages she left in the unit. The new management company would handle those charges if there are any as well as her deposit dispute.

I moved out of this apartment about 4 months after my lease was up last year. I notified someone at the office who kept calling me and asking me to sign a new lease. I told them I didn’t want to sign a new lease because I would not be living there another 12 months. I notified them a full month before I moved out, and months later found out they filed an eviction against me 2 months after I moved out! They are now trying to charge me over $2700 for rent they say I haven’t paid and for court costs. This company is a huge scam which is why they are so poorly rated. The apartment I lived in was infested with roaches and they only sent someone out one time to spray and it didn’t help. They wouldn’t send anyone out again because they said it takes time for the poison to work. They do less than the bare minimum and then charge people ridiculous bogus fees and try to scam tenants once they move out. If the company will not reach a resolution I will be looking for a lawyer to assist with this.Business Response

Good afternoon,
We do not have any written documentation indicating that the resident provided notice of vacating the unit. On 08/21/2021, we spoke with the resident on a recorded line. During that conversation, the resident expressed uncertainty about his ability to pay the rent for the upcoming month. We informed him that if payment was not made, we would begin eviction proceedings. No payment was received, and as the resident remained in the unit, we proceeded with filing the eviction as per our lease agreement.
The resident is responsible for the rent for August and September as the court date for the eviction was scheduled for September, and at that time, the resident was still occupying the unit.
On 09/22/2021, the resident contacted us inquiring about a notice placed on his door stating that his belongings had been left behind in the unit and he was no longer occupying the unit. Upon inspection, we found the unit to contain the resident’s belongings and in an unclean state. As a result, the resident was charged for the trash-out and cleaning fees, which were necessary to restore the unit to a rentable condition. These charges are valid and remain on the account.
Regarding the pest issue, we took immediate action upon the resident’s initial notification. We arranged for pest control to spray the unit on 06/30/2020, and the pest control company successfully completed the treatment. There is a required waiting period between treatments, and the issue was never reported again following the initial spray. We are committed to addressing any pest concerns promptly and effectively.
We value our residents and are always willing to address concerns in a timely and fair manner. The charges and actions mentioned in this case are in line with our policies and procedures, and we stand by them.

For your reference, reasons for rejection are included below.Just look at the companies reviews and you’ll know they are a bunch of lying scammers. They routinely bill people for “damages” that never happen and use it to remodel their slum apartments. The fact it took them almost three years to respond to this says a lot about how they do business
