The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On February 28, 2024, Mark Benoit, doing business as Wood Specialties by Mark, entered into a consent judgment with the Office of the Sedgwick County District Attorney. The consent judgment settles allegations by the Consumer Protection Division (CPD) that Benoit violated the Kansas Consumer Protection Act (KCPA) by failing to provide a material benefit to a consumer when he failed to deliver and install cabinets for a kitchen remodeling project. The consumer entered into a contract with Benoit and paid for the materials and labor in advance. Under terms of the consent judgment, Benoit agreed to pay $22,400 in restitution to the consumer and will be on a 24-month probationary period with the CPD. He is also liable for $10,000 in civil penalties, along with additional investigative expenses and court costs. Future contracts will include proper notice of the three-day right to cancel the transaction for any door-to-door sales. The consent judgment includes an injunction from engaging in deceptive or unconscionable acts in the future. Benoit also agreed to cooperate with the investigation of any future complaints. The consent judgment was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
