    We started our kitchen re-facing contract with David **** at the end of January 2024. The project was projected to be completed within 8-10 weeks. After 4+ months of "working" and us trying to have him cancel the contract, it was decided to cut our losses. This left us with list of work and repairs that needed to be completed by other parties (and us), since Dave failed to do it or did it poorly: Crack cabinets doors; unpainted/uncaulked door fronts and shelves; poorly made glass cabinet doors which are still missing mullions; electrical outlets not installed or working; leaking sink; uneven hinges on cabinet fronts; poor installation of new cabinets; poor installation of new beverage fridge; did not pick up / dispose trash from project We were misled into believing that the cabinet fronts were being ordered from a reputable company. Instead, he was making them at home using cheap materials. The doors have holes, cracks and several imperfections that he tried to cover up with bondo. We are still trying to complete the project that Dave failed to finish.

    2/28/2024 - The contract was signed/agreed to in an email. The contractor requested to start per contract on 4/7/2024 - for a 3-5 day job. That week, excuses began: he would be delayed, he couldn't make it, the wood was not sanded or primed, and the work was not complete. Framing was torn out to add a built-in custom shelf, not completed. The contractor is not licensed but presented that he was. He is very slick about his ways and wording. I have requested a city inspection code and must pay someone to complete what he has not. Today is 5/8/2024, and 5/7/2024 was the last day I accepted any excuses from him. I do not want him back in my home. This man needs reported, his behavior is alarming.

    I was contacted online by **** ******** on 2/26/24 to provide an estimate to repair her railings. The location at the time of the request was ******** in Shawnee but after speaking with her I came to find the location to be **** ****** St. We came to an agreement on the contract and she placed a $1400 deposit. On about 3/22 ****** contacted me and informed me her lender required she pay the entire balance on the contract at that time. I accommodated that request.
    ****** ******* has used the name **** ******** when she initially requested service. She used the name ******* ***** when communicating via email. There was another request for service online at her address using a name ******* ******** This complaint has now come in from the same person using the name ****** *******.
    The newel post, railing, base plate and baluster work has been completed per the contract and photos are attached. There are some final trim screws necessary that were to be installed during the cabinet install. ****** was made aware of this my last day on site and reminded of this via text. Through her communication with me she has eluded to the material not being sanded or clear coated. Three coats of clear were applied with sanding in between. In the photos you can see the sheen from the final coat of clear. She knows this and this claim is not truthful. This work has been highlighted on the attached contract in yellow and is clearly defined with pricing.
    The cabinet insert for the closet had one design as described in the contract. ****** then provided a more elaborate drawing of what she wanted after the contract was signed. This included more shelving and a door. At an even later date the final and more elaborate design was sent. This design included three columns of “vase” shelving with multiple levels and a door. All of these have been attached as well. These changes all cause delays. I was attempting to set a date for install when she filed the complaint.
    ****** has complained about the delay in completing the project. There were multiple delays due to weather conditions. The weather during this project has been some of the most rainy in recent years. The material will spot if it is rained on prior to stain or clear coat. I was also cutting, drilling and sanding material outside as the garage wasn’t available.
    I’ve attempted to resolve this by either completing the cabinet install or refunding the amount paid for the cabinet. ****** is asking for a full refund of work that has been completed and photos provided. Her assertion that only a small portion of the work is complete is not truthful. These lies are hurtful to my business and I request this be dismissed.

    Hi ****. Please find attached my text messages with ****** regarding the install of the cabinet. These messages start before her complaint and span until after her complaint in a good faith effort to complete this project. 

    I attempted to schedule multiple different days but she would have none of them. I have offered to refund the portion of the contract that was unfinished because she wouldn’t schedule with me but she refused that as well. 

    She is clearly skilled in this type of transaction and believes refusing to allow me to finish entitles her to a full refund of work already complete. I disagree and have made every effort to rectify the situation fairly and timely.

    I'm very confused. The contractor only reached out for resolution, once I turned him into the BBB. I do not agree with this judgement at all. He offered resolution to a job that he never completed, after weeks of trying to get him to complete it. I tried resolving in April, and those emails and texts were provided. When he never completed the project, I had to take other options for resolution. This judgement is biased. I don't believe the details were read, and he has multiple small claims cases in Johnson County for the same situation. Unbelievable. However, this judgement will be part of discovery.
