      All Season Excavating & Landscape ( ******************************) * ************ owner ****** **** Auburn. KS has been in business since 2007. He had a television commercial that I saw and contacted him via the website regarding vegetation removal around my pond. Did a great job. I asked if he was able to reframe a metal pole barn by lowering the roof and replacing 2x4s. He agreed and settled on $10,000. This occurred on Friday August 16th @ 12:45pm. In good faith, a deposit was given. There was only a verbal agreement. While the crew was here finishing the pond with their bobcats, I asked to have an arbor torn down next to the pole barn, done. The only problem, the structure is now in a heap of metal/boards of rubble. ****** said he would bring a dumpster. August 26th, September 10th, 11th and 13th, I have asked for a schedule date. Materials (metal sheeting & lumber) were delivered on August 20th & 28th. Cost unknown. September 11th, I sent a text message to ****** (his address unknown) regarding a Demand Refund Notice in full for $10,000 deposit for NOT providing services as agreed upon. He called me back, saying his communication skills could be better and would come on Tuesday/Wednesday September 17th/18th. I agreed to put a hold my refund request. It is now Tuesday and no workers nor communication with Jeremy. I showed him good faith by paying a deposit for his commitment to provide services. Yet, I have not received back any respect with this transaction. My request is a full refund of $10,000. The materials can be picked up and he can return them to ******* for a refund. Thanks for your assistance in this matter.

      Customer prepaid for labor/materials on August 16th because she said she wasn't around much. She was told it might be early fall before we could get to that particular job. She said to get around to it whenever we could. Customer was since spoken to a few weeks ago informing her that the job would be done within the next coming week. A lot of rain made it not the ideal of conditions for the project that week. She was still on the schedule. Customer is now demanding money back after materials were already purchased with her consent. Cost was for labor and materials. Materials cannot be refunded.

      I am rejecting this response because: The 1st sentence is invalid and a lie.  I am always at home.  It only rained one day during the work week.  Yes, it was hot.  Materials were delivered on August 20th and 28th.  I have no need for the materials since I am not a carpenter.  They can be taken back to the store for a refund.  

      I asked several times for a schedule with no reply, always evasive.  I no longer have trust in his character.  This can be settled with a full refund since no services were provide after 6 weeks of a $10,000 deposit.

      Attached is the past precipitation reports for the area. It rained a heavy amount towards the end of August. As in previous attachment, the text exchange shows that when attempting to finish the job, *** ********* told us to reschedule because she wasn't home. Attached is also the phone exchanges taking place on 9/11, 9/13, and 9/19. *** ********* was told we would be arriving within the next day after she canceled with us. Again, (see attachments) heavy rain took place on the 17th and 18th. Even if it isn't raining on a particular day, the ground still has to dry out in order to operate certain machinery for safety reasons. Shortly after, we received the letter from the BBB. The client has clearly been contacted, and clearly the weather has been wet at times. As stated before, the materials are on her property. They are now hers to do with what she likes since she no longer requests labor done. She had been told she can be refunded for the labor if she has chosen to cancel. We have provided documents of weather and phone exchanges and a solution; please stop with the harassing letters.  Thank you.

      I am rejecting this response because: I have secured an attorney for my consumer legal rights due to contractor failure to schedule a date to perform work within a reasonable timeframe.  A deposit of $10,000 cash was given on August 16th.  Materials delivered on August 19th and August 28th.  After 2 requests for a start date, none was received.  I text a Demand notice for a full refund on August 11th but was ignored.  I have sought the mediation of the BBB but remained unresolved.  It is now 9 weeks later thus have secured attorney.  Thanks, BBB, for your assistance.  This case can be closed.

      All Seasons was hired to complete four excavating/landscaping projects. Estimate states three days and $18,000 to complete. A 5th project was added on-site, bringing estimate total to $25,000 and extending time frame. Unhappy with quality of work, homeowners terminated All Seasons after two days and 2.1 of the 5 projects complete. Homeowners paid separate contractor $700 to remove soil, roots, grass All Seasons placed in the hole and $300 to uncover a water line All Seasons buried. Homeowners also paid $3,600 in materials for the 5th project.

      All Seasons demanding $16,735. Verbal threats against personal property made. Upon hearing recorded threats, *********** County sheriff's department felt warranted to sent sheriff to oversee equipment removal.

      Home owners have offered several settlement options to All Seasons. All denied.

      The ******* contacted All Seasons for foundation work. They were given an "ESTIMATE" of $18,000 to complete the job. As of all contract jobs, an exact amount cannot be determined due to fuel charges, time, unexpected  fixes, etc. They were told it would take approximately 3 days to complete. Upon arrival our crew discovered that not enough backfill from previous contractor was done. We told them we could do that for them to correct it and add it to the previous estimate. They said okay. *** ****** purchased the gravel himself and had it brought to the site. *** ****** was also told to box in his water line to ensure it wouldn't get buried by the time our crew came back. Due to his noncompliance the line got buried. The original estimate for $18,000 WAS including fuel. The itemized bill was just breaking it down to show where the costs were. The ******* got a discount on labor.  A day consists of 8 hours. Our crew had 12 hour days. When the ******* realized their bill was adding up, they wanted to stop where they were because we weren't finished even though they agreed to the extra correction of the previous contractor. When they said they couldn't afford any more, our crew put the remaining topsoil on top of the clay and AB3 that was laid down. The photo the ******* provided was a pile of dirt that was there previous to our crew even arriving. The topsoil is supposed to go on top, which the clients were aware of. The ******* were informed that our work there was done after they started complaining and nearing their budget. No threats were made. Only statement made was that we were retrieving our machines or any unpaid unused materials. Even the officer that arrived stated how ridiculous their claims were. Our crew politely left, and the bill for $16,735 was given to them. Their bank is aware of the work done, and they paid us for the work done. The ******* are unhappy that construction can sometimes end up costing more than originally anticipated. That is why "ESTIMATES" are given. Our invoice was not far off. According to the other businesses working with the *******, they have also found them impossible to please and want extensive work done for cut-corner costs.
