      Just reviewed credit report and this company is identified and indicating that I owe 159- never done any business with Helvey & Associates - reviewed other complaints about this company and they are placing collections against **** customers. Additionally, **** has not notified me that I owe any past amounts for any accounts that I had previously opened with them. **** also be contacting them regarding this issue.

      Thank you for notifying ********** about this matter. Please be advised this communication is from a debt collector.

      We have reviewed and considered all information provided by you and completed a reasonable investigation. Additionally, we requested the original creditor complete an internal investigation to verify the personally identifiable information on file for you and the details that led to the placement of the account with **********, and to obtain documentation that would substantiate the collection account to you. 

      Per the original creditors policies and/or procedures involving termination of utility service, it is the responsibility of a residential customer to request termination of utility service directly with the original creditor and provide a forwarding address for the final bill. However,a forwarding address was not provided and the original creditor mailed the final bill to the last known billing address on file for you.

      The original creditor has assigned a total of five (5)accounts to ********** for collection with you as the responsible party for the accounts. These accounts were assigned on the following dates 08/28/2020,05/03/2021, 05/12/2022, 09/30/2022, and 10/12/2022 and we had prior interactions with you. However, the account in question and the premise of your complaint was the only account that was reported to your credit.  

      As a result of this final bill remaining unpaid, the original creditor assigned the account in question to ********** for collection on 09/30/2022. In addition to the final bill from the original creditor, ********** mailed a notice to you, on 10/05/2022, to the last known billing address for you. This letter advised you that the account was placed with ********** for collection, and identified the original creditor, balance due, and account number for the services rendered. This notice also stated that unless you notify ********** within 30 days of receiving that notice that you dispute the validity of the debt or any portion thereof, ********** would assume the debt is valid.
      ********** mailed a second notice to you at the same address, on 11/09/2022, which provided you with notice of our intent to report the account to your credit.  ******* communications mailed to you were not returned and assumed to be received by you, nor did we receive any notification from the National Change of Address database. We did not receive a response from you and the account was subsequently reported to the ****************************

      To date, you have paid four (4) of the accounts in full. You paid the first account in full directly to the original creditor and called **********, on 11/09/2020, to provide the confirmation number for the payment. You paid the other three (3) accounts in full to ********** over the phone on 01/23/2023.
      The fifth account previously mentioned, assigned on 05/03/2021, was canceled from our system per the original creditors request on 07/09/2021.

      As the representative explained to you during the 01/23/2023 phone call, ********** will report your account as paid in full to the **************************** We are obligated, at a regulatory and contractual level, to report accurate information, thus, it is not within our discretionary control to delete a credit tradeline that has been accurately reported. The ********************************** (CDIA) has specific requirements for collection agencies which include the requirement that paid-in-full collection accounts remain on the credit file and not be deleted.

      Should you have additional information or documentation for us to consider, we will be happy to review it. Otherwise, the account will remain paid in full and disputed and will be reflected on your credit file accordingly.

      Upon seeing my credit report, it pays my attention that the following accounts are inaccurate and fraudulent. I am a consumer by law. I am not happy about it what I saw.       Thank you for notifying ********** about this matter. Please be advised this communication is from a debt collector.

      We have reviewed and considered all information provided by you and completed a reasonable investigation. Additionally, we requested the original creditor complete an investigation and verify the personally identifiable information on file. As a result of the investigation, we regret to inform you that we are unable to fulfill the request to have the account in question deleted from the consumer reporting agency's files to which we have submitted information. We are obligated, at a regulatory and contractual level,to report accurate information, thus, it is not within our discretionary control to delete a credit tradeline that is accurately reporting.

      The account is for utility services rendered to you at the same address you provided in your complaint. This service was established on 05/19/2021 per your online request and disconnected, on 07/08/2022, per your online request to the original creditor at which point you provided a forwarding address.  However, you called the original creditor and requested to change the disconnect date to 07/11/2022. The original creditor emailed the final bill to you at ***************** on 07/13/2022 at 3:54 p.m. since you had previously signed up for e-billing on 10/13/2021. As a result of this final bill (copy enclosed) remaining unpaid, the original creditor assigned the account in question to ********** for collection. In addition to the final bill from the original creditor, ********** mailed a notice to you, on 10/03/2022, to the forwarding address you provided the original creditor. This letter advised you that the account was placed with ********** for collection, and identified the original creditor, balance due, and account number for the services rendered. This notice also provided you with options to dispute the debt and stated that unless you notified ********** after receiving the notice that you dispute the validity of the debt or any portion thereof,********** would assume the debt is valid and our information was correct.
      ********** mailed a second notice to you at the same address, on 11/07/2022, which provided you with notice of our intent to report the account to your credit.  ******* communications mailed to you were not returned and assumed to be received by you, nor did we receive any notification from the National Change of Address database. We did not receive a response from you and the account was subsequently reported to the ****************************

      As previously stated, based on our investigation, it is our position we have identified you as the correct consumer for this account.Because there is no evidence of an error or inaccurate information, at this time, we believe we have reported all information accurately as required by data furnishers and fulfilled our obligation as required by the law to investigate your dispute based on the information that you provided to date. The results of our investigation will be mailed to you and will include the necessary information to substantiate the collection account appearing on your credit file.

      Should you have additional information or documentation for us to consider, we will be happy to review it. Otherwise, the account will remain active, owing, and disputed and will be reflected on your credit file accordingly.

       I am rejecting this response because:

      I viewed my credit report and noticed that there are fraudulent accounts. This was not sent in error. I am a consumer by law. Here are the details of the said inaccurate accounts, company name, balance & date last reported: Account Name HELVEY ASSOC Balance $1,677.00 Account Number *******

      Thank you for your additional communication on this matter. Please be advised this communication is from a debt collector.

      The correspondence and message that you submitted with your original complaint and with your rejection does not contain any new information that would prompt another investigation of your complaint. Our original response to your complaint included verification of the account in question which verified the service address for the account in question. Your correspondence to the *************************** and the BBB listed the same service address as your current address. Furthermore, the original creditor emailed the final bill to you at the same email address you are utilizing in your complaint and other communications. We have enclosed a copy of the original creditors final bill which validates you are the responsible party for the account.

      While your complaint included your Identity Theft Report, it did not include any other details, evidence, or documentation to substantiate your identity theft claim. This documentation should provide and substantiate your place of residency during the time the past-due balance was incurred, an attestation verifying that you did not live at the service address nor did you authorize the service to be connected in your name for another individual, a court order,account statements, and/or other documentation that would establish that this account is not yours. In the interim and/or absent the receipt of such documentation from you, the account will remain active, owing, and disputed and will be reflected on your credit file accordingly.
      Again, we are obligated, at a regulatory and contractual level, to report accurate information. Because there is no evidence of an error or inaccurate information, based on the documentation you have submitted to date, we believe we have reported all information accurately as required by data furnishers and have fulfilled our obligation as required by the law to investigate your dispute and substantiate the collection account by providing proper verification of the debt.

      We regret we have been unable to resolve your complaint and fulfill your request to have the collection account deleted from your credit file, and look forward to working with you and helping you achieve a positive solution in resolving the delinquent account.

      I am not liable for this debt with HELVEY AND ASSOCIATES and i do not have a contract with HELVEY AND ASSOCIATES . They were not able to provide me with the verifiable proof of any contract with my signature on it like i asked. this was a account from duke in which it was sent to collection as closed with zero dollars. their failure to positively verify the account has hurt my ability to obtain credit.

      We have reviewed and considered all information provided by you and completed a reasonable investigation, and requested the original creditor complete an investigation. As a result of the investigations, we regret to inform you that we are unable to fulfill the request to have the account in question deleted from the consumer reporting agency's files to which we have submitted information. We are obligated, at a regulatory and contractual level, to report accurate information, thus, it is not within our discretionary control to delete a credit tradeline that has been accurately reported. The ********************************** (CDIA) has specific requirements for collection agencies which includes the requirement that paid in full collection accounts remain on the credit file and not be deleted.

      The account in question is the final bill for utility services that was disconnected on 07/27/2020. The original creditor sent you the final bill to the forwarding address you provided to them on 07/14/2020; however, as a result of the final bill for utility services remaining unpaid the original creditor assigned the account in question to our agency for collection. In addition to the final bill from the original creditor, our agency mailed a validation notice to you on 01/18/2021 to the forwarding address for you as provided by the original creditor. This letter advised you that the account was placed with our agency for collection, identified the original creditor,balance due, corresponding service address, and account number for the services rendered. This notice also stated that unless you notify our agency within 30 days after receiving that notice that you dispute the validity of the debt or any portion thereof, our agency would assume the debt is valid. Our agency mailed a second notice to you at the same address, on 02/19/2021, which provided you with notice of our intent to report the account to your credit.  Written communications mailed to you were not returned and assumed to be received by you,nor did we receive any notification from the National Change of Address database. We did not receive a response from you and the account was subsequently reported to the credit bureaus in March 2021.

      On 06/16/2021,the original creditor advised that you paid the account in full directly to their organization. As a result, we updated your credit file to reflect that the account was paid in full.

      To date, you have not contacted our agency, directly, to request any details or information surrounding the account in question. However,we have received, investigated and responded to indirect dispute notifications from the *************************** for which we ensured the account was accurately reporting as paid in full and disputed.
      Enclosed you will find verification of the account in question as required by law which will also be mailed to the address you provided in your complaint.

      Based on our investigations, it is our position that we have identified you are the correct consumer for this account and are reporting accurate information by furnishing all information required of collection agencies and reporting your account as paid in full and disputed. Should you have additional information or documentation for us to consider, we will be happy to review it. Otherwise, the account will remain paid in full and disputed and will be reflected on your credit file accordingly.

      We regret that we were unable to resolve your complaint and hope you understand our business position. Thank you, again, for contacting our agency.
