in late Oct of 2023, ***** ****** of Sun's Out Solar came out to discuss solar panel options for the property where we live. The property isn't in mine or my wife's name. Upon discussing everything, it was stated that we had to be on the deed to the property in order to receive the financing for the project. I had explained that neither of us were on the property and that it was in my mother's name. He stated that one of us need to be on the deed. i said that I would speak with my mother, but it was highly unlikely that I would be able to be on the deed. He encouraged me to go ahead and fill out the paperwork, so I did so. He stated that I had 3 days to cancel, and that it was dependent on me being on the deed. I had explained that I doubted that I could be added to the deed. It was stated before he left on our front porch that if he didn't hear from me about being on the deed, that it would cancel, because one of us has to be on the deed. So of course I wasn't able to be placed on the deed. Then somehow they bypassed this provision without letting me know that they had done so. Then on Nov 4, 2023 he sent me a text that I somehow missed stating that they were going ahead with the project, again with no verbal conversation through voice. Then at the beginning of Dec 2023, I receive a call from their project manager telling me I need to schedule the install. I proceeded to argue with the project manager that I thought this matter was over because ***** stated that we had to be on the deed. Then spoke with ***** about it and he said that they found a way around it. He has then tried to setup installment several times after this. I told him that we no longer wanted the system after doing some checking and that I didn't like their deceptive business practice of stating one thing and then finding a way to circumvent it and not verbal notify me of the situation. Now they want me to install or pay a restocking fee. This should be an illegal practice.Business response

The following was written by ***** ****** who was the Sales Representative who sold the Solar System to Mr. ******:
**** ****** story here only has half truths and it's been modified to benefit him. I told him that if the stipulation wasn't cleared from ******** and if it sat stagnate then that credit would expire meaning we couldn't go forward with lending. He asked me what the stipulation was and I told him it was a owner verification stipulation. ******** needs the following valid and current documents;
First mortgage payment letter OR mortgage statement showing the applicant’s name and property address
Current tax bill showing the applicant’s name and parcel number
Recorded deed (all pages)
Mortgage Note
Closing Disclosure
Settlement Statement
If the property is held in a Trust, provide the Certification of Trust
If the property is owned by an LLC, Corporation, or Company please provide either the Articles of Incorporation or K-1 (from the business returns) showing ownership percentage
******** will look to see if this is visible on public record. If any of these requirements are met then they will release the stipulation. I did nothing to clear this. ******** cleared this on their own. I did tell him that the credit he has with ******** has an expiration date. If all stipulations and installation are not taking care of prior to the expiration date, then the current ******** finance documents that he signed would be invalid and he would have to reapply with ********. Also, I never stated that if I did not hear back from **** ****** about being on the deed than the deal would be canceled. As a matter of fact he asked me how to cancel the transaction if needed .
I then showed him the cancellation section on the contract and went over it with him. He reconfirmed what he needed to do according to the cancelation section on the contract to cancel if it came down to that. I confirmed that he had to follow the steps provided on the contract and do that by the three day right to rescind date. He then confirmed that date with me on the contract. Eighteen days after signing up I tried to call **** ****** and also sent him a text that we had the engineering stamp and the next step was permitting. Also, when I did speak with him and told him I made several attempts to communicate with him he acknowledged that and just said that he has been busy. **** is very aware of how to cancel and what steps where necessary to do so. I have all phone and email records in terms of communication as well.
