I bought a vehicle from momax .They were deceitful from day one.They changed price of vehicle in contract ,more than posted price online .They gave a short warranty which they refused to honor,and lied about condition of vehicle .The vehicle started having electrical failure and other issues from day one.I offered to bring vehicle back next day ,let them keep my down payment and just give me my trade in vehicle back,which they refused.I took the vehicle to several mechanics and the refused to work on the vehicle because they stated it was a hazard to my family and anyone on the road ,that it was dangerously wired and pieced together.Finally ***** dealership worked on it but it cost me ****** dollars to get in working order,and was in dealership for almost a year off and on.on october 5th 2023 ,they took my vehicle while I was home and told them they couldn't. I Was less than 2 months behind and told repo men thatvi would call make payment ,to not take my vehicle.They took my vehicle despite,and said i would have to call dealership next day to speak with ****** ( manager/ owner ) to get amount owed to retrieve vehicle .The same day i called and called and got the run around .The dealership is over 2 hours away from where i live,so i couldnt just go there,especially since they took my vehicle.my family and i have suffered without transportation since they took my car, ****** (owner of momax)put my personal information( screenshot of computer screen with all my pe4sonal info) in a ************** i never was able to speak to anyone at Momax about the price it would cost to get my car back, and that even today i still have no idea what happened with my vehicle as Momax never responded. I tried several times to work with Momax to come up with a reasonable solution, but they never responded to ME. I have an audio recording of an employee saying that my car had been sold less than a week after repossession date and have proof of everythingBusiness Response

After reviewing your file, we would like to clarify the following:
You purchased your vehicle through Momax Auto Sales, and at the time of purchase, a powertrain warranty was included. Approximately five to six months later, you contacted the dealership reporting issues with the vehicle. During that call, you requested to return the truck and have your trade-in vehicle returned; however, the trade-in had already been sold. You were advised at that time to file a claim through the warranty provided. No further communication was received from you following that advice.
This was a buy here, pay here transaction, and unfortunately, multiple missed payments led to the vehicle being repossessed. After the repossession, you contacted us to inquire about reclaiming the vehicle and were informed that the full balance would need to be paid, and that you had 10 days to do so in accordance with applicable laws. You asked for an extension of 15 days, which we honored. However, no payment or follow-up was received during that extended period. As a result, the vehicle was prepared and returned to our inventory for sale.
At no point did Momax Auto Sales act improperly or outside of legal or contractual obligations. We also responded to the complaint filed with the state, providing all necessary documentation, and the case was formally closed.

This carlot repoed my truck saying I still owed taxes, but my car has been paid off for 6 months. They wont give me a copy of charges for the tow when they repoed but charged me $3500 for fees or said theyd sell my truck.Business Response

Also, for the record this truck was repoed once before. ******************** knew exactly his total balance and past due balance. On 02/23/24 at approximately 1030 am I went to Momax Auto Sales to purchase a vehicle. My initial contact was with *********************. I provided him with the vehicle I was interested in and asked if we can work on financing before i test drove the car, so we did. I provided ****** with my current pay stub and the last stub from 12/2023 and my license. We sat and talked for about ****** then ****** said we was good I could go ahead and get auto insurance. I provided him with the copy of my auto insurance. He told me I could test drive the car while he finished up on his end with the financing and I did. When I came back, he had the contract pulled up on the computer for us to sign. He went over the contract told me United Auto is my financing company. I paid my down payment to a ********************* cash tag name because he said to pay with a card they charge a fee and it was easier to cash app. That day I left with the vehicle. Saturday morning 02-24-2024 the bank called me and said they needed me to provide them with my bank information. I informed them that I was not comfortable doing that and asked what was the reason. They told me to get financed. I informed them that I was told by the car dealership that I was already financed and that was the only time I heard from the bank. Monday morning 02-26-2024 I called the car dealership to ask ****** what was going because he told me I was already financed those were his words! ****** told me he would give me a call back and see what was going on with the bank. He called me back screaming and threatening to take my pay stubs to my job and that he was going to call the police on me for Bank fraud. He also told me to bring the car back and if it was in good condition then he will provide me with a refund. When I got to the car dealership they blocked the car in with multiple cars and the owner ********************* refused to give me my down payment back although they took the car. ****** also told me he was going to *** me for my paystubs unless I had a cosigner to go on the application and more money down. i asked him to refund me my deposit again because in the contract it states the buyer and seller can cancel the contract within 5 days if the seller cannot assign the contract under its original terms which I was told I was already financed before I left the lot on Friday and the bank approved everything. ****** also told me the deal was cancelled and I would receive a refund and in the contract it says the buyer has two days to return the vehicle and a refund shall be given. Also ****** was in the office on the phone with what I thought was the police saying "its a black girl, its a tall black girl" but when i went to the police station to file a complaint they said it was no record of him calling. I just want my down payment back. I am a single mother in ************** trying to provide the best life for my kids and for a business like this to just come and do whatever they want to do is not right. And I investigated and found out this is something they do they have several court cases of civilians suing them for multiple fraud things it is not right, and they need to be shut down. I also have a LPD event number and officer name that I can provide if needed.Business Response

We are writing in response to the complaint regarding Ms. ********* *****. When Ms. ***** applied for a car loan at our dealership, she provided documentation that initially met the requirements of the finance company. Based on the documentation she submitted, she was allowed to take possession of the vehicle.
The very next day, however, the dealership was notified that the pay stubs she submitted were fraudulent. Upon learning this, ****** promptly contacted Ms. ***** to address the issue. Although she agreed to come in, she did not return until three weeks later.
When Ms. ***** arrived, several employees positioned couple cars near the vehicle to prevent her from leaving with it until the matter was resolved. Unfortunately, the situation escalated, and due to her yelling and threatening behavior toward the manager, we were compelled to contact the police and file a report.
Enclosed, please find copies of the documents related to the charges for the car key she initially refused to surrender and fees for the mileage accrued during the three weeks she used the vehicle. Also copies of responses to the complaints she also filed with the state.

They sold me a car with undisclosed frame damage, three weeks later they called said that they need the car back due to banks not approving loans because of the structural damage to the car. They said I would get a refund for the amount of what I had previously put down. I called to check on the refund due to it being a week later and they said I wouldn't receive my refund.Business Response

Thank you for reaching out to us with your concerns. We want to clarify the situation regarding the vehicle you purchased from Momax Auto Sales.
The vehicle in question did not have any frame damage. However, it did exceed the mechanical remarks set by the **************. As the vehicle was bank-financed, the bank discovered this remark about a week after the transaction and, as a result, canceled the financing.
We promptly contacted you to inform you of the situation and offered assistance in securing financing through another bank. However, this option required a higher down payment. We understand you were unable to visit the dealership immediately, and when you did come in a couple of weeks later, you mentioned you didnt have additional funds available. Unfortunately, due to credit and income limitations, we had no further financing options to offer.
After the vehicle was repossessed, it was noted that the vehicle had been driven approximately ***** miles and had a strong odor of marijuana. The charges for the extra mileage and detailing fees exhausted any remaining credit on your account.
