    We signed a contract to build a house with *********. In the last 15 months, we have had a multitude of issues; however, this complaint is specifically re: to our closing date. We received our closing date from the ************* and ** on Mar 6th, 25, which was set for Mar 26th, 25. On Mar 11th, that date was rescheduled to Mar 31st, 25. Through the month of March, we had no communication from ** indicating we would have any MAJOR delays that could significantly impact our closing ******* good faith, we 1) coordinated the closing of our home; our buyers did the same with their home, 2) locked our rate for 30 days which would give us a 2-week buffer in case of MINOR delays, 3) coordinated our move for that weekend.On Wed, Mar 19th we had a call with our PM to discuss timelines and ensure we were still tracking to the Mar 31st closing date. He mentioned they were still waiting on CenterPoint and that those delays were out of their control and solely CenterPoint's "fault". He told us he had tried to contact CenterPoint multiple times and could not get a hold of them to check on a timeline. Unhappy with his answers, we called CenterPoint ourselves. We found out ** did not submit our gas application until Mar 5th. The lead time for getting gas on site is 6-8 weeks so looking at the week of Apr 22nd for install. Our realtor has been in contact with **'s sales *** DAILY, since we were blindsided by them late last week, to get an updated closing date and compensation to cover the costs we will be forced to incur due to DH's negligence and lack of transparency. Yesterday, they communicated a new closing date of **MAY 2ND** but have not said a word about compensating us for the ~$7k we're about to incur between temporary living, storage, moving expenses + TBD possible rate increases. We have ONE option left for housing for us and our 3 dogs on ****** that could get booked at any time now (and would cost us over $5k); otherwise, we will be HOMELESS in 5 days.

We will be looking to close on 4/11 pending final inspections. This closing date will avoid a rate increase as mentioned and cut down significantly on the extra expenses noted previously.

    Before we moved out of our previous home, we provided Davis Homes with an ESTIMATE, as requested by them, of what we would most likely incur in expenses as a result of their dishonesty and poor business practices. We ended up spending an additional $550 in expenses that we could not have possibly predicted until we actually moved out of our house on March 31st, such as 1) having to rent an additional storage unit for our furniture and things, 2) upgrade the original storage unit to a larger unit, 3) additional mileage on the moving truck, 4) and pet fees for our temporary home that had not been included by the landlord in our initial estimate. We had to cover those costs out of OUR POCKET because Davis Homes refuses to do the right thing and reimburse us for the total amount we actually incurred DUE TO THEIR OWN MISTAKE. Now they are ******* to finish and close on our house by 4/11 - as they mentioned in their response to my initial complaint - sacrificing quality of workmanship, because they don't want to incur the costs of our rate lock extension. They scheduled a final inspection with the city despite us asking them to hold off until they were further along with the interior and exterior finishes. We also asked them to move our closing date to 4/18 to give the construction team enough time to properly finish our home, and as always, we received no response at all from their non-customer focused and tone-deaf management team. To no surprise, they failed that inspection today by a mile and will have to schedule a re-inspection. Doing business with these people is like doing business with a rock. I don't know how they've been able to survive in business for as long as they have, it is embarrassing.

    I've been trying to get Davis Homes to put in the missing honeycomb weep holes in the brick veneer of my house since May 30th of 2024. The missing weep holes is a building code violation and as such not covered under the Davis Homes 2/10 warranty. Would appreciate it if you can get them to do something about it. If not I will take them to court. If a home inspector notices that there are no web holes I would be forced to pay to have them put in prior to putting my house up for sale.

    We spoke with a sales rep and entered into a contract. Well that's when things changed. The #s he was giving vs the loan person were very different. No one could seem to give us an exact down payment amount/house payment amount. We kept being told it would be 30-45days before closing. To us that is a big deal not knowing if we needed 10k or 13k or if the house payment was 2500 or 3000. We submitted a mutual release form and have asked for a refund of what we have put down due to the inconsistency. Once it was submitted the sales rep became rude when before he was so nice and welcoming. I'm sure because we backed up that's why but being inconsistent on what your telling people especially ones that have never done it before isn't alright. I can't get a hold of anyone to know if the release has been accepted or if we will get a refund. I would like some communication on what is happening.

    When we chose to build on our lot with Davis Homes in May 2023, I (as a single Mom) trusted Davis to deliver not only a well-built, beautiful home... but to do so in a safe, conscientious manner. Unfortunately, that did not happen.In March 2024, as the build was coming to a close, the final electrical work inside the house was happening in a haphazard, dangerous manner. It turns out Davis Homes began the electrical work weeks before actually pulling a permit and then used a contractor that does not actually employ a licensed electrician. Despite numerous conversations, requests, emails and texts to everyone from our construction supervisor all the way up to the President of the company, the electrical in our new home was not done safely, nor was it overseen or even checked by a licensed electrician. Davis Homes was content with the minimum required inspections by the city. Desperate to know our home would be safe, I brought in a licensed, master electrician and also a certified home inspector to inspect (and re-inspect) the electrical and the entire home. Their reports confirmed that the electrical was not done correctly, and my anxiety increased. At this point I was afraid of the random men working on electrical in the house, and when I expressed my fear the construction supervisor shrugged off my concerns. As it turns out, that construction supervisor was in fact a convicted felon (armed robbery), another source of anxiety for me. Each time an electrical issue was brought to them, Davis' response was to bring in the same unlicensed contractor who had created the problem. The electrical was not the only issue we had to deal with - the workmanship in several areas was simply shoddy. However, the dangers of the electrical were my biggest concern. I brought in a licensed, master electrician to inspect, re-inspect and repair the issues. The total costs to me to correct everything exceeded $5,000 and I would like Davis Homes to reimburse me.

    The homeowner expressed concerns during the build which were addressed and corrected by our own contractor that is in contract with us. She also expressed nothing but satisfaction via email communication with her project manager about "turning things around for her". Since closing, she has blocked or ignored any communication from Davis Homes. We passed our city inspections which are to BAGI standards as stated in the purchase agreement. We will not be reimbursing the homeowner for money spent on private inspections since our contractors made repairs during construction.

It is no surprise that Davis would disregard the fact that at no time was a licensed electrician involved with our home build.  Their lack of concern over the sloppy electrical work was evident for the last month of construction, and their unwillingness to bring in a licensed electrician to first inspect the work done, and then repair the issues was notable.  The contention that somehow having the same unlicensed electrician repair the shoddy work he had done would "resolve" our issue is illogical. When I brought in a licensed electrician as well as a home inspector, both agreed in writing that the electrical issues were rampant.  Upon discovering that our construction supervisor, the second one to handle our home, was a convicted felon we became so uncomfortable that we simply completed the closing documents and took possession of our home.  Davis Homes should have been horrified that they had hired an unlicensed electrician to work on our home, and they should have notified us of the supervisor's previous record and asked if we were comfortable with him being involved in our home build.  The response they've given to our complaint, taking zero responsibility for any of the electrical issues and insisting the build was "to code" simply shows any prospective customers how little ********************** cares about customer satisfaction.  At the very least they should reimburse us for the costs we undertook to make certain the home was safe.

    I bought a brand-new build from Davis Homes on 07/01/2022. They guarantee their work and advise that work defects are covered under a warranty. There is a noticeable dip in my bedroom floor. The concrete slab under the carpet is not even. It was pointed out at the 60 day walk through. The Davis Homes employee advised there was likely something screwed into the concrete that when removed caused the dip/hole in the concrete. It should have been fixed before the carpet was installed. I was told this is a big fix that requires moving the furniture out and pulling up the carpet. This will wear the carpet in one area over time. I was advised to wait until the 1 year walk through to fix it in the summer. I submitted a ticket to the warranty company for all items. They fixed all but the floor. During the walk through I was told to move my bedroom furniture and then it would not be noticeable. I confirmed again this was a workmanship defect and I want it fixed. Davis Homes then reported all items repaired to warranty company and my ticket was closed. I reopened and was advised I would be contacted in ******************************************************************************************* After the horrible closing experience where Davis Homes demanded more money or they would cancel my sales contract despite the contract saying the price was fixed and could not be change, this is extremely concerning. They are not sticking to their warranty

    We have not received fixes to problems listed on our **** warranty. They were coming and doing work up until about 4-5 months ago. Then they never returned. We are now past the 10 month **** with nobody from Davis Homes returning attempts to contact.

    We received an email from ******************************* on 1/7/24 at 9pm to which we replied on 1/8/24 at ****am. We received no follow up email from ********************. Then, a new warranty request was submitted on 1/12 to which we sent a notification email to the electrical contractor and have had no response. After the warranty request was submitted, we received an email from ********************************** as a reply from an email thread from 2/27/23 to **** (no longer employed at Davis) and Jan requesting communication. We replied the same day asking for photos and details of her issues and the response we received from ********************* was "I'm not doing double the work". We then followed up with her on a second email reply on 1/15 and said it would be discussed at our weekly meeting on 1/18. It was discussed and one of our warranty team members attempted to contact the Turnbells and was unsuccessful.

    We have been waiting for these items to be complete for over a year now since the close of our home in January 2023. We had a walk through on January 30, 2024 and were told contractors would be scheduled and out at the house soon to complete the work. It has been 3 months and nothing has been done. No contractors have contacted us to even schedule work. The last communication we had with Davis homes was on April 15th and it just said they are working on it. Nothing is being done.

    Nothing has happened. We havent had any contractors contact us to finish the work. Davis has not set up any appointments with contractors to come to our house and finish the work. We provided everything they asked for in the Warranty portal back in January and even the **************** is reaching out on our behalf to no avail. Davis is not a company I recommend to anyone building a home. We had nothing but problems our entire build process.

    The response states "We have attempted to send our Davis team out to their home and with no success in that visit" This is an absolute lie. The last time anyone was here was a scheduled visit on January 30th. A walkthrough was done on that date and the 2-10 warranty items were discussed. We were told the next steps would be contractors getting in touch with us to complete work. No contractors have contacted us. We even asked for the contractors phone numbers so WE could make the calls and set up the appointments since Davis is doing nothing. They have not made any attempt to setup another meeting or walkthrough in our home.

    Delays, delays, delays with no course of action to make up ground. First delay was due to "Saturated soil conditions" when it hadn't rained in at least a month, but excavation could start a couple of days after a heavy rainfall. We were told HVAC would start 7/10...I guess 8/4 is close...not a word of communication was provided regarding why they were late. HVAC, plumbing and electrical rough-in was finally completed in early September. Asked ** when insulation would be installed on a Friday since it was on site...crickets...luckily I was able to let him know it appeared to be complete the following Tuesday so it could be inspected. Drywall was installed - we reached out to ** regarding roof penetrations since drywall was in and rain was in the forecast...crickets again. Drywall was finished on a Thursday and there was no communication from ** as to when paint would get there. We were finally given a schedule a week later that paint would be there on Friday and cabinets installed on Monday...paint was actually there, but shocking, cabinets were not installed as promised. Did anyone care to let us know they wouldn't be there? Of course not. Delay after delay after delay without a care in the world to make up ground. Finally we were able to talk to VP of operations who tried to act like he wanted to get the house completed in a timely manner, but nothing has yet been done to prove they actually care. The sales team has been great to work with, however the project management team needs to take a few courses in how to properly manage a project. The most amusing thing we were told is that we were "on schedule" for the completion and that drywall was "ahead of schedule", so the painters didn't know the house was ready for them. Shouldn't the ** know this and communicate with the trades? Lack of communication has been the downfall for this project.

    If you do not have the time to be on the job site making sure things get completed per the scope of work this is not the builder for you. Started this process Sept. 2021, it is now August 2023. They showed up on day one with the wrong house plans. Have been through 3 project managers. Had to initiate coordination with the regional project manager, area project manager, project manager at the time, and VP sales rep for an on-site visit to discuss ALL the issues back in April 2023. Still have those same problems with no resolutions or answers. Months will go by with no subcontractors showing up to do work. Drinking alcohol on the job site. (Pictures can be provided). This may be another reason for the ***************** framing plans, faulty work, corners cut short, damage to the concrete patio, cedar posts, front door, garage doors, garage entry, windows, window ***** cut short, etc. WE personally had to bring in over $3000 worth of fill dirt since they did not plan for the land contour to meet code. The house still is not fully bricked or painted 8/7/23. Installed flooring that did not match their samples. The list truly goes on and on. They have not figured out the custom home build on your lot. It is not what you will get. Took months to get a roof and windows installed. We have black windows that are warped/damaged and still have melted adhesive tape on them to this day 8/7/2023. Spray paint from attempted cover *** on the windows. Shingled the roof then over-sprayed the roof and black ***** drip edge, then tried to cover it up by spray painting the roof shingles with black satin spray paint. They forgot we had a chimney after the fact the roof was shingled. Kitchen cabinet crown molding is a different color white than cabinets. We know there will be setbacks and mistakes but it is literally one step forward 2-3 steps back with this builder. Phone calls and emails go unanswered. Nobody reaches out to us and we do not know what to do. We just want our house completed.

    We began our custom home process with Davis Homes in May 2021 by signing a purchase agreement. After long delay times from them, a Davis Homes representative put in writing that our new custom home would be completed by the end of September 30, 2022. *************************** arrived, our home was far from complete. Instead, we were issued a price increase because the home wasn't started/finished in the allotted time in the contract. Those delays were on Davis Homes, not us. Also, the details of the price increase did not match our purchase agreement. When we compared the line item breakdown to our initial contract, our calculation showed a substantial difference from what Davis Homes was telling us that we owed them. Furthermore, we did not receive an occupancy permit until the second week of December 2022. Even though we still hadn't agreed to the price adjustment or been given greater detail on the differences, they would not issue us our house keys until we wrote them a check. Our bank suggested writing the check "in protest" just so that we could get the keys and get out of our month-to-month rental situation. We wrote a letter to an Executive at Davis Homes who appeared to be interested in our concerns and finding a resolution. We had an hour long phone conversation in late December with this Executive trying to gain a better understanding on the price increase as well as seek financial reimbursement with our rental/storage expenses. It is now May 2023 and we have followed-up more than once since that initial conversation with no response or resolution.

    Although it appears that some of our employees gave estimates of completion of this project, those estimates are not binding and not part of the purchase agreement.  Please see the attached purchase documents that specifically note in section 12 that Davis Homes is not responsible for delays that are outside of our control. At the time this home was constructed, builders across the nation were experiencing substantial delays and material shortages caused by the Covid crisis.  In addition, home building was experiencing a boom at the same time there was a shortage of skilled tradesmen in the ************ market exacerbating the problem.

    The agreement also has a waiver of implied warranties.  Please see the highlights in section 32.  The buyer agreed to the express terms in the agreement and waived the right for claims for implied warranties.  The estimates given to the buyer were just that, estimates, and not part of the written agreement. 

    The matter of compensation for delays was discussed with the buyer prior to closing and the request for compensations was respectfully declined.  Davis Homes contends that the terms of the agreement have been honored.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

    [There are two issues I have with this response from Davis Homes:  1.  In the first sentence of the last paragraph, the Davis Homes representative says "The matter of compensation for delays was discussed with the buyer prior to closing...."  That is simply not true.  No conversation occurred prior to closing because we could not get a Davis representative to speak on the matters.  Hence, this is the entire reason we wrote a personal letter to a Davis Homes Executive (see attachment titled Letter Page 1 and Letter Page 2) and wrote "paid under protest" on our closing check so that we could have a conversation at a later date.  At that point in the process, we could not wait around any longer because we had no place to live.  2.  Weeks after closing, we did engage in multiple conversations with the Davis Homes Executive whom we wrote the letter to.  We provided receipts for our rentals and storage units.  We were under the impression that Davis Homes was going to take the difference between what we would have been paying if we would have been in the house and subtract it from the monthly/weekly rental expenses we occurred while not having the home (see attachment title Don's ********** We weren't expecting full reimbursement but some assistance.  We also provided information on our mortgage and property taxes/insurance (see attachment title Our **********  Since that time, I have followed up monthly with no response and that is why I am following up through the BBB.  Davis can't say to us that this matter has been resolved when no discussions happened at closing and the last correspondence I have from Davis is me following up on the status of a potential reimbursement as explained.]

    We closed on our house December 16th,2022 at that time we were told that our yard would be completed come spring time. We have repeatedly try to contact ************************* who is the superintendent who we dealt with during our build only now to be ignored. The one time my husband was able to get a response from him, was when we asked if he would need dirt because we were having an in ground pool installed and we would have dirt left over. Our yard is so uneven it is ridiculous and also the drainage out front is clogged from when they built the house from trash or they didnt do something properly so it backs up and causes the neighbors yard to flood. After numerous attempts I finally emailed ****** who then she sent an email to ***** and ************************* to please respond. My husband then received an answer saying this Friday (04/21) landscapers would be out weather permitting . Then I received an email later from ****** saying ***** reached out to her saying because of materials landscapers can not give a date .Once again we tried to reach out to get a clarification and nothing. We now have mounds of dirt in our backyard and a mess of a front yard. We would like our yard to be completed ASAP. Its embarrassing
