Response to complaint submitted by *****************************:
Ace Handyman Services prides itself in taking care of our customers and taking care of our employees.
***************************** requested an estimate for a project that had four phases: 1. Secure decking as a sub floor in a room in his house. 2.Create a half wall with drywall; mud, tape, and sand to paint ready. 3. Install trim around the base and doorway. 4. Install a sliding interior barn door on a track after flooring was to be installed (by another company or persons).
****** accepted the estimated cost between $2,735.00 and $2,959.00. Ace Handyman Services completed the first phase. After this visit, our craftsman identified a situation he encountered. When the second craftsman arrived on site to work on phase two (which would require more than one visit to apply additional drywall mud), he shared with us that he was not comfortable in the home due to the same situation and identified it as a safety concern.
Ace Handyman Services worked with ***************************** to schedule subsequent visits when he was able to ensure the safety concern was no longer present. Unfortunately, this did not happen. We sympathized with ******* predicament and continued to work with him to schedule and reschedule subsequent visits when it worked best for both parties. Unfortunately, ****** was not able to fully address the safety concerns, and some visits by our craftsman were cut short due to the safety concerns (hence the area not swept before departing).
****** was scheduled to have flooring installed on February 27. Ace Handyman Services had one more opportunity to work on sanding the drywall, finish installing trim and caulking the trim, along with securing one deck board where the s**** was sticking up according to ******. In fact, two persons arrived on site on February 26 to ensure the third phase (trim work installed, caulking, sanding the drywall, and clean up) was completed prior to the floor installation.
When the craftsman and second worker arrived, it was apparent the safety concern had not been addressed as agreed, so Ace Handyman Services determined this project could not be completed on this day, prior to the floor installation (by another company or persons). We communicated this to ******.
****** replied, stating that he would look for his bill in his email and he apologized for the safety concern Ace Handyman Services encountered.
The work that was completed was done in a professional manner. *********** request, we billed him for the time and materials spent thus far. Unfortunately, the entire project could not be completed before the flooring installation, and this is what ****** described in his complaint.
Ace Handyman Services bills on time and materials. If we were able to work on site as agreed upon with ****** sans the safety concerns, the project would have been completed in full and the invoice billed within the range of the estimate ****** agreed to pay for our time and materials.
While we value our customers and the relationships we build,we also value our employees and caring for their safety is a top priority.Customer Answer

I am writing to respond to ********************** rejected response to his original complaint.
I am attaching several documents to this email so that you can review them. Our intent is to demonstrate that ******************** accepted our estimate prior to the work being started at his home, and after we did what we could at his home, he noted in his communication to us that Ace Handyman Services deserve to get paid, and requested his invoice.
Ace Handyman Services left the communication open to help ****** again if his circumstances changed.
The attachment titled ******** RESPONSE (2) TO BBB begins with a statement from our craftsman and below it is a copy of the text messages exchanged between ***************************** and Ace Handyman Services. What is not stated in the context of the attached text communication, is what caused concern from and for our craftsmen, and what deterred our craftsman from remaining or returning to the home while **** was there, especially if one of the craftsmen were alone.
On the first visit, **** unsolicited, and repeatedly told my craftsman that she was suspected of being involved in her fiancs death as a murder, and that the police were wanting to speak with her about his death, that occurred suspiciously in a house fire. **** cited several details about the house fire and her continuous, one-sided conversation caused our craftsman to be concerned about the safety of our staff being present in the house alone with ****.
On the second visit, **** was present and the same one-sided conversation ensued. After allowing this second craftsman to abandon his project for the day, we continued to attempt to work with ********************, even looking ahead at weather temperatures so that ******************** would not have to send **** out in the cold too early in the morning.
Subsequently, as we proceeded to insist that the house was empty when we worked, I received a phone call from ****. This call could be heard by our owner who was in the office at the time, and the call was recorded (as callers are made aware when they dial our number) for quality purposes. During this call, **** demanded to know who gave direction for her to be vacant from the home while we worked, and why. Also, validating our concerns, **** accused our craftsman of stalking her. It just so happens that this craftsman, on one of his attempted visits, called me and stated that because he could tell that **** was in the house, he would just park across the street at the tennis courts until he could see she was gone. **** in turn *** have been aware or could have seen our craftsman parked across the street, away from Mr. ********* property, waiting for her leave.
As well, the attached statement from our craftsman explains Mr. ********* complaint from our craftsmans firsthand workmanship perspective. There is nothing more we can offer from this perspective about the workmanship that ******************** spoke of in his complaint.
Regarding the $300.00 ******************** claims he had to pay to secure the one decking s**** that was protruding, I cannot attest to this, except there was a floor crew due to arrive at the house on 2/27/24. Likely, the floor crewman was able to shim and sink the screw, and that this was included in the cost to lay all the flooring. Although this is an unknown, we will be willing to discount our invoice in the amount of $300.00. The remainder of the invoice is due, as we work on time and materials. Also, the language within the invoice (3.) explains our warranty provisions, etc. once the invoice is paid.
Please let me know if you have any questions and how I can further assist in resolving this matter.
Best Regards,Initial Complaint

We have had multiple conversations and exchanges with the ***** family regarding their concerns. Additionally, we visited their location to assess the issue they reported. Upon inspection, we did observe some loosening of shingles, which we offered to secure again. However, we discovered that additional work had been performed on the siding, which, according to the terms stated in our invoice contract, renders the warranty void.
2. Warranty Claims: In the event of any breach of the aforementioned warranty, the Contractor will rectify, repair, or replace the affected item at no additional cost to the customer.
3. Warranty Exclusions and Limitations: UNDER NO CIRCUMSTANCES WILL THE CONTRACTOR BE LIABLE TO ANY PARTY FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM ANY CLAIM BASED ON THE WORK OR MATERIALS PROVIDED TO THE CUSTOMER, EVEN IF THE CONTRACTOR WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The maximum liability of the Contractor shall be limited to the charges paid by the customer for the defective work or materials provided by the Contractor. No warranty is transferable. Any attempt by the customer to engage an employee or agent of the Contractor for separate additional work will render all warranties void. Furthermore, all warranties will be nullified if the customer alters any work performed by the Contractor or terminates any ongoing work before its completion. Failure to pay the full amount due in a timely manner will result in the voiding of all warranties. The Contractor does not provide a warranty for materials provided by the client. In essence, Ace Handyman Services was contracted solely for labor to remove the old siding material and replace it with the product supplied by the ***** family. From the pictures documented by our team during the project, there is no apparent evidence of backerboard installation. Instead, it was observed that the previous product had been attached to the furring strips utilized by our craftsmen. However, it should be noted that no moisture barrier was initially present, and the team requested to use leftover material (felt paper) from a previous project at no additional cost. Throughout the project, the ***** family remained in constant communication with our on-site team, and no issues were raised except for their reluctance to pay the full amount, despite their agreement and signing of a document acknowledging the expanded scope of work. Mr. ***** and I reached an agreement to consider our business transaction complete, with only the original estimate being charged. Per my letter attached the settlement demand seems extensive.

I am rejecting this response because: I have not had any additional work done to my home. I did replace the cracked picture window that happened while *** worked in that areas of my home using my own money. I paid the full price of the job estimate please see attached. *** tried to increase the price.
the workers came and went and the job took over 30 days to complete. I was patient.I wanted the work to be done right . I have also attached my receipts for the siding They would never do this to their home.

The work was performed during the time of unfavorable weather conditions in 2022. We work on time + materials, which is clearly explained to each customer. They purchased all the materials which is what we used minus adding the felt paper for moisture protection and few other items. ******** onsite explained it was going to take longer than the original estimate and gave them the opportunity to go another direction. This was when they had a scope increase document signed and were transparent upon the additional time. After the work was completed they refused to pay the full amount at which point it was stated they would be happy to go to small claims court rather than pay the full amount. They were only willing to pay the original estimate resulting in a +$1800.00 discount/loss. We agreed this ended our transaction and no further work would be done due to the uncompromising and hostile nature of the interaction. It should also be noted that no issues were discussed at the time and even when the painter finished they were pleased with the work.
This spring we got a call at which time we offered to resecure the siding that need but they declined the offer. We stopped to inspect the siding and noted finishing nails that had been colored with perhaps marker but it was not paint. We did not use nails, only acceptable staples per the instructions.

I am rejecting this response because: I paid the bill, the amount due was doubled and we refused to pay more than the estimated price. Very shady business practices. They did not know what they were doing and should refund the money. They know this and would never do this to their home.I will be seeking legal assistance and I appreciate your help. Please warn other consumers about this company and they do not back up their work or warranty. Thank you.Business Response

I understand they want their money and are unwilling to compromise. This was the situation the from the time payment was due. Both *****'s were outside inspecting the work the entire time during the project. Regarding shady business practices, they are welcome to their opinion but I disagree and our 5-star reviews and high volume of repeat business would prove are always focused on being helpful and doing the best job possible. The simple fact is that our business model works on time + materials, which is clearly explained to each customer. They purchased all the materials which is what we used minus adding the felt paper for moisture protection and few other items. The picked us I am sure because we were less expensive due to the initial estimate but that is all it ever is, an estimate.
