         We Changed the contract at your request and changed the terms as was discussed. You delayed project by 5 MONTHS due to no plat of survey. You wouldn't pay the deposit noted in new contract, which was your request but were willing to pay the overage for your cabinets...?  You had extras and were told about every single one before any worked performed and you agreed with the extra cost of every single need. We arent going to fix your house for free, its your house and your responsibility.

      Every dollar from deposit was allocated for the project up to the next progress payment of 30% of total which was never received and hence the project was canceled, garage doors frozen and permit removed due to lack of progress payment. The 60% was for Demo, Dumpsters, ************************* New Cedar Siding, General fee, electric, plumbing, materials for said items, framing, meeting with town 4 times, checking on house for 4 months since homeowner did not know what to look out for(at our good will)  We did many other items pro **** for client with no change in attitude toward project and just thought everything should taken care of at Mitchellbuildersllc expense. 

      We had a redtag which is normal and we did not continue project without code enforcement approval, this is FALSE and a lie that we continued without proper approval and the town can prove this. If we had continued without proper approval the project would of been shut down. Client proceeded to have contractors work on project with OUR permit. Client ripped out drywall as we suspect to make it look like we did something wrong. House was 100 years old with many issues that cost the client way more than thought. The client stated house had a proper home inspection before purchasing which we never saw proof of and the house was clearly not inspected. Electric was crazy wrong, foundation was rotted and sunk 2" which was stated that before buying was in great shape. Client continued to state that we, Mitchellbuildersllc, should be responsible for their house being not properly inspected and that , Mitchellbuildersllc, should include this unforeseen items.....no....doesn't work that way.

      We are requesting YOU pay for the pro **** items since you can afford to pay ******** more for cabinets than in allowance.

      There will be no refund hence to why we had PROGRESS PAYMENTS to insure we don't work and pay for such items not in deposit. Contract is void due to not following the newly agreed in person, on paper and verbally contract terms.

      Stated by your realtor/ designer/ medium client had run out of money and /our could not afford anymore extra expenditures.
