    Formal Complaint Indiana University Housing Charges and Unauthorized Use of Identity Dear Better Business Bureau,I am writing to formally express my dissatisfaction with Indiana University and to raise serious concerns regarding housing charges applied to my underage son, **** ******, for the ******** academic ******* has come to my attention that a housing contract was allegedly signed on May 5, 2024, with my name listed as the proxy for ****, who was under 18 at the time. I want to make it unequivocally clear that I did not give permission, consent, or authorization for my name to be used in this manner. I was not involved in the housing contract process, nor was I aware that my name had been entered or signed electronically.Moreover, **** never attended Indiana University and never resided in any on-campus housing. Despite this, the university has pursued financial charges based on a contract that involved the unauthorized use of my identity. This has resulted in undue stress and the potential for long-term credit and legal consequencesentirely unjustified under the circumstances.I have submitted a formal appeal to Indiana University and have requested that all associated charges be removed and that the case be withdrawn from any internal or external collection efforts. However, the initial appeal was denied without appropriate consideration of the fraudulent nature of the contract and lack of consent.I am now requesting the assistance of the Better Business Bureau in resolving this matter. The accounts in question are listed below.     ** has been sending debt collectors and communication in a balance supposedly owed from 2016. My state refund has been offset for the last 2-3 years. I have provided documentation showing ** did not return loans/*****s they claimed were sent back to the lenders to the debt collectors and ** themselves. The loans show through the federal student loans on my credit/loan repayment program and through the ***** sites as being sent to **. ** is now sending communication a year after this was resolved and ended. The debt collection agencies have stopped contacting me. My credit report also shows this has been paid in full after the documentation was provided showing that the funds where not returned as ** had claimed.

    Indiana University maintains the complainant has a valid debt that the University is legally attempting to collect. The complaint indicates the desired settlement is a discontinuance of the claim and the University is willing to work with the complainant on the desired resolution.Complainant though has indicated for the University not to contact them. IU is hopeful that the desired settlement can be achieved if the complainant is available to discuss with the University.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

    Documentation was provide showing the university debt is not valid. They have been told to stop harassing regarding this. I have provide the student loan ledger showing there is no money owed to the university. The collection company that was previously attempting to collect agreed and stop the attempt due to the documentation that was provided.

    I have late payments from INDIANA **** STUDENT on my credit report. I have been on time for 99% of my payments. The months that report a late payment was due to an ACH payment issue with my bank and I was never notified about it. I would like to ask if upper management could submit a request to the credit reporting agencies to remove the late payments.

    This is a ******* Loan, last in a forbearance that ended May 2023. The account requires monthly installments paid, as payments have been made since the end of the forbearance. As a result of this nonpayment the loan reflects 11 months delinquent. Our office received an Equifax credit dispute Tuesday and responded correct as reported as there is no error reflected in the reporting. 

    The credit reporting reflects the payment history accurately in accordance with the terms of the ******* promissory note. Indiana University cannot change accurately reported credit history simply because a student requests it. We have to follow the ******* regulations as well as comply with CFPB and FCRA. This does not mean there is zero chance for update. As you have expressed your wish to pursue credit bureau update, ********************** will need to reach out to our office so we may research and, if eligible, supply them with the appropriate form and associated documentation allowable under the ******* program.

    The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC ****. Indiana University (#******) has egregiously infringed upon my rights by incorrectly reporting 12 instances of late payments. This erroneous reporting has had a significant negative impact on my credit score, thereby impeding my ability to secure housing and obtain credit. Notably, this pertains to a school loan, which by its nature should not have been disclosed publicly without my explicit consent. Furthermore, given that I was actively enrolled in school during the relevant period, my loan should have incurred a zero monthly payment. I engaged in a conversation with a representative from Indiana University, who advised me to initiate a dispute in order to rectify this situation. I was assured that the late payments would be rectified and the account would be restored to good standing, rather than having 12 late payments inaccurately reflected on my credit history. I beseech that these unwarranted late payment entries be expeditiously expunged from my credit report. It's essential to underscore that my debt has since been consolidated and is no longer associated with Indiana University. 15 U.S.C **** section 602 A. States I have the right to privacy. 15 U.S.C **** Section 604 A Section 2: It also states a consumer reporting agency cannot furnish an account without my written instructions 15 U.S.C ****c. (a)(5) Section States: no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. ****s-2 (A)(1) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.I have reported this to CFPB.

    The ** Office of Scholarships is not responding to our letters or emails, while ** is definitely taking our money for registration and deposits.
