BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims may come to our attention from our internal review of advertising, consumer complaints and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On 10/20/21 BBB contacted the business regarding their advertised products on their website. The business advertised a price comparison from an original price to a reduced price. In addition, the price reduction was found in October 2021 and as of 2/1/2022, the reduced price have not reverted back to the original price.
Business advertised the following:

Under Packages & Pricing, one of the packages offered states:
"Classic Photo & Video - $1,299
ORIGINAL PRICE: $2,099 (SAVE: $800)"

On the bottom of the website, it states:
"*Processing fees applicable to select packages and event dates. Nationwide Photo and Video Services." -
The BBB Code of Advertising States:
5. Comparison with current price of comparable products or services sold by the advertiser or by others
5.1 Advertisers should be reasonably certain that the comparative price does not appreciably exceed the price at which substantial sales of comparable products or services have been made in the trade area for which the claim is made for a reasonably substantial period of time, in the recent, regular course of business. Such comparisons must be substantiated by the advertiser prior to making any advertised comparisons. Descriptive terminology often used by advertisers includes: “comparable value,” “compares with products or services selling at $_____,” “equal to products or services selling for $_____.”
5.2 In all such cases, the advertiser must make certain that the comparable products or services are similar in all material and significant respects.
22. Asterisks
An asterisk may be used to impart additional information about a word or term which is not in itself inherently deceptive. The asterisk or other reference symbol must not be used as a means of contradicting or substantially changing the meaning of any advertising statement. Information referenced by asterisks must be clearly and conspicuously disclosed.
The BBB requested for the business to provide a copy of the contract that is provided to consumers, provide an explanation regarding the processing fees as advertised on the website, modify website to include details about these fees that are clear and conspicuous, and clarify if the original price was their former price or another source. The BBB requested substantiation that the company made sales within the last 12 consecutive months at the original price.
On 1/5/2022 Eivan's Photo, Inc had a call with the BBB to discuss proposed changes needed to meet the BBB Code of Advertising per BBB Standard 2, as the business was currently accredited during the review. Eivan's Photo, Inc agreed to make necessary modifications to the website by removing processing fees verbiage advertised at the bottom of the webpage as they informed us that they are no longer charging this fee. They agreed to update the advertised pricing comparison as they are not comparing to a former price but to industry prices.
As of 2/1/2022 Eivan's Photo, Inc has removed processing fees verbiage from website. After a call with the business on 7/26/2022, they have presented a plan of action to address the website. As of 9/1/2022, the website has been modified to advertise one price for each package, which eliminated any price comparisons.
