This law firmm has been harrassing my nonprofit for nearly a year now. They are representing *************, which initially had a valid contract with us, but later breached by raising the price by unauthorized amounts and also provided subpar service (not relavant here as complaints were filed with the establishment).Nonetheless, this law firm just called us (supposedly on a recorded line) and the 'lawyer' admitted several times that she had not read any of the initial contract, nor the complaints, nor the submitted evidence: which we sent them months ago.She then asked me to negotiate what we believe we owed the client and asked if we would pay 29% of it ($10,000 of $34,000).This cannot be an accredited law firm! A firm with facts in hand would realize that if the client is owed $34,000 they expect that and more (to handle attorney fees and potential court costs)! The call turned more and more unprofessional as she insisted that she was right (because of her law firms standing). Wrong! She also lied and said that she had a contract in hand that showed my signature for nearly $80,000. An absolute lie as I have the time stamped email where I (the only authorized signee from my organization) signed for under $50,000.She said she would send it to me immediately and I still don't have her email: because the document doesn't exist! This firm needs to be shut down, AND as I see from other complaints, they need to start writing checks to organizations and people they harass!Business Response

This is in response to ****** Draftons complaint. On September 11, 2024, we received a collection account from our client *************************************** (Hilton) in the amount of $42,467.54 for services rendered pursuant to a contract entered into by ****** and the US Veterans Hall of Fame Class in connection with a meeting held at the **************. ********** admits in this complaint that there was a valid contract. Mr. ******* now claims that the account balance was incorrect and argued that ****** had breached the contract on two occasions: first, during the initial discussions about using the hotel for their event, and second, during the negotiation of a settlement. Mr. ******* claims that he had not signed the attached contract and that the ****** created a different contract and cut and pasted his name from an electronic signature from another contract. Mr. ******** allegations are ridiculous and baseless. A copy of the contract and invoice breakdown is attached. Mr. ******* also alleges that ****** had used a credit card without proper authorization and raised several concerns about the condition of the rooms. The credit card that Mr. ******* provided was declined. Mr. ******* has not provided any proof of these allegations.
Mr. ******* admits that there was at least $17,000.00 due to Hilton, but that he was unable to pay that amount in one lump sum and was waiting on other funds to make the payment. It is clear that Mr. ******* and his organization were having financial difficulties and is now using these allegations as a basis to breach the agreement with *************

I am filing a complaint against Leviton ************** and collection agency: ************** for their actions in attempting to collect a payment for services that were never requested or provided on behalf of their client:Sothwaste. Case Number: ********. Despite our request for supporting documentation, the collection agency (**************) and client: ********* hasnt been able to provide evidence of services requested and rendered. Additionally, the contact person listed in the invoice was no longer employed/involved by the restaurant at the time of the alleged services. The actions of ***************** ************** have been unprofessional, including failure to provide requested documents and continued collection efforts without proper justification. Their failure to address our concerns or validate the claim has caused undue stress to our business. We seek the cancellation of any outstanding balance on this invoice, as the charges are unsubstantiated, and we request that both parties cease any further collection efforts until proper documentation can be provided.Business Response

On July 15, 2024 I paid $638.00 as a down payment for a commercial vehicle insurance policy through ********************** and financed by Capital Premium Financing. I was told by the company that I was contracting for that this policy did not provide the required coverage. I tried several times to unsuccessfully have corrections made to the policy. On August 8th, 2024 I canceled the policy. I asked them to refund my down payment of $638 but was denied. I pursued that only to be denied again so I took my loss and thought that would be the end of it. Since then I have received many harassing and threatening phone calls, letters and emails from Leviton Law Firm demanding I pay $1,174.22 to their client, Capital Premium Financing. I never had any of that money in my pocket, wallet or checking account. If I don't have that money, then who does? I did not have insurance coverage through them either. They stole $638 from me and now they are demanding more? How unethical and dishonest of them!Business Response

This company continues to contact me stating I owe $3400 for an unpaid workers compensation policy for a company I used two years ago! They will not provide any proof other than them saying Im in rears. ****** companies have sent me anything by mail or email. I initially was going to settle for a lesser amount as the business is closed and that amount was all I had left in the account but after looking back at my paperwork and all the payments I made Im not seeing a single time I underpaid or didnt pay at all. They will not accept me asking for any proof. They hang up on me when they dont hear what they want. They are incredibly rude and dont let you respond to anything. They are now calling multiple times today threatening Ill never be able to get worked comp insurance for any business I start for the rest of my life which is 100% not true! After reading other complaints about this company Im now seeing they are a big scam! Glad I never gave them any money!Business Response

Tell us why This is in response to ******* Hurts complaint. On October 10, 2024, we received a collection account from our client Berkleynet in the amount of $3,684.56 for premium that resulted from an audit of **************************** (insured) commercial workers compensation insurance Policy Number BNUWC0158567 effective 12/04/2022 to 12/04/2023. All documents supporting Berkleynets claim have been provided to the insured. Numerous attempts to resolve the balance with the Insured since at least October 10, 2024, have been unsuccessful. The premium you pay at the beginning of a policy period is a provisional amount. It is an estimate based on projected payrolls for the coming year. After a policy has expired, the insurer conducts an audit to determine actual payrolls for that year. The insurer then adjusts the premium. If actual payroll exceeds estimated payroll, you may be billed an additional premium. If actual payroll is less than projected payroll, you may receive a return premium.
Most workers' compensation policies contain a clause that addresses audits. It states that the employer must allow the insurer to audit the policy anytime within three years after the policy has expired. The insurer has the right to examine any records that relate to the policy.
As you know we do not ensure the validity of our client's claims. Our duty is to verify the debt with our client when the debtor requests or disputes a bill. Our client has verified this debt.
We take all complaints very seriously and have thoroughly investigated this matter. While this is a commercial debt, we do have a Policy & Procedures manual that is given to every employee. In it we have adopted a zero tolerance policy regarding violations of any law. Our Policy and Procedures manual also requires collectors to follow the proscriptions of the ****** TCPA and all other Federal and State laws relating to debt collection when required. At no time was Ms. **** harassed or provided with incorrect information.
This firm prides itself on treating debtors in a dignified and respectful manner; and most importantly within the bounds of legal and ethical standards. As of this date the audit premium is due and owing. here...Initial Complaint
