            This may be in violation of Section 475.310 of the IL Administrative Rules on Motor Vehicle Advertising. In IL, advertised pricing can exclude only taxes, title, license and dealer documentary service fee.

            In addition, onscreen text of First Marshall Auto Auction's TV commercials state “Plus T, L & F”. This may be in violation of Sections 475.250 and 475.310 of the Illinois Motor Vehicle Advertising Regulations.

            Pattern of Complaint

            A recent review of BBB complaints has delineated a pattern of consumer allegations against First Marshall Auto Auction.

            In their complaints, consumers allege that:

            Consumers were charged additional fees, which were not mentioned prior to giving down payment, and increased the total amount due.

            First Marshall Auto Auction failed to disclose their no money back policies to consumers.

            Consumers were not allowed to test drive or inspect a car prior to purchase.

            A recent review conducted on March, 19th 2018 found allegations to be continuing. 

            To date we have not heard back from the company regarding the pattern of consumer allegations. The BBB will continue to monitor complaints, but advises any consumer to be aware of this business and the pattern of consumer allegations.

            In October 2019, the BBB investigated the business practices of First Marshall Auto Auction LLC as a result of consumer complaints and inquiries received. Review of information determined previously alleged business practices continue to recur based on recent customer complaints. Additionally, the business has been unresponsive to consumer complaints. Lastly, a review of First Marshall Auto Auction LLC’s Terms of Auction appear to address noted complaint allegations.
