Important information

  • Advertising Review:

In October 2022, BBB questioned Consumers Choice Home Warranty’s mailer which stated:
    “FINAL NOTICE”
“IMMEDIATE RESPONSE TO THIS NOTICE REQUESTED”
    “Respond By: 10/14/2022”
    “Signature Required”
“Call to verify the above information Before the respond date expires!”
    “IMMEDIATE RESPONSE REQUESTED”
“Please call 1-800-349-0755 IMMEDIATELY as this will be our FINAL ATTEMPT TO NOTIFY YOU.”
“We reserve the right to revoke your eligibility for service coverage after 5 days.”
“Our records indicate that you HAVE NOT CONTACTED us yet to get your Home Warranty up to date.”
Without a home warranty in place, you are at risk of being financially liable for any and all repairs. However, you still may have time left to activate a Warranty on your home before it’s too late. No inspection will be required and final acceptance is subject to your ability to meet eligibility requirements.”
    “Registration Fee Voucher”

According to BBB Code of Advertising, “The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact. In addition, according to the Missouri state statute 15 CSR 60-7.020 (1): “A seller shall not make a representation or statement of fact in an advertisement that is false or has the capacity to mislead prospective purchasers.”

BBB requested the business provide substantiation, modify, or discontinue the claims made on its mailer.  The company responded to BBB indicating that it made modifications to its mailer but failed to provide a revised copy to BBB as requested.
