On May 19th Axle Whittham from Axels Tile And Masonry came to my home and he wrote me a bid for some tile work, I agreed to the price and provided him with a deposit in the amount of $950. He asked me to order the tile and let him know when I received it and he would start the work then. In a subsequent conversation with him I mentioning that another contractor had dropped the ball and not completed some construction work I had paid him to do on some other projects outside. He said he could do that work too and wrote a bid for those projects as well on May 23rd. He indicated he required a 50% deposit to put me on the schedule and indicated he was available to start the following week. On May 31st the day before he had agreed to start the work I gave him an additional deposit of $9,000. The next day came and went and he did not show up, I called and he did not answer. The following day he also did not show up. I called and he did not answer. on Saturday, June 3rd I went to his home and asked when he was going to come and start the work and he indicated he did not work on the weekends. I asked why he hadnt shown up the previous two days and he said he was on another job. An argument ensued between us. I left and indicated to him via text message that I was not interested in having him do the work, and that I would like a refund of my money. I did not hear back from him so on June 3rd I called the ********* police department and reported him but was told that it was a civil matter, and that I had to take him to small claims court. He has indicated several times since that he does not intend to come and do the work that he has been paid to do but also that he is unable to refund my money. I have requested my money be refunded to me several times, and he has indicated that he will pay me back when he can with no specific date. As of June 9, after posting a warning not to hire him on ********* he contacted me and indicated to me that he could potentially pay me back by the end of July. I told him this is unacceptable that I needed to be refunded immediately in order to hire another contractor to complete the work. I have the bids with the work to be completed listed, the deposit amounts paid and full amount listed and his electronic signature. I paid him in cash as thats what he requested. I understand this is not the first time hes done this to someone here locally as another gentleman by the name of **** reached out to me on ******** indicating *********************** had done the same thing to him. I have contacted local attorneys, who have all indicate that they do not deal with small claims and that filing a law suit against him would likely cost more than I would receive back. I would very much appreciate any help I can receive in this matter, I am an overwhelm single mom and $10,000 is a lot of money to me. Attached are the bids with the work to be completed, the full amount as well as the deposit amounts listed. Thank you for your attention to this matter, I greatly appreciate any help I can get. *************************

Ive also attached the withdrawal slip for the deposit paid in cash to **** on the 31st. The other 950 I took out of an atm and I am trying to figure out how to get receipt of that.

Thank you for your time in this matter,
