    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

    On July 3, 2019, in the District Court of the Fourth Judicial District of the State of Idaho, in and for the County of Ada, State of Idaho, through Attorney General Lawrence G. Wasden filed a Complaint against Access Life’s Adventures LLC, Keith Craig Fletcher and Crystal Renae Fletcher (hereinafter, “Defendants”). 

    According to the complaint, the Defendants advertised and sold guided fishing, hunting, and sightseeing vacation packages to consumers located within Idaho and throughout the United States.  The Attorney General’s investigation revealed that 50 consumers paid approximately $190,305.50 to Defendants for guided vacation packages that Defendants failed to provide. 

    The Attorney General notified Defendants in writing on June 14, 2019, of the Attorney General’s intent to file this lawsuit and offered Defendants an opportunity to enter into an Assurance of Voluntary Compliance before June 21, 2019. Defendants declined the Attorney General’s offer of settlement.

    The State is asking the Court to declare that Defendants committed multiple and separate violations of the Idaho Consumer Protection Act; enjoin Defendants from engaging in advertising, offering for sale, or selling vacation packages involving guided fishing, hunting, or sightseeing excursions; pay restitution to all consumers who (i) paid Defendants for goods or services they never received and (ii) did not previously recover their funds through other means; pay the Attorney General a civil penalty of $5,000 for each violation of the Idaho Consumer Protection Act and pay the Attorney General’s reasonable attorney’s fees, investigative costs, and expenses.
