    On September 11th, 2024, I contacted Fathom realty about a property located at *****************************************************. I asked to speak to the listing agent. **** ******* stated she was the listing agent and met us at the property for a tour. I loved the property and told her onsite that I would like to put in an offer. She asked if I had an agent and I told her that I don't work with a buyers agent. I only deal with the listing agent. She had her laptop and prepared the offer onsite. She had us "Docusign" at the house on our phones. Of course it was impossible to read on our phones, so we trusted that the offer was standard and we weren't signing anything other than "Offer Docs." Unbeknownst to my daughter and I, a "Buyers Agent" form was slipped into this process and she was our agent. The purchase offer was not accepted and we went on our way. We never talked to **** again and never heard from her. Eventually I found another home right down the road and contacted the listing agent. Over a period of a month an offer was made and accepted on this property. On 10/11/24 **** reached out and contacted my daughter and I and asked us how we were doing. We said we were moving into our new home. On 12/07/24 we received a registered letter from Fathom Realty asking for $18,750.00 in cancelation fee for buyers agent contract. This contract was delivered in an unethical way and Brooklyn nor myself, had any idea that we were under contract. Had we known, there would be no motivation for us to not use **** ******* the purchase of our new home. We never heard from ****, talked to her, were shown homes, helped during the procurement. This is a shakedown move. No service was provided to ******** or myself over the month in between viewing the ******************** and the purchase of our current residence. I would like for Fathom Realty to retract this request and realize this is not a better business practice. Finally, this clearly breaks the Realtors Code Ethics section 9-2.
