By way of introduction, as **********************'s current ***************** Chair-person, we contracted design rendering services in August of 2023 from Jessi Mart in the amount of $1000 for providing a design rendering for refurbishing Calvary's existing kitchen facilities located @ ***************************************************** (Invoice #*** dated 8/22/23 from *****************************************, ******************************************************: Design Retainer). Subsequently, *************** issued Check #***** dated 8/29/23 in the amount of $1000 to secure the requested design rendering services, and then our representative met on September 5th, 2023 with ***** Mart, her general contractor and 4 other sub-contractors to discuss scoping flooring, carpentry, plumbing, and electrical services in support of scoping associated costs for new cabinetry, installation of new flooring, appliances, plumbing fixtures, and associated lighting and carpentry activities to augment existing capabilities. Note: Invoice #*** for design rendering services from ***** Mart appears to be the same Jessi Mart located at the ********************************************** address for The Design Studio - see *********************************** internet address and the listed associated contact phone #************. *************** is seeking full remuneration in the amount of $1000 for issues similarly addressed for ***** Mart as noted on the ** non-accredited BBB rating customer reviews. I apologize for the delay in responding.
After reviewing my communication regarding what my retainer was intended for-I do feel as though I have provided information that satisfied the use of my retainer (Please see the email below)
I attended the meeting with the subs and provided them all a scope of work as well as a floor plan with any of the notes discussed. I also made many follow up conversations regarding appliances and any questions the sub contractors had about the project. I provided appliance and plumbing selections on November 10th with some rough color scheme ideas. (See the email below as well as the attachments)
Yes the communication was a little spotty during the process. But in regards to the retainer for my time, that has been satisfied.
I do recall at the time of the meeting with the subs, you were provided a general rough estimate of around $200,000 but should be able to do the project for that or below (without knowing what was happening with the ventilation)
Generally when assisting with design projects-I charge $250/hr and depending on the situation, I will discount that off any product that I provide(as I listed in the email below).
I know that in previous communications I had mentioned that I would be working on renderings and providing estimates but over the last two years I have over-promised (on top of having a lot of personal issues I have been dealing with) and was trying to help keep everything moving forward so if I misled you-I apologize. But after reviewing communications and what my obligations were leading up to everything-I do see that my retainer has been satisfied. I have had to look at what my workload is and not continue to do more than what I am able to do.
If you would like to move forward with this project and work through anything-please let me know. I would be more than willing to provide any information necessary to help in anyway

That retainer will include:
Assistance with color selection
Specifying any finishes, appliances, plumbing
Meeting at jobsite with the vendors
Coordinating with the general contractor
Meeting to make sure things are running smoothly

I hired *************** (********) at The Design Studio nearly 6 months ago. She will not communicate with me, nor refund me as I have asked. Here is an excerpt from an email to her regarding the refund request: Your email on 11/10/23 referenced the need to get materials ordered in maintaining that first of the year schedule. On 11/14/2023, you picked up a check for $12,142.74 to order the supplies needed to begin our kitchen remodel in January 2024. The following is an outline of our communication since you received payment: 1/07/24 - I emailed asking when we were able to begin.1/16/24 - REPLY via email: You cited another job having water damage and hoping to finish up in the first part of February and then I was next in line. 2/02/24 - I sent a text to your cell. No reply.2/12/24 - I sent an email. No reply.2/29/24 - I sent a text to your cell. No reply 3/08/24 - I sent an email asking if you had our materials ordered. No reply.3/08/24 - I called your office and left a message to please contact me. No reply.3/13/24 - I sent a text to your cell. No reply.3/18/24 - I called your cell and left a voicemail requesting a reply.3/18/24 - I sent a ******** message to you as well as a mutual friend wondering if you were ok.3/19/24 - After our mutual friend confirmed you were ok, I sent a text to your cell asking for a response. 3/19/24 - REPLY via email: You cited a variety of issues, but were hopeful that they were getting worked out. Not sure address you have listed is correct. Here is what website has: ************************************* ************ - ************************************************************************ Note that this is the 2nd BBB complaint we have filed this year See Complaint #********.We signed with The Design Studio and *************** in Feb of 2022 for remodeling work for our home. There are two parts to this job 1. Upstairs bathroom remodel (which is mostly done) and 2. lower lever bathroom/laundry room revamp. (Little has been done)They started fall of 2022, but work was sporatic. For many months she would not return our numerous calls, emails. We even dropped by her business only to find it unoccupied just about every time. We finally filed with BBB in July of 2023. After that she contacted us, some work was done but by Sept of 2023 she had gone unresponsive again. In Contract attached, it says 2nd payment of $5794.50 was due with drywall done. At that time, some work was getting done and in good faith, we paid that payment Sept of 2022, despite that part of job work was not completed. After we paid, they were unresponsive.We were told the projects were supposed to be completed in 6 weeks or so, we are now coming up to 2 years and not completed. I paid The Design Studio $390.00 for a deposit on a new bathroom vanity in October 2022. I was told a 6 week lead time. I started contacting them in December via email and heard no response until January. In January 2023 they told me they had not received the vanity yet and would hopefully be in by the end of the month. That is the last contact *** heard from them. I was working with the owner and they have not returned my emails, calls, or regular mail regarding the status of the vanity. At this point I am seeking a refund since I have no faith the vanity will come.Business Response

We signed for remodeling projects in February 2022 - a bathroom remodel and lower lever laundry/1/2 bath remodel. We did not get started right away since there were shipping issues etc, common for that time. Work started a bit in fall of 2022. Most of the main bathroom was completed, except for fixture errors and shelving never installed. The lower level is studded for drywall, cabinets removed. Images attached.No one has been at our place since late 2022/early 2023. Emails, texts, phone calls have not been answered, or if there is a reply its "I will call tomorrow" or "I am still planning". We visited place of business (****************************************************************************) to find nobody there. When we did find owner, discusses her divorce, people being sick; and we were assured the money is not gone. I have been in contact with this client and was recently at their home to discuss the completion of their project. As I suspected some of the subcontractors work had not been complete and there was a payment dispute. In addition to many personal issues within my own life.
