On October 20, 2023, the Contractor’s License Board, under the Department of Commerce and Consumer Affairs, State of Hawaii and Wave Builder’s LLC (hereinafter, “Respondent”) entered into a Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order.
The Order alleges, RICO received several complaints alleging that Respondent failed to complete residential projects and to refund monies for work not completed.
RICO alleges that Respondent has closed the business and Chun, the only manager of Respondent, has filed for bankruptcy in United States Bankruptcy Court, District of Hawaii, Case number 23-00127. The foregoing allegations, if proven at an administrative hearing before the Board, would constitute violations of the following statute(s) and/or rule(s): Hawaii Revised Statutes ("HRS")§§ 444-17(1) (dishonest or deceitful act as a contractor that causes substantial damage to another), 444-17(3) (abandonment of a project without legal excuse), and 444-17(11) and 444-17(13) (failing to complete the Project without legal excuse).
Respondent admits to the veracity of the allegations and that Respondent's acts violate HRS §§ 444-17(1) (dishonest or deceitful act as a contractor that causes substantial damage to another), 444-17(3) (abandonment of a project without legal excuse), and 444-17(11) and 444-17(13) (failing to complete the Project without legal excuse).
Respondent enters into this Settlement Agreement as a compromise of the claims and to conserve on the expenses of proceeding with an administrative hearing on this matter.
Respondent agrees to the voluntary revocation of Respondent's license.
Respondent understands Respondent cannot apply for a new license until the expiration of at least five (5) years after the effective date of the revocation. Respondent understands that if Respondent desires to become licensed again, Respondent must apply to the Board for a new license pursuant to and subject to HRS§§ 92-17, 436B-21, and all other applicable laws and rules in effect at the time.
