    Dispute between homeowners and ***. BOD and Property Management Company not following our rules and regulations, while unfairly and illegally trying to impose fines, create lawsuits for people they don't like, and that they want to get rid of. Causing stress on all owners, with our property values and quality of life going down, with no regard for the real important issues that directors are tasked with for taking fiduciary responsibility for the buildings, property, and the healthy management of maintenance fees. ******** company clearly need mediation to keep their own agendas and personal vendetta's away from business dealings, and from owners, which is effecting the proper management responsibilities being carried out in a professional respect manner to all who are paying large fees and assessments for these unhealthy behaviors and management practices.

    Aloha's property management's agent ******, has publicly made untrue false statements about me, a Homeowner, and ***************** Member, to our entire BOD's, and *********************** on emails, and at meetings. She further abetted these false statements adding illegitimate fines & late fees to my homeowners account, that has been in good standing the entire time I have lived in my condo. Then aided & abetted our HOA BOD to send these fraudulent charges to an attorney, placing a $5,000 lean on my property, with HUGE attorneys fees. Without so much as a single witness, and/or statement from me, or my neighbors who ALL witnessed her conduct with this egregious behavior without just cause. Causing me a senior, serving on our ********** living on a fixed income, undue stress, financial hardships, not to mention, slandering and vilifying my character in the community. Very UNPROFESSIONAL for a licensed agency.For resolution I would need these false charges and unwarranted statements removed from my billing statement, removed from my property, and a public apology.

                Aloha Property Management,**** is the agent and property management company that manages the Association of Apartment Owners of ******************************** This letter is in response to a complaint made by an owner at the Association.
                Aloha Property Management, **** denies treating any owners unfairly, inequitably, or disrespectfully. Aloha Property Management, **** denies making any false statements concerning the owner in question and further denies any impropriety involving the assessment of fines and legal fees. Aloha Property Management,**** strives to manage properties as professionally and cost efficiently as possible.  Management of the Association is vested in the Board of ***************** who are elected by the owners of the Association, who then direct the performance of Aloha Property Managements duties.
    The Association must follow the procedures outlined in the Declaration of Condominium Property Regime of Keonekai Villages, the Bylaws of the Association of Apartment Owners of Keonekai Villages, and the Rules and Regulations of the Association of Apartment Owners of Keonekai Villages (collectively Governing Documents) for maintenance, repairs, and/or improvements at the Association. This may mean that some maintenance, repairs, and/or improvements are not completed as quickly as owners would like, however Aloha Property Management, **** and the Board must follow the governing documents of the Association. Deviating from the governing documents for expediency purposes would open the Board and/or Aloha Property Management, **** to legal liability.

    I just received your email, after your 7 day expiration date. I have been traveling for work without a day off to look at personal emails.

     

    After I read ****** Clurs response I still have no idea what she said, because she never touched on the complaint I made about putting an $8000,00 bogus fine on my home based on a lie she told, and she has never addressed this lie or cleared it up. Why the lie? 

     

    Her defense response was some speech about following rules and regulations, and NEVER touched on the fact that she clearly lied about me cutting trees on *** property. 

     

    I have Attached the false billing statement to this email she keeps harassing me with. Also attached are Letters from neighbors who were there and witnessed her lying, one of whom actually paid to have the work done in front of their property, nowhere near my property, and had nothing to do with me. 

     

    There are more letters, and photos to prove that my neighbors hired out, and paid for the work that was done, cutting down haule koa, an invasive species on the city & county property line, fronting their properties,  which was NOT on *** property, and had absolutely nothing to do with me. Absolutely NO TREES were cut that day, by anyone, in fact these neighbors were trying to save the perennial trees on their properties, along with ***** and fauna that was being choked out and killed by the invasive species. Of which our *** By-laws States, 'No invasive species allowed on our property ". They feel they were following *** BY-Laws. They were cutting it out before it invaded their trees on property. again nowhere near me, and nothing to do with me.

     

    I will also include more documentation in my next email, I am too tired and unable to locate tonight the photos, of weeds on property stake lines. Photos of my property nowhere near this property where I cut the weed out 7 years ago, and did not receive a fine then. Neither did 4 of my other neighbors receive a fine for removing from their property lines. I will also include statements from  C&C representative that offered to cut down the weed that they admitted is on their property, and wouldn't offer to do so if it was on our property. Again, which has NOTHING to do with why she lied and put this huge fine on my property, 

     

    This IS FAR from over, and she HAS NOT answered the complaint, of all the lies, false character assainations, illegal abuse of a Board member that owners voted to the **** they want to know also??  Then she failed to blind copy the email addreses's of which owners are really upset about, and REALLY want an answer as to why she still has a license when she is this incompetent, and incapable of following legal procedures, and simple rules for which she claims to be following with no examples in her response? We just don't see it?  

    I want to know why she lied?

    Why she did not advise the *** board it was illegal to lock me out of a board meeting? And lied to them, to help further fuel a feud on our property, instead of managing with proper procedures?

    And still doing so!

    Why she BLASTED an email to the entire property of owners, FALSELY accusing me of 'Vandalizing the property"?? Of which she excluded me from the email, and all my neighbors provided me a copy of, full of character assassinations!

    Why has no one else has been fined over the past ten years for removing the weed which has now been man-dated to be removed all over the state as a huge fire risk? (and main contributor to the Lahaina fires!)  

    And the HUGE bogus fines?  Harassment? Where are her facts that she is entitled to keep lying with no proof whatso ever that I ever cut anything, and say she has answered complaint?

    Far from resolved,,,, OR answered!

    On 1/27/2023 and 2/27/2023 this company billed me $492.16 for HOA fees, even though they informed me that a new bank, CIT, would be collecting the fee. CIT did collect payment, but this company continued to collect the same payment, double billing me for those two months. My bank stopped payment on the March double billing by them, but they will not return my calls regarding a refund of the $984.32 they owe me for ******* and February payments. They continue to stonewall me after 5 phone calls and 4 voicemails with the person they say is in charge of accounts receivable. Today I asked to speak to the supervisor of the person responsible, and they replied she doesnt have a supervisor. Then I asked for the Office Manager, and conveniently the Office Manager was also unavailable.
