Originally, $83,584 was paid for solar panels to be installed in 2011. The solar panels are covered by a 25 year warranty. I have the written agreement and warranty for services. The company acknowledges that new solar panels are needed and refuses to honor the warranty for the solar panels.

We purchased 24 pv panels and 4 battery system that Poncho's installed. Our system was never put online. I have followed up with the salesperson multiple times with no response other than she'll follow up with her team. After installing the panels and battery, they took their money and ran. The company was sold to **** shortly after the installation. No one is willing to help. We can't even find our Site ID or anything because nothing was documented or given to us after the installation. We can't tell if our system is even running correctly or the amount of power the panels are providing.

I bought solar panel system installed at my residence in September 2020. Despite installing 31 solar panels and purchasing 6 batteries, I have encountered several issues that have not been adequately addressed.Firstly, I did not receive any pamphlets or instructions on how to read the inverter, which has made it challenging to monitor the systems performance. When I received my first electricity bill, I noticed only a slight change. However, subsequent bills have been unexpectedly high.Upon contacting my salesman, I was advised to reduce electricity usage during peak times and to turn off the air conditioning by 7 PM. Despite following this advice and monitoring my usage for several months, my bills have remained high. I have raised this issue with my salesman multiple times, but I have not received a satisfactory explanation. When I provided my salesman with a copy of my bill, he forwarded it to the service department without offering any explanation or follow-up. Eventually, a technician named ***** was sent to inspect the system. He discovered that the battery power was off. I am particularly upset because no manuals or instructions were provided with the purchase, and despite repeatedly mentioning the high bills to my salesman, no action was taken. which I find unacceptable given the lack of initial support.Furthermore, the representative from the inverter co.informed me that the service technician should have ensured the battery was fully charged before turning it on. Due to the incorrect setup, the battery has not been fully charging, causing me to continue relying on power from the electric company. As a result, I have paid high electricity bills for nearly four years because the battery was not turned on by your company. We made sure we bought enough solar panel and battery to support our electricity. I bought my solar panel from poncho but shortly after they sold the company to Haru. Also they didn't hook up my AC to solar panel so my bill is high.

I am writing to file a complaint against Haru Energy (formerly known as Estat Hawaii and Ponchos Solar) regarding the installation of a no-export solar system at my home. I contracted with Estat Hawaii in August 2021 for the installation. The installers completed their work in June 2022 at which point they demanded and received final payment. The system immediately began failing, requiring constant monitoring and resetting. The system had ongoing battery faults for over 12 months because the original battery bank was undersized, as determined by technicians from Haru Energy and the inverter manufacturer. To address the battery faults, on June 2, 2023, a Haru Energy technician greatly limited the power through the inverter to avoid tripping faults. However, this means I cannot get the full benefit of the solar power being generated.I agreed to pay for additional batteries to resolve this issue. Despite multiple promises to provide a quote for the battery upgrade at cost, Haru Energy failed to deliver any quote. The permit for the system installation still remains open after over 16 months. Haru Energy has repeatedly broken promises to complete the paperwork and inspections required to close the permit. I have lost all confidence in their ability to resolve this. Moreover, I cannot hire another company to add batteries and fix the issues without voiding my system warranty with Haru Energy. Their lack of accountability has left me trapped in this unacceptable situation. After over 16 months of delays, I am left with no choice but to file this formal complaint to seek action.

    I received your message.
I am sorry that I misinterpreted the situation.
My understanding was your problems were solved and waiting for battery quotation from us and our sales has been responding.

Please let me know if we can still provide you the question.

I am rejecting this response because:
    Dear ******************,
I appreciate receiving a response, however I want to clarify that the core problems with my system remain unresolved.
Specifically, the undersized battery bank, power limitation to avoid faults, open permit, and lack of a battery upgrade quote have not been addressed nor have you provided any date commitments despite repeated requests. This case will remain open until these items are complete.

Please provide me with a specific timeline and commitments in writing to resolve each of these issues. I welcome the opportunity to work constructively with you to find a solution. Please let me know if you have any questions. I appreciate your attention to resolving this matter.

    Sincerely,

    ******************,

Regarding the undersized battery bank, power limitation to avoid faults, I believe we sized/build your system based on your ******************* at that time.
We are currently working on *****, we will let you know once we have inspection date.

I will have our sales person to re-send you a battery upgrade quote,  but meantime have you consult with Taka to decide which system you would be interested to purchase?  I appreciate if you could let us know as soon as you find out.

I am rejecting this response because:

These specific items in the response were promised by 2 other people in the company on July 26 and August 3.  I relayed the same information recently to a third person representing the company.  Given the history of broken promises and open-ended resolution times, I can only accept getting a quote in-hand with pricing as discussed on July 26 AND having an inspection date showing ** in the county permit system.  The quote was to be for adding 2 additional batteries of the same make (Simpliphi) and size that they provided in the original design. The additional batteries will accommodate higher demand that occurs in the evening. The no-export system was supposed to be designed for a monthly consumption range of 1090-1340kWh/month.

    Sincerely,

    Complaint: 20793632

I am rejecting this response because: The quote was not reasonable given that the initial storage was under-designed for the system and our usage patterns which were provided before design was done.  I generously offered to pay for the batteries since they were not on the original quote but this company is trying to make me pay for their mistakes. If the system was designed correctly, they would not have to fly technicians in again.  I regret that this matter now requires legal remedy. I will not hold the BBB case open for this item.

The BBB case will remain open until the permit is closed

    Sincerely,

I have a service contract (part of the purchase) with Poncho's Solar. Last year and early this year, it took well over 100 days for ******'s to respond a fix a problem. This time, in early September I reported a leak in the solar hot water system. A few days later I notified ******'s that the leak was worse, and I had to shut down the solar portion, but wasn't sure I did that correctly. Now, well over a month, with five telephone calls, still no response of any kind from ******'s (aside from one during a telephone call: "We'll tell Poncho."

My husband and I purchased Solar PV in 2015 through Poncho Solar. Earlier this year I found out my HECO connection was removed from the *** program due to an incomplete *** application. I found out Poncho Solar was sold to eStat. Poncho ******************** informed me Poncho Solar must remedy the issue - when they bought the company they also bought the client base plus liabilities and they took the "portal" to submit the paperwork. Poncho Solar (aka eStat) delayed and made promises they never fulfilled. They finally sent me a bill for almost $1,000 to remedy the problem. I went back to Poncho Water Heater and they agreed to remedy the problem since access to the "portal" was not to be used due to the original program being pre-portal. HECO approved the application and I am back in the program. Yesterday, I received a bill for $261.78 from Haru Energy (same address as eStat) for services I never authorized or approved of. eStat/Poncho Solar/Haru Energy is operating under different company names and creating unnecessary and/or false expenses.

I am requesting BBB assistance for a warranty issue with Ponchos Solar on the replacement of a malfunctioning solar panel. Ponchos technicians determined that the panel is not working properly. Yet, Ponchos is not honoring the full ten-year labor warranty and is going to charge me a truck roll fee of $250 to replace the panel, which was also covered by a 25-year manufacturers warranty. Per the warranties, I request that the panel is replaced at no cost.Ponchos explained that it is a dispatch fee per job site visit and is a one-time loyalty courtesy discount because the actual work costs well over $250. *** considered the offer for the last ten weeks, but believe that their work is within the scope of the warranty. In my experience, I never got charged for repairs on an electric stove, a washing machine, and a solar water heater system under a parts and labor warranty.8/27/2013, Ponchos installed photovoltaic system.10/14/2022, I reported an underperforming panel to Ponchos.10/28, no show by Ponchos.11/4, the first technician determined that the optimizer needs to be replaced. (He stepped on all over the panels, not only the frame/rim.)1/27/2023, the second technician replaced the optimizer. (He told me that his office would reset the system to recognize the new optimizer.)2/2, after all, I had to perform paring on the inverter.2/3, I reported the optimizer did not fix the problem. (Around this time, a new dispatcher asked me for my username and password for the solar power monitoring account. I did not share them, because the previous dispatcher had access to customers accounts.)2/4, I sent the warranty and invoice to Ponchos.2/10, the third technician determined that the panel needs to be replaced.3/16, Ponchos scheduled the panel replacement for 4/7 and canceled on 4/6 due to a holiday, only after I followed up.4/11, Ponchos mentioned a truck roll fee of $250.5/4, Ponchos stated they have a replacement panel.

    Better Business Bureau:

I accept the response by ******************************* from eStat Energy Solutions in reference to complaint ID ********.  However, I request BBB to keep the case open, due to the unresolved issue concerning warranty repair on an underperforming ** panel.  Additionally, there remains uncertainty which company bears the responsibility for the repair at this moment.

In response to my original complaint (ID ********* to ********************** on 6/13/2023, *********************************, VP, responded on 6/26/2023 that P&T sold the photovoltaic business to ****************** in May 2021 and she is responsible for the warranty repairs.  However, ****************** responded here on 7/22/2023 that my warranty repair, for an installation completed on 8/27/2013, falls solely under P&T's responsibility.

Faced with this unexpected dispute between the two companies, I personally spoke to ****************** on the phone on 7/27/2023, using the contact information provided by Ms. *************** ****************** mentioned, in my understanding and wording, that she has received similar complaints about warranty works, has communicated with P&T regarding their warranty responsibilities, provides the warranty for customers, whose installations were completed by eStat, and provides extended warranty as a courtesy at eStats discretion to P&Ts customers.  All of these seem to show eStat's effort and intention to work with P&T and customers.

I believe that the case now requires more details from P&T than just referring to eStat.  Therefore, I kindly request BBBs assistance in contacting P&T Solar Company dba Ponchos Solar Service.  Given the current status, where I have returned to the starting point of this dispute, I request P&T provide documentation(s) to clarify the warranty responsibilities, particularly in cases where P&T completed the ** system installation prior to selling the photovoltaic part of their business to eStat.

I think that there will be more customers, who will find themselves in the same situation.  My concern extends not only as an individual seeking resolution for my warranty repair, but also as a consumer to find the clarification and resolution for others and to report notably unfair business practice if found during the resolution process.

    Sincerely,

    ***************************

    BBB,

I accepted the business's (Estat) response last night with my request to BBB to keep the case open, as my complaint about a warranty repair is not resolved yet.

Upon speaking to ******************, the owner of the business, I learned that she has been attempting to resolve the issues of warranty responsibility with P&T Solar Company, which sold the photovoltaic business to Estat.  It seems that P&T is only pushing all PV warranty claims to Estat and it is uncertain how responsibly P&T is working with Estat for these apparently repeated issues from different customers.  I think it is reasonable to request P&T to clarify, with documentation, how clearly the warranty responsibility was transferred.

I sincerely thank you for your continuing support on this matter.

I have attached the page of our contract with
Estat that shows what our company is responsible for in relation to selling the ** part of our company to Estat.  We are responsible for permitting and validation documents.   Estat took all files for our ** customers.  They are responsible for honoring warranties.  We will take care of ***************

    Customer Answer

    Date: 08/29/2023

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.  However, until the panel replacement is completed, may I request BBB to keep the case open?
Technicians from Poncho's Solar Service came to find the ** panel model on 8/22/2023, and I received a message on 8/28/2023 to schedule the replacement work.  I emailed my availability to Poncho's at the end of the day and will follow up on which date works best for them.
I read the extract of "eStat contract" document.  Combining my limited interactions with Ponchos and eStat, in my perspective, it seems that each company has different interpretations beyond exactly what it says and/or what it does not say.  Regardless of Poncho's intent of being responsible for warranty work up to 30 days after Closing, which was May 2021, I greatly appreciate Poncho's assistance in resolving my warranty work issue.

On 8/30/2023, technicians from Poncho's Solar Service came to replace the panel and also completed paring the new panel and the inverter with the assistance of the inverter manufacturer.  On 8/31/2023, I verified the satisfactory performance of the new panel.  I would like to thank ****** from Poncho's for resolving my warranty issue and BBB for their assistance in this matter.

I purchased a 34 photovoltaic panels package from Poncho's Solar in 2018. It was working fine until May 2022 when ***************** turned it off due to "no final closing document" submission by ******'s Solar. I called Poncho's Solar ***** on 6/30/2022, 7/21/22, 11/18/22 and she said they would send someone to get the final closing document to HECO. I called Poncho's Solar again on 1/4/23, 1/9/23 and discovered that ***** no longer worked there, but ****** said she would assist me. I called Makana at Poncho Solar again on 2/17/23 and she said to send pictures of the meter. On 4/1723 I emailed ****** asking for a progress report. On 4/24/23 ****** sent an email "I am not able to help you with your request. I am in contact with my supervisor in trying to direct you to who would be able to assist you.      Dont understand why BBB has closed this case, I would likethis to remain an open case. HARU Solar not provided a real explanation to why my PV system has not been generating for the past year. On Feb 10th HARU. relocated 6 panels back to the original location and now my PV system is generating as it was before the relocated in April 2023. I want to get reimbursed for all the cost I paid for HARU to resolve and the increased in my electric bills since April 2023- Feb. 2024.

My wife and I had a solar/electric hot water system installed by Poncho's in 2013. It had (and was a major selling point) a 12 year service agreement (called a "12 year parts and labor warranty" in the contract). On September 22, 2022, I called in a request for service, on a pump problem for the solar portion of the system. No return call. I called again 9/29; they were aware of my prior call and promised a call back when Poncho was available to set a date. On 10/3, I left a message noting that I had also discovered a leak in the solar portion. No call back. I called again on 10/6, and was told they were "adjusting our schedule" to send someone out. I was promised an update. I called again 10/21 (no contact by ******'s in the interim). I called again with a message on November 8th: no call back. I called again on November 22nd, and was told ****** was on Maui and he'd have Poncho call when he got back. I sent a letter on November 28th, asking for a specific date no later than December 29th for the repairs. On 12/9, ******* said someone ("***") would call and come by and see if he could fix. No call, no ***. I left another message, and called again and was told I'd get a call back, ******* was on the other line. Later that day ***** from Aloha Solar left a message. Aloha did come out, inspect, order a part, scheduled a repair for 12/30/22; ***** then called on 12/29 to say Poncho's wouldn't let them do the work: Poncho would come out to do that and general maintenance in January. On 1/4/23, ***** called again and said ****** refused to set any definite date to do the repair, and they weren't permitted to do the work under the service agreement. No contact from ******'s, though. On 1/5 I left a message asking for a return call by January 9th if they intended to do the work. No contact from ******'s.
