  We're looking to build a house with them. Signed contract gave deposit. Contract stated non refundable however they did not have a builder to build. Tried 3 times to rectify but they could not provide a builder. I feel we were scammed into fraudulent contract. Could not provide service. Have tried several times to get refund but to no avail. Looking to get money back and let others know not to deal with this business

  Business Response /* (1000, 9, 2021/06/14) */ The customer wanted to build a custom home and sent a 5000 deposit to cover the costs of drafting the home. They went back and forth with the drafting company and designed a large 2 story home. The cost of the drafting services used the 5000 deposit. Unfortunately do to the cost of the home and the customers financial situation they were not able to obtain financing to start the project. In trying to find a less expensive home the customer reached out the to drafting company and paid him directly to design another home that would cost less. It was smaller home, but unfortunately during the time from when they started designing and completed the design, lumber prices had increased by more than 100%. They decided not to proceed with the project. They are not entitled to a refund as all the deposit they sent was spent on drafting services. We were told the original deposit would be credited to any home we would build with Walter Family Homes. They had no builder to build any house. The original deposit was to cover the plans and permits. No permits were never ordered the blue prints were never completed. We were advised we should at least be entitled to a refund of $2500 as the drafting company was not paid the entire amount as they did not complete the plans. When we went for smaller house we were advised to deal with drafting company on our own and not through Walter Family homes which we did and paid them out of our pocket. As stated previously contact was falsified as they could not build the house Why did they advise us the would credit us with the $5000 on any other house they would build? As previously stated contract was fraudulent as they drew up a contract with no builder They tried 3 times with 3 different homes and no builder in each case. Therefore they were committing fraud Business Response /* (4000, 31, 2021/08/03) */ I sent the contract stating that the deposit was non refundable There is also a 10% cancellation fee in the contract that we did not choose to enforce
