    On March 18 and 19 I zelled a total of ******* to **** *******, the representative/wife of *** (******) (******) for the Deposit per his invoice emailed to me. The floor prep began March 21 to install epoxy in garage, *** texted me and stated he put down acid, and text said Saturday he would sand and grind, he came Saturday ( did nothing) and sent another text that he put down acid and a text asking for $300 more dollars, I declined. On Sunday he came stayed 10 minutes and said he needed to go to ****** to get epoxy, he was gone approx 4 hours, because it was getting late,and nothing was done I ended the day, and put his equipment/materials away in my garage because I was leaving my home for the night. He called, I explained that I was showering and would open the garage for him when I get dressed so he could get the stuff and come back another time to complete. I let my garage up and he began getting the tools and materials, and the police walked up onto my property and said they were there to make sure he got his equipment etc, he obviously thought I wanted to keep stuff. I was dumfounded that he would call the police to my home for no good reason, I hired him, he was working for me. By calling the police he has nullified any agreement, he had the audacity to text and say he would be back to finish the job, no **** he called the police to my house, he will not be allowed on my property, I asked him for the money spent for the epoxy material he took with him, he has refused to give me the materials only portion of my deposit back. I am seeking assistance with getting the materials portion of my ******* back. He shucked work for three days and was constantly asking for money.

    And response to this complaint, First of all when I was hired for this project, I was assured that I would have unlimited access to the garage area since the customer worked nights Big and obviously I worked during the day. This turned out to be very challenging as there were several days where I could not get access until 1 oclock in the afternoon when I had been on site at 8 AM, 9:30 AM, 11 AM and finally received a call around 1210 to have access at 1 PM. After the first day of the project The homeowner notified me she had plans to go out of town she had forgotten about and I would need to come back on the 15th of the following month to complete the project. We explained to her we have a very busy schedule therefore we would not be able to reschedule for the time she would like, but we could certainly reschedule for a later date. She responded with thats OK. I will go ahead and cancel my plans. I assured her I did not want her to cancel her plans and that we would just reschedule. She was adamant about not rescheduling. therefore, we began the project as scheduled and ran into the problems of having access. Again upon the second day to gain access for the project, I was told by the homeowner that she was no longer home and would not be home until the 15th of the month. Myself and three coworkers witnessed her standing outside of a neighbors house, four doors down while on the phone with me stating she was not home and I was not able to get access to the garage to get my tools and equipment out. Therefore, I felt like I had no choice but to call law-enforcement to keep the peace and assure I could get my equipment. There was absolutely no discussion of her being in the shower and she would let me into the garage momentarily. After law-enforcement arrived, she did open the garage and allow me to get my tools and equipment. But not before. I do have all of the texts between the homeowner and myself in addition to the before during and after pictures of the work we were performing and also the police report for them responding out due to her behavior. I did text and assure her that we would come back at a later date to complete her project And she refused to respond to my emails and texts. Im not sure why she says Im refusing to give her her deposit back when first of all she has not requested that and secondly, my contracts clearly stated that deposits are nonrefundable because they are used to purchase the material for the project which was done and left there at her property
