I contacted this particular dealership 2 weeks ago regarding a truck they had for sale I found on Auto Trader. I put a deposit of $1,000 down on the truck due to me being a out of state buyer. I flew in the following week to physically look and test drive the truck with all intentions of me purchasing it. Prior to me physically seeing the truck the salesman did provide photos of known issues with the truck. When I arrived at the dealership I inspected the truck and took it for a test drive. Vehicle ran great till you hit 65MPH then the whole truck shook due to the tires being not unbalanced. The truck also vibrated when the brakes were used due to warped rotors. Truck was in need of tires, brakes and rotors approx. $2,000.00 I brought these issues to the sales guy and the took another $800 off the price. Personally for me the deal was not worth it due to the issues that arrived during test driving. I told them I would not be moving forward with the deal and the team became ignorant with me. I asked for the deposit back and they replied "You aren't getting that back". Their reasoning was they don't have to give it back and explained the pricing and issues over the phone. They DID NOT however explain to me it needed tires, brakes and rotors. A legal contract was never signed or the deposit was never mentioned to be non refundable via text, email or phone call. As of right now I have contacted my credit card company to report it and they will be getting contacted by them. I do NOT recommend this dealership due to shady business.

    To Whom It May Concern:

Mr. ***** negotiated a deal over the phone and was well aware that we are taking the vehicle offline and placing it sold with a deposit to give him time to fly down here and pick up the vehicle. We instructed him it was non-refundable. He came down to the dealership and loved the vehicle. Due to the vehicle possibly needing tires and front brakes he noticed on the test drive only going over 65 mph we offered Mr. ***** the price we already negotiated from $12,800 out the door to $10,800 out the door. Mr. ***** was trying to lowball us at $9,500 out the door and we just could not justify that low of a price. We took $2,000 off the price being $10,800 and he refused the deal. Keep in mind Mr. ***** flew from ************** to ******* for a 2006 **** F-350. Due to our already low pricing and no availability of this vehicle in or near his area. We are sorry Mr. ***** is not taking responsibility for his own actions, and he wanted a 2006 to be a brand new vehicle and blame the dealership, when we were being more than reasonable by taking off the 2k and he knew the deposit rules. Mr. ***** used the condition thinking he could low ball us further at $9,500 out the door. We strive to do the right thing 100% of the time and we were more than reasonable and fair.

I am rejecting this response because: Dealership is providing inaccurate information:

    1. "Vehicle possibly needing tires". Tires were bald and and well below tire manufacture wear bar. Tires were also out of balance allowing the truck NOT to pass the speed of 65+mph without truck shaking, resulting in truck unsafe to drive.

    2. "Vehicle possibly needing brakes". Truck vibrated aggressively when hitting brakes at any speed. Salesman stated "This issue started this morning", which is a false statement due to brakes not failing within hours.

    3. "Instructed him the deposit was non-refundable". Salesman never stated the deposit was non-refundable, over text and calls.

    4. ******** failed to provide other faults with truck: Air bag light on, which will fail inspection. Rear window broken and unable to open.

    5. Dealership stated "truck was inspected by 3rd party and was cleared" but failed to provide any documentation.

    Sincerely,

    *** *****

We were more than fair with Mr. ****** We sent him pictures of the vehicle and condition before he flew down. We let Mr. ***** know before he placed a deposit on the vehicle it was "Non-Refundable" due to the fact that we are placing a sold sign in the vehicle and removing it offline. When he arrived here, he loved the vehicle after taking it for a lengthy test drive but wanted to lowball our agreed low price even further due to his concerns. We offered him an additional 2k more off the price to compensate for brakes and tires etc. since he was from out of state, and he decided to walk away. This vehicle was far from unsafe it passed inspections and could be driven anywhere! Where are the pictures of bad tires and brakes? Mr. ***** is not a mechanic but simply wanted us to make it new instead of used. Why didn't he take the 2k we offered him off the price which was more than enough for ANY repairs? We were more than reasonable and Mr. ***** made the choice.

Had a transmission go out in my old vehicle, that same day my father helped me out by driving me to get a new used one. Came here and they knowingly sold me a vehicle with transmission problems as well. They claimed they inspected it well, however the transmission fluid wasn't even covering the dipstick! And there are codes for it on a diagnostic! Everytime I ask them for help to resolve the issue, I get ran around to different mechanics just for them to tell Billy Ballew the same thing. It's the transmission! 12+ mechanic have already told me the same thing, and now the warranty I got with my vehicle won't even cover my issue. I have a child and I am the ONLY driver in my household and this is the only car I have now. I need a reliable form of transportation, not another expensive problem I can't afford to fix.

    Business Response

Dear Mr. *************** are sorry you are having these issues. We sold you the vehicle on 8/29/2024. You purchased a 14-year-old vehicle and you test drove it and everything was fine. We strive hard to make sure the vehicles have no issues even though they are used. We provide an inspection report on every vehicle we sell but that doesn't guarantee anything and down the road anything can happen that's why we sell the warranty coverage. I am not sure why the warranty is not covering the vehicle but that is between you and the warranty company. You have a right to cancel the coverage, and they will prorate any unused portion back to you or your finance company if it is still under a loan to pay the loan principle down with the prorated amount if you choose to do so. Cars in ******* are sold as/is with no guarantees. You must do your own due diligence prior to the purchase, and we welcome every customer to do so and take the vehicle for a pre-purchase inspection with your own mechanic. If you had a vehicle with transmission problems before, I am not sure why you didn't do that for peace of mind. We consider this case closed and hope you do as well.

    Best Regards,

    Billy Ballew Motorsports LLC

I purchased a truck from them on 8/28/2024. In doing so I traded in a vehicle that had a payoff. Upon signing agreements with a 15 day payoff, the truck has not been paid off as of 10/5/2024. Causing me to have to pay two payments on a vehicle they already sold

Please accept this response for the claim made. Unfortunately the original payoff package with the check to pay this unit off was misplaced by our overnight parcel service. Upon receipt of the claim to BBB, on October 7, 2024, Notifying of no payoff,  we immediately paid the unit off directly to the lien holder.  We spoke with Mr.***** ******* and we reassured this was completed. While obtaining the updated payoff the amount did not decrease, in fact increased due to daily interest being accrued and no payment made. We issued the payment for the full payoff amount due within our bill of sale contract, as well as the accrued interest balance. We spoke with Mr. ******* to notify the completion of his payoff to satisfy this claim against Billy Ballew Motorsports.

    To whom it may concern,

The customer had the car inspected by a Third party dealership and passed the inspection with flying colors, the loan also included a warranty that is still in good standing. We are truly sorry that the vehicle had an issue, but we sold the car by Georgia law "AS-IS" with all paperwork and contracts showing this. ****************** did reach out to us threatening and overall being rude about the situation. I called on numerous times to try to hear her side of the story and explain what the warranty covered and what it did not. This was also explained to her during the sales transaction.

We have no control on how the car was taken care of or was driven when it leaves our car lot.
****************** has done nothing but threaten, cuss and harass us.

As far as selling her a "Lemon" the vehicle had a clean Carfax and Autocheck report which clears it of any Lemon Law status with a Carfax buyback guarantee.

We are a completely transparent company that posts the Carfax to every car sold as well as to allow time to have a car inspected if the customer chooses to do so. Again, we are sorry if the customer had a bad experience but cannot help at this time due to Georgia Implied Warranty Liability Laws.

    To whom it may concern,

The above mentioned consumer was charged $450.00 for transport of the purchased unit to the address of the buyer. Billy Ballew Motorsports had to reserve then pay in advance the transport company since the customer wanted a rushed delivery. The consumer was advised of the situation on several occasions before charging her CC that she gave to us for payment of said transport.

AT the last hour the customer called and said they had a "Family emergency" and had to cancel the vehicle purchase, at this point I told them that we could not get our/ her money back since it was so last minute.

The customer has since disputed the CC charge and at this time we decided to accept the dispute to her CC company, even though we are well within our rights. We at Billy Ballew Motorsports would like to just move on from this customer.

    Thank you,
